First, the Inspection Review. A partial Overhead Rough/Hydro Inspection was requested for the 2nd Floor addition of piping. [2] Seismic Restraint was not installed per updated plans for the 2.5" cross mains. Failed/additional inspections as part of inspection phasing will require additional inspection fee of $161.00 each inspection. I have cleared the Partial OH Rough/Hydro in the permit system as this portion of the system is not intended to be covered and can be inspected again as part of a future additional/partial inspection. Thus, avoiding a reinspection specific to this section and requiring fees. Items still need to be addressed. NOTICE OF VIOLATION This "Notice of Violation" is being provided in application to CA Health & Safety Code, Ch 5.5 Automatic Fire Extinguishing Systems Certification, Article 4. Enforcement, § 927. Violations. The SFM, SFM Designee or AHJ is authorized to inspect project worksites where work on fire protection systems is being performed to ensure that persons performing the work possess valid certifications or registrations as required by this Chapter. The SFM, SFM Designee or AHJ is authorized to require persons performing work to provide proof of applicable certification or registration card. Any person who cannot show proof of certification or registration to the SFM, SFM Designee or AHJ shall be subject to Sections 928 through 932. It was observed that Cal -West Fire Protection (CSLB: 870249) had 2 employees present and working at the project location of 79315 Highway 111, La Quinta, CA 92253 under La Quinta Fire Permit FSS2020-0159, performing install work and in violation of the following: H&S § 925. General Provisions. An Apprentice or Trainee shall become registered in accordance with the provisions in Article 5. H&S § 934. Employer Responsibility. Every properly licensed contractor performing installation of water-based fire protection systems shall ensure all fire sprinkler fitters under their employment are certified or registered. The licensed contractor shall notify the Office of the State Fire Marshal in writing within seventy-two (72) hours from the date of hire of an employee's status as a trainee, apprentice or certificate holder. H&S § 937. Fire Sprinkler Fitter Trainee Registration. d) Individuals may perform work within the scope of these regulations for no more than ninety (90) days prior to submitting an application to the OSFM. e) The trainee shall work under the direct supervision of a Certified Fire Sprinkler Fitter at all times and shall do the following: 1) Only perform installation of water-based fire protection systems for a properly licensed California Contractors State License Board C-16 contractor. 2) Be registered into a California State or federally approved fire sprinkler fitter apprenticeship program within one (1) year of their date of hire. Alejandro Moreno -Diaz (A010634 — Trainee) was identified as "one of the lead" workers on the installation work. There was comments received that the Journeyman level Sprinkler Fitter was not present and was only on the job a couple times a week. Additionally, Moreno-Diaz's certification is well past expired. The second individual (Name not documented) was identified as a "laborer" and was not able to provide any SFM Sprinkler Fitter Certification information. In the coming days and weeks I will likely perform unannounced site visits and will ask all observable persons performing work on the fire sprinkler system to provide their Sprinkler Fitter Certification Cards. Please confirm receipt of this notice and advise if you have any questions. EMAIL TO CAL -WEST AND GC: Today's inspection was communicated as being the "final" of the rough partials, however there were some rough elements that were yet to be completed, most notably the drops to the elevator hoistway pit with the indicating(tamper) control valve and water flow switch, & the connection of the new portions of the system to the existing risers. A thorough inspection was nevertheless conducted and thorough notes were taken to document changes and missing elements or corrections, where identified. The inspection essentially failed and requires correction with reinspection. Attached you will find the latest plan set with the inspection notes provided in (Purple) notation to stand out from the red piping details. I will attempt to list elements that are corrections requiring reinspection and separately identify elements that are for notation for revised as-builts that will be required for thorough documentation. Corrections: • More than 20 locations were identified as missing the cut- out coupon being affixed in proximity to the connection. (Comment from "Trainee" lead fitter Alejandro Moreno -Diaz that he will go check the truck to see if he could find them - is unsettling. Such flushing operations shall be performed by Sprinkler Fitter classification and in the presence of the General Contractor (Kevin Ham) Following the flushing of the system to the liable comfort of Cal West — Fitter/Management and the pleasure of the General Contractor — Cal West shall provide a letter on company letter head documenting the actions taken and satisfactory results. This letter shall be wet -signed by the Fitter and the General Contractor and then provided to the La Quinta Office of the Fire Marshal for documentation and record keeping. *This is in addition to the check -box detailed in the NFPA 13 Contractor's Material and Test Certificate for Aboveground Piping required as part of System Acceptance. • 2 locations were noted with painted heads — see plans for locations • Several locations were identified as "Missing Head" and confirmed as reasonably needed based on construction elements and required spacing. Install where "Missing Head" is noted. • 2 portions of pipe, affecting 3 heads was twisted — causing the head deflectors to not sit level, but a drastic angle. —see plan for locations • 1 location was identified as needing to be relocated for conduit obstruction — see plan for location • Portions of the main -runs appear to have had seismic installed at dimensions exceeding their maximum spacing. Possibly 2 lengths of 4 -inch have exceeding lateral seismic restraints. • The existing front covered patio now converted to enclosed self -storage space and display windows is still provided with existing sprinkler coverage of unconfirmed density and hazard design. Installation crew does not intend to remove existing and install new portions of system in this location as the plans show, and wants Cal West designers to confirm that Printed: Friday, February 24, 2023 11:23:27 AM 5 of 24 RWSYSiEMS the supply to this portion of the system from the 2nd story supply main is adequate for the Ordinary Group 2 rating. Plans need to clearly identify if this system is to remain, its piping arrangement, pipe size and the 1 or more points of supply. o The plans need to correctly identify the added heads in the 3 window display bays. o Plans also need to correctly identify the existing coverage and head location in the still exterior shade canopy - see noted area on plan. • The 3 -window display bays were drywalled and connection of the new heads was not able to be confirmed even after cutting small access areas. *Cut-out coupon missing was identified at only 1 accessible of these locations. Reinspection needs to be able to adequately show the connection to existing/new overhead lines. • The elevator hoistway pit protection needs to be installed per plan with an indicating control valve and waterflow switch independently supplying the pit sidewall. (x2 locations) • Provide penetration protection in all fire rated assemblies in compliance with NFPA 13 standards and the CBC. • A transition portion of the main of System 1 was not completed per plan. See plan notes for the location of 3 -inch pipe that reduces off of a T -fitting of the 4" main to a 2.5" main. • I forgot to confirm the name of the Cal West Foreman (Jose Moreno, or Gregory Bartholow?) - As the SFM Certified Sprinkler Fitter, they must be present on the job site whenever a Registered Trainee and/or Apprentice (or uncertified) installers are working on the system (CA H&S 937 item (e) / H&S 938 item (c)). Commentary with the Sprinkler Fitter identified that he has not been constant on the job while these uncertified/unregistered Trainees and Apprentices were performing all of the work. Overhead Rough/Hydro — Partial inspection for the 1st floor additions to the system were not approved. 2. Significant modifications made in the field that were not compliant with the approved (revised) plans dated 5/4/2021. Portions of the mains were rerouted and moved to deal with architectural impacts. 3. It appeared that the field installers were not provided the current approved set of plans and were following the original approved plans for the seismic restraint installation locations. This is of minor concern as the seismic installed is excessive to what was approved in the revised set. 4. You need to confirm that the existing coverage is (1) supplied and charged, (2) is of appropriate calculation for Ordinary Hazard Group -II if you would like to keep the existing coverage. a. If not keeping, portion of system should be demoed/improved per approved plans. b. As-builts shall reflect either option. 7. I had already observed some and even directed the need for CalWest to reasonably mitigate. I'm sorry to hear that they are merely putting a band-aid on the long-term issue. This building has been suspected to have had MIC (Micro- biologically Influenced Corrosion) in the fire sprinkler system since my observation of it on 10/23/2019. 1 observed it while inspecting work related to the neighboring tenant's construction improvements. I gave direction to that General Contractor to have a licensed C-16 Contractor to perform a needed NFPA 25 5 -Year Certification of the system. The contractor acquired local company Desert Fire who certified the system at that time. Alternatively, a C-16 Fire Protection Contractor may be tasked with performing a whole system investigation for other areas of corrosion or obstruction concerns. Attached are excerpts from NFPA 25, the standard for maintaining these systems. Annex D provides good information on the impacts and concerns of corrosion, especially that of MIC. I have also provided the Permit Details for the Floor & Decor permit which has my correspondence on this matter highlighted on page 3. Please let me know if you have any questions. Kevin advised that they have had a total of 3 leaks in the system due to observed MIC internal pipe corrosion. Cal West Fire Protection went out and did minor pipe replacement repairs. I will be discussing property owner and tenant improvement contractor options for addressing the long-term issue. Such flushing operations shall be performed by Sprinkler Fitter classification and in the presence of the General Contractor (Kevin Ham) Following the flushing of the system to the liable comfort of Cal West — Fitter/Management and the pleasure of the General Contractor — Cal West shall provide a letter on company letter head documenting the actions taken and satisfactory results. Install where "Missing Head" is noted. • 2 portions of pipe, affecting 3 heads was twisted — causing the head deflectors to not sit level, but a drastic angle. — see plan for locations • 1 location was identified as needing to be relocated for conduit obstruction — see plan for location • Portions of the main -runs appear to have had seismic installed at dimensions exceeding their maximum spacing. Possibly 2 lengths of 4 -inch have exceeding lateral seismic restraints. • The existing front covered patio now converted to enclosed self -storage space and display windows is still provided with existing sprinkler coverage of unconfirmed density and hazard design. Installation crew does not intend to remove existing and install new portions of system in this location as the plans show, and wants Cal West designers to confirm that the supply to this portion of the system from the 2nd story supply main is adequate for the Ordinary Group 2 rating. Plans need to clearly identify if this system is to remain, its piping arrangement, pipe size and the 1 or more points of supply. o The plans need to correctly identify the added heads in the 3 window display bays. o Plans also need to correctly identify the existing coverage and head location in the still exterior shade canopy - see noted area on plan. Reinspection needs to be able to adequately show the connection to existing/new overhead lines. • The elevator hoistway pit protection needs to be installed per plan with an indicating control valve and waterflow switch independently supplying the pit sidewall. (x2 locations) • Provide penetration protection in all fire rated assemblies in compliance with NFPA 13 standards and the CBC. • A transition portion of the main of System 1 was not completed per plan. See plan notes for the location of 3 -inch pipe that reduces off of a T -fitting of the 4" main to a 2.5" main. • I forgot to confirm the name of the Cal West Foreman (Jose Moreno, or Gregory Bartholow?) - As the SFM Certified Sprinkler Fitter, they must be present on the job site whenever a Registered Trainee and/or Apprentice (or uncertified) installers are working on the system (CA H&S 937 item (e) / H&S 938 item (c)). Commentary with the Sprinkler Fitter identified that he has not been constant on the job while these uncertified/unregistered Trainees and Apprentices were performing all of the work.
