The approval of this Minor Use Permit amendment does not extend the operational time limit of two (2) years as set forth in M U P2022-0008. • The proposal is consistent with the general plan and provisions of the zoning code. The proposal is in compliance with the requirements of the California Environmental Quality Act (CEQA) and would be exempt from CEQA pursuant to Section 15304, Minor Alterations to Land. • The proposal would not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. • The proposed flag poles are temporary in nature and would be placed in an area that does not block the line of sight. CONDITIONS OF APPROVAL: 1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Minor Use Permit amendment. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense.
