Chairperson Nieto announced the applicant for the project requested a continuance of
the public hearing to a date certain of February 13, 2024, to allow additional time for public
outreach; polled the Commission and received a consensus to approve the request for
continuance; advised the public of the option to reserve comments until the proposed
project is considered by the Commission on February 13, 2024.

disruption qualities of STVRs; STVRs decreasing value of surrounding homes; noise
pollution and violations caused by STVR guests; and incompatibility with surround
community.

increased crime and trespassing concerns with STVRs; law enforcement's inability to

in the Development Agreement which states "reserves the right to change" occupancy

Staff answered questions regarding the temporary and permanent structure types and
reasons for the delay in construction and installation of the telecommunication facilities.

PUBLIC SPEAKER: Brett Smirl, applicant and Project Manager for Coastal Business
Group representing AT&T, introduced himself and answered Commission questions
regarding the status of the temporary and permanent facilities; provided a proposed
timeline of the installation of the temporary structure; and explained the reasons for the
delay in construction and installment of the previously approved structures.
Commission Secretary Flores said that no written public comment had been received and
that there were no requests to speak on this item.

DECLARATIONS REGARDING COMMISSION PUBLIC CONTACT — None
Associate Planner Fernandez presented the staff report which is on file in the Design and
Development Department.
Staff answered questions regarding details of the site plan, including setbacks and height
for the Village Commercial zone; fire and general safety standards for glassblowing
studios; and area maintenance between perimeter walls.
CHAIRPERSON NIETO DECLARED THE PUBLIC HEARING OPEN AT 5:51 P.M.
PUBLIC SPEAKER: Ken Parsons, applicant and Architect for the project, introduced
himself and provided additional information regarding fire and building safety regarding
the proposed use; and the reduction in parking spaces provided.
PUBLIC SPEAKER: Jason McQuaid, applicant and owner of McQuaid Studio, introduced
himself and provided a brief history of his company and art; additional information
regarding commercial insurance for the studio; air quality, fire safety, and building safety
measures taken regarding the glassblowing studio; proposed use of residential units on
the site; expected furnace noise levels.
Mr. Parsons provided additional information regarding the site design, architectural style,
and massing of the buildings.
Commission Secretary Flores said that no written public comment had been received
regarding this item.
PUBLIC SPEAKER: George Christopher, La Quinta — expressed concerns regarding the
limited size of the residential units and number of stories per building in relation to City
standards and building code.

PUBLIC SPEAKER: Betty Saidel, owner of neighboring business Old Town Artisan
Studios — in support of the project and said that there was no noise heard from the existing
temporary studio to her business in proximity.
PUBLIC SPEAKER: Larry Bakstad, La Quinta, and neighbor to the proposed project — in
support of the project and the art community.
CHAIRPERSON NIETO DECLARED THE PUBLIC HEARING CLOSED AT 6:08 P.M.
The Commission expressed its general support for the project; Commission discussion
followed regarding appreciation for the art and mixed-use components of the project; that
the applicant being a long term resident; the additional benefit to other local commerce;
the project providing short -stay opportunities for students; the unique buildings
architecture; concerns regarding minimum square footage for residential units within
commercial zoning; building materiality and design components, including large walls at
east and west side elevations; lot lines and setbacks on the site.
CHAIRPERSON NIETO DECLARED THE PUBLIC HEARING RE -OPEN AT 6:17 P.M.
PUBLIC SPEAKER: Mr. Parsons provided additional design information, particularly
regarding the east and west building walls of concern; setbacks and property lines; and
building and property ingress and egress.
Detailed discussion with the Commission, Architect, and applicant followed regarding
architecture; using some of the interior wrapping materials on the exterior of the buildings
to provide additional design elements on the east and west side facades to the greatest
extent possible, and additional glazing in the form of clerestory windows at the east side
of the building. Architect and applicant were agreeable to adding Conditions of Approval
to this effect.
PUBLIC SPEAKER: Craig Bagus, La Quinta — in support of the project and suggested
adding glass tiles to the design to promote the glassblowing studio.
PUBLIC SPEAKER: George Christopher, La Quinta — in support of the project;
questioned the residential units being used as STVRs; suggested EV charging stations
and Art in Public Places on the site; and promoted utilizing the roof as a patio deck or a
barbeque area for the residential units.
PUBLIC SPEAKER: Nicole McQuaid, co -applicant — introduced herself and made
additional suggestions regarding art displays and metal design components as
architectural treatments to the building design.

MOTION — A motion was made and seconded by Chairperson Nieto/Commissioner

RECOMMENDATION
Consider the applicant's request for continuance of the public hearing for a Development
Agreement (DA2022-0001) to give the applicant time to conduct more community outreach.
EXECUTIVE SUMMARY
• The Estates at Griffin Lake project consists of approximately 40 acres located on the
south side of Avenue 54, east of Madison Street, and includes 78 single-family lots,
one residential estate lot, and common lots for amenities and streets (Attachment 1).
• The project was approved by Council on May 5, 2015, and included a Specific Plan
Amendment, Tentative Parcel Map, Site Development Permit, and Tentative Tract
Map.
• The applicant is proposing a Development Agreement (DA) to allow for Short -Term
Vacation Rental (STVR) permitting for the 78 single-family lots.
• The Planning Commission (Commission) held a public hearing on January 9, 2024,
where the public hearing was continued to a date certain of February 13, 2024, at
the applicant's request, to allow time for the applicant to conduct more community
outreach. The applicant wishes to conduct another meeting with the community and
is requesting another continuance to a future date.
BACKGROUNLiyA VALYSIS
The Estates at Griffin Lake project, located on the south side of Avenue 54, one quarter
mile east of Madison Street, consists of a 39.8 -acre residential development with 78 single-
family homes, one residential estate lot, and common lots for a lake, community building
and private streets (Attachment 4). The project was approved by Council on May 5, 2015,
and included Specific Plan (SP) 2014-1001 Amendment 1, Tentative Parcel Map (TPM)
36745, Site Development Permit (SDP) 2014-1003, and Tentative Tract Map (TTM) 36744.
Extensions for the SDP and TTM were recently granted by Council on June 20, 2023.

PUBLIC REVIEW
The public hearing notice was advertised in The Desert Sun newspaper on December 29,
2023, and was sent to property owners and occupants within a 500 -foot radius of the
project site, in accordance with the noticing requirements of the La Quinta Municipal Code.

This morning's edition of The Desert Sun has a front page article titled "Neighbors Fight Proposal for 78 Short -Term
Rentals."
As you know, in 2015, Council approved the "Estates at Griffin Lake" development for single family homes, with NO
short-term rental capability, on the former Mery Griffin property located on Avenue 54 between Jefferson and
Monroe. This development would be consistent with the directly neighboring residential developments of Griffin Ranch
and The Madison Club which also do not allow short-term rentals. The communities of PGA West Greg Norman,
Hideaway and Carmela are nearby and also do not allow short-term rentals.
The developer has submitted to the Planning Commission a request for an exception to the City's current ban on
short-term rentals except in specially zoned areas. This request will be considered by the Planning Commission in
February.
As Griffin Ranch residents, my wife, Ellan, and I are strongly against granting an exception to the City's short-term
rental policy for the "Estates at Griffin Ranch" development. Such exception is totally inconsistent with the neighboring
communities, and would hurt our quality of life and property values.

A year ago I moved from Palm Springs and purchased my lovely home
in Griffin Ranch. The sole reason I did this was to live in private and
secure residence. I was also looking forward to the establishment
growing in the price structure for my secure retirement as they have
been growing in prices.
I would not have purchased my home in Griffin Ranch if I knew they
were gg to be building rentals next to my property. The issues are not
having the security or privacy as I have come accustomed to and the
price of my home declining instead of rising due to rental properties.
Griffin Ranch has already put up with the whole month of April of
partiers and loud crowds, transients, streets being blocked off. We
put up with this and I know if we add on the rental homes it will be
100 times fold.
I am seriously thinking maybe I should sell my dream home that I
worked all my life for and carefully decided to purchase and find
another place that I would have to another place that would fit my

needs. And at this time in my life it would be an extreme hardship just
pick up and start all over. I am extremely sad that I may have to do
this.
The rental homes were okayed back in 2013. That was 11 years
ago. That ruling should not be allowed to be okayed for a hundred
years. If is was okayed back then in 2013 then that's when they
should have built their stick built homes and I would not have
purschased my home here today.

My husband and I have lived in Griffin Ranch since April 2012, nearly 12 years. During
that time our community grew from approximately 70 homes to full build out at 283
homes. There are many full time residents who moved into the community because of
it's quiet location and nice homes.
The proposal by MDM for 78 STVRs on the Mery Griffin Estate is incompatible with ALL of
the criteria set forth in the La Quinta municipal code.
Excerpt of the code below;
Section 9.25.020 of the Municipal Code governs Development Agreements. It provides
(subsection C.8) that the Planning Commission must consider whether the
Development Agreement
"a. Is consistent with the objectives, policies, general land uses and programs specified
in the general plan and any applicable specific plan; Not consistent with the 2015
specific plan which was approved for marketable single family homes, not STVRs.
b. Is compatible with the uses authorized in and the regulations prescribed for the land
use district in which the real property is located; the city cannot ban STVRs (done in
2021) and then allow 78 of them alongside a community which does not allow them
c. Is in conformity with the public necessity, public convenience, general welfare and
good land use practices; Not a public necessity or convenience .... in fact this is a public
nuisance, especially noise into the early morning hours and security concerns.
d. Will be detrimental to the health, safety and general welfare; Detrimental to property
values for Griffin Ranch and the still unbuilt 37 Capstone lots. Safety and security
problems have already occurred every time the Mery Griffin Estate is leased for an
event without exception.
e. Will adversely affect the orderly development of property or the preservation of
property values; There is the distinct possibility that the Capstone lots will become
unsellable to a builder if the proposed STVR project is approved. Griffin Ranch property
values will be adversely affected once potential buyers become aware of the STVRs.
f. Will have a positive fiscal impact on the city." This is the ONLY positive aspect of this
proposal and comes at a very high cost to the La Quinta citizens who reside in the area.
The planning commission should disapprove the MDM proposal for the many reasons
stated above. The project is an unwanted and unnecessary nuisance for La Quinta
residents and taxpayers.

We live on Mery Griffin Way in Griffin Ranch.
We are opposed to the development of 78 STRV's at the Mery Griffin Estate property. Our
reasons are as follows.
1). MGE property is in a residential zone, with the exception of the 5 adjoining acres where
the main house is located, is not approved for STVR operation.
2) owner developer, if permitted to build STVR's intends to own all 78 homes and operate
as a hotel with a 5 acre amenities area including an event area. Clearly a commercial
operation in a residential area.
3) 2019 city appointed committee found the city was woefully ill equipped to manage
existing STVR's. This lead to a 2021 moratorium against future STVR's being approved.
4) the owner operator has consistently displayed a lack of consideration for surrounding
neighbors with over 100 complaints/violations in the past 18 months for noise and dust
management coming from the property. The concept that someone can't handle 1
property should be considered for 78 more is preposterous.
We hope that you consider the above and reject this applicant and application. None of
you would consider living in a home next to this proposed circus.

Dear Commissioners:
The proposed zoning change to allow 78 short term rental homes replace 78 single
family homes within Tract Map 36744, adjacent to Griffin Ranch and Madison Club, is
not in keeping with property use expectations considered appropriate or desirable by an
overwhelming number of residents in Griffin Ranch and likely Madison Club.
The same would be true through La Quinta, in any instance where a tract of 78 rental
homes were considered for approval adjacent to tracts of owner -occupied single-family
homes.
Most residents share the opinion that the City of La Quinta already has enough short-
term rentals. Additionally, though short-term rentals represent a revenue stream for the
city, the adverse impact on home values in Griffin Ranch and Madison Club have the
potential to reduce collective home values far more than the revenues gained by the city.
This would occur because of a required real estate disclosure on the part of homeowners
marketing their home for sale in each of these communities. Commensurate with said
disclosure, potential buyers would view an adjacent tract of 78 rental homes as
undesirable, likely to the point of being a liability.
Residents of La Quinta are supportive of our city receiving additional revenues, which
is why a majority of voters voted for a 1% sales tax increase with said revenue going
directly to the city. However, approving a tract of 78 rental homes adjacent to hundreds
of homes in a bedroom community is not an appropriate way to gain community support
and increase city revenues. Should a zoning change be approved by the city council,
voter support will likely dwindle for incumbents who support this requested zoning
change when affected homeowners next vote for City council candidates. This would
be most unfortunate, considering the outstanding work done by the current city council
members.

Lastly, the city has had more than enough experience with municipal code and or
contractual agreement violations involving events at the Mery Griffin Estate, where
violations have run the gamut with examples as follows:
1. Sound volume violations have been far in excess of City of La Quinta Noise
Ordinance Section 9.100.2.0 standards both before and especially after 10:00 pm
2. Trespass violations have involved individuals climbing over the Griffin Ranch
perimeter wall to enter Griffin Estate through the side yards of Griffin Ranch
Homeowners.
3. Large numbers of individuals, far more than the maximum attendance stated in
the event planners Agreement with the City, have attempted enter Griffin Estate
planned events. In one instance, during one of Golden -voice's music festivals, it
was reported that hundreds of individuals attempted to 'crash' the Griffin Estate
event. This has not been a one-off occurrence, as noted in #2 above.
Before he left working for the City, Carlos Flores was responsible for overseeing the
signing off on the event Agreements with the property owners of the Griffin Estate. The
problems associated with violations of event Agreements were frequent and significant
to the point that the property owner was once prohibited from scheduling events for two
(2) years.
The records, hopefully maintained by Mr. Flores on this property, should be examined
by members of the Commission in this regard. Following review, only one question
needs to be asked as follows: Does the City of La Quinta want code enforcement to be
required to deal with similar violations involving 78 short term rental homes adjacent to
Griffin Ranch and across the street from Madison Club.

To the La Quinta Commissioners,
Asa resident of Griffin Ranch (my address is 54940 Secretariat Drive), I would like to register my very firm
opposition to the re -zoning contemplated in MDM's Development Agreement to permit 78 new homes to
be used as short-term rentals.
My argument to support my opposition is as follows:
1. There is a lot of land in La Quinta that is zoned to allow short term rentals. As such, it begs the
question "whywould MDM propose a development that is dependent on short term rentals in a
Location that does not permit the intended use?". Given that property developers often make a
significant portion of their overall investment on the "lift" in value from re -zoning a property, it is
Logical. to assume that this anticipated "rezoning lift" is a large part of the motivation for proposing
the Griffin Ranch location.
2. The "re -zoning lift", is essentially a wealth transfer, from the residents of Griffin Ranch, to MDM,
the developer behind The Estates at Griffin Lake. It seems extremely illogical, and fundamentally
unfair, for the City of La Quinta to allow such a wealth transfer given that the home owners of
Griffin Ranch purchased their properties with the security of the existing "no short term rentals"
zoning, and MDM is attempting to change the zoning to extract excessive profits from their
investment.
3. More importantly the the impact on property values and excess profits to MDM, is the negative
implications on quality and life, and enjoyment of their properties, on the residents of Griffin
Ranch, While I am not certain of the average age of the residents of Griffin Ranch, an educated
guess would be 65 or older. We are people who have worked hard, and invested in a quiet
community where we know our neighbours, and we socialize together in a very harmonious
environment. Changing the zoning of the adjacent land that would become The Estates at Griffin
Ranch would threaten the tranquility of Griffin Ranch, and very seriously negatively impact the
enjoyment factor and quality of life of Griffin Ranch residents.
I respectively ask the Commissioners to reject MDM's application. If you approve the rezoning of this
property, how can residents of La Quinta have any peace of mind regarding the type of neighbourhood
they have invested in, and hope to enjoy into their future as la Quinta residents?

I reside in Griffin Ranch at 81517 Mery Griffin Way and wish to supplement the comments I
previously submitted.
The proposed project is essentially a hotel -- 78 units under common ownership, common
management, and an on-line booking system to allow transient occupancy. With at least 4 bedrooms
per unit, this is essentially a 250-300 room hotel.
I have been informed that, when he first informed the HOA board of his plans in December 2023,
Mark Majer said something to the effect: "think of it as a hotel."
A hotel is a commercial enterprise that does not belong in an area zoned for single family
residences. The La Quinta Municipal Code already recognizes that commonly owned "hotel like"
residences should not be treated as ordinary single family homes. Municipal Code 9.60.280
addresses residences sold as "timeshares" and provides:
"The City Council finds that timeshare facilities constitute a commercial hotel use. Due to the mixed
method of operation, hybrid ownership, the potential generation of large numbers of people and
vehicles, and the potential impact on the tourism -related facilities in the city, special development
criteria are warranted. Also, this section is intended to establish criteria by which timeshare facilities
will function as hotels/motels."
If a group of "single family homes" sold as timeshares require special regulation and should be
treated as hotel, then the La Quinta Estates proposal -- with even more transient occupancy than a
timeshare -- should be treated as a hotel.
The Staff Report submitted to the Planning Commission nowhere discusses the "hotel -like" nature of
the development. Moreover, there is no discussion of the legality of putting a "hotel -like"
development in an area zoned for single family homes.
I therefore request:
(1) The Planning Commission should refer this matter back to Staff and ask Staff to address the
"hotel -like" nature of the development.
(2) The Planning Commission should refer this matter to legal counsel for the City for an opinion as to
whether a "hotel -like" project such as is here proposed can legally be sited in an area zoned for
single-family homes.
(3) The Planning Commission should consider whether new provisions of the Municipal Code should
be adopted, similar to Section 9.60.280, to address "hotel -like" developments masquerading as single
family homes.

Dear Members of the Planning Commission,
We ask you to reject the development application submitted by MDM Enterprises Inc_
and Mark Majerovic for The Estates c@ Griffin Lake, which proposes the use of 78 new homes as
short-term vacation rentals.
The Mery Griffin Estate is classified as an STVR-exempt zone, with only the original 5 -
acre site (lot 79) subject to exemption from the STVR ban. 'rhe proposed new home sites (lots i-
78) are not approved for short-term vacation rentals and should stay that way.
This developer's proposed exemption is in the wrong place, at the wrong time, by the wrong
company led by the wrong person.
The Wrong Place
The proposed STVR exemption for 78 new homes would be right in the heart of the existing
Griffin Ranch community, which has overwhelmingly opposed the proposal,
I ) Over 30 letters to the planning commission before January 9`h oppose the MDM
Enterprises development plans for a Short -Term Vacation Rental ban exemption
detailing the concerns over noise, traffic, and property values. More are coming.
2) The law firm representing the Griffin Ranch Homeowners Association sent a letter to
the City opposing the STVR exemption_
3) The City has been given an ort -line petition that was included in that HOA letter that
lists 415 signatures opposed to the STVR plans,
4) Testimony from several residents of La Quinta at the January 9" planning
commission meeting opposing the MDM's STVR plans.
5) The representative of MDM Enterprises, Mark Majerovic, admitted receiving
comments and letters from the neighboring community raising concerns.

6) An article in the Desert Sun of January 19'' with the headline: "Developer wants 78
new short-term rentals in La Quinta, and neighbors cry foul." The article detailed
the "strong pushback from neighboring residents."
By contrast, when the City recently approved short-term rentals for the Polo Villas, there were
no objections from neighboring citizens, and the property is right by where the loudest events
would be held.
The Wrong Time
Less than 2 years ago Measure A that would have phased out short-term vacation rentals by the
end of 2024, except in a few exempt areas, was narrowly defeated by 308 votes out of over
15,000 total votes cast. It was so close the proposed ban was leading on election night, but the
no vote took a narrow lead a week later.
This is not the time to send a message to the community that despite strong community
opposition, the City will continue to expand areas for short-term rentals even where they are
strongly opposed. That would make a new Measure A inevitable.
In opposing Measure A two members of the City Council said that STVRs. in La Quinta
"generate $6 million in annual TOT revenues for the city to provide essential services." If the
City approves the MDM Enterprises request to make 78 new homes into short-term vacation
rentals it risks a revival of a new more effective ban that would reduce City revenues by $6
million.
The Wrong Company led by the Wrong Person
The company behind the request for a STVR exemption for "The Estates @a Griffin Lake" is not
clear. It may be "NOM Enterprises, Inc.," "MMM Investment Group," "Griffin Ranch Investors
LP," or the "Griffin Estate Investors, LP."
The representative of all of these entities is the same person: Mark Majer aka Mark Majerovic,
who rents the Griffin Estate property as MGE (ex peri encemge.coin).
In the last 18-24 months, there have been countless complaints about noise and other activities
on the Mery Griffin Estate property rented out by Mr. Majerovic. Attached are files from the
City documenting over a hundred of these complaints.
The record of these complaints is an overwhelming reason to deny the application by the same
company and same representative requesting 78 additional properties to become short-term
rentals. Instead, those properties can be sold as single-family homes consistent with the
neighboring communities of Griffin Ranch, the Madison Club and the Hideaway.
Instead, the question before the planning commission should be whether to revoke the permit or
zoning allowing the Estate parcel to continue short-term rentals. It also should be sold or rented
out on a long -terra basis in order to end the continuing nuisance complaints.

Because problems with short-term vacation rentals have become a major issue, in 2021 the La
Quinta City Council passed two ordinances amending chapter 3.25 of the La Quinta municipal
code related to Short -Term Vacation Rentals. The City banned new short-term rental permits
except in specially zoned areas, which meant that the Mery Giffin Estate is the only home on the
parcel allowed to operate as a short-term rental. The ordinance also provided tougher
enforcement provisions for the City to deny or revoke permits. It is under the new ordinance that
the existing authorization for the short-term rental of the Griffin Estate should be revoked and
any new permits for additional properties be denied.

arrived at 11:52pm on property. I was able to hear the music
from the corner of Madison and 54. 1 made contact with the
event coordinator. I informed them of the complaint that was
received and informed them of the city ordinance. she stated that
they do have a city permit but one was not shown. I then called
the local contact with no answer and a voice -mail was left. I then
spoke to the property manager and provided the same
information. he stated that they would start to shut it down
Immediately. music was started to go down at12:15pm. then the
event coordinator complained about the music coming from
Madison Country club. I informed her that I have yet to receive a
call but I will be heading over after this one is shut down. I
parked across on the north side of Ave 54. 1 was them
approached by Madison security. I informed the officer why I was
parked on the street and who I was. I then informed him about
the complaint for their property and asked if they could ask the
owners to shut it down. giving him the city ordinance for noise
after 10pm. he began to laugh and say that's not going to
happen. explaining that they've tried in the pass with no success.
that even the mayor has come by to speak with the property. so I
took it as his refusal to make contact with the owners. I then
informed him that I would then need to contact RSO for
assistance. he said go ahead. while speaking with dispatch. the
security officer asked for my full name. I only provided my first
name due to policy. I clearly stated that I'm a 3rd party contractor
with the city of LQ Code compliance. he then asks me to move
along while being parked on a public with signs being posted.
signs state no stopping at anytime from 4/14-5/2. not wanting to
cause more of an incident I moved on the south side of the road.
RSO arrived and I explained the situation and the complaint from
the event coordinator. adding that I was denied to drive into the
property since it is private property. he then asked for credentials
for the city and I could only provide the email I was given by
Kevin Meredith. he then asked me to follow him to the gate to
see if we can resolve the issue. we met with the officer in charge
for graveyard and they provided their side of the story and asked
me my las tname, i then stated the same as before unable to
due to policy. adding that I was being difficult. RSO asked if we
could drive in and shut down the party. the OIC asked if RSO
only and RSO asked me if it was OK. I said I am a contractor
with the city. the OIC said no only RSO. so again I was denied a
2nd time to come in. I just asked RSO to confirm the music is
shutting down. I stood by Ave 54 to confirm the time of the music
being turned off. music stopped at 1:15am. so no address could
be provided for Madison Country Club due to being denied
access. 81345 Ave 54 unknown if a permit was issued and the
end time for the even."
Other Paul 04/11/2022 11:10 am 0.25 After reviewing the entry from Associa DRM Officer Jose Pena,
Villanueva he received the noise complaint for this property at 11:30pm. He
arrived at the property at 11:52pm and he was able to hear the
music from the corner of Madison and Ave 54. He was able to
make contact with the P/M and had the noise turned down by
12:15am on 04/10/2022 which the Special Event Permit was
only good for one day (04/09/2022). At 12:00am on 04/10/2022,
the property would have to again follow the STVR operational
requirements of no radio receiver, musical instrument,
phonograph, compact disk player, loudspeaker, karaoke
machine, sound amplifier, or any machine, device or equipment
that produces or reproduces any sound shall be used outside or
be audible from the outside of any short-term vacation rental unit
between the hours of 10:00 p.m. and 7:00 a.m. Pacific Standard
Time. Due to the violations observed by Jose Pena an Admin.

look at the citation and the circumstances in which it was issued. The citation will stand
based on the following reason, please feel free to share with
• There are specific directions and time limits to request an appeal to an
administrative citation. The time for an appeal has been exceeded, no appeal
request was made to the Citation Processing Center and the full citation amount
has not been paid to date.
• The administrative citation was issued on April 11, 2022 for a violation observed
on April 10, 2022 between 12:00 a.m. and 1:15 a.m. by our Contract Security
Officer.
• The Special Event Permit: The only area that mentions when this event took place
is the MGE Reservation Summary, attached. It seems to indicate that the event
was for April 9, 2022, early afternoon and evening reception.
• The approval action letter as you know list general conditions for several events
and does supersede the STVR conditions while in effect. However, special events
have start times/dates and end times/dates, the events covered under the
approval action letter seem to be single day events, with the exception of the
Orban Wedding that clearly covered two days. This appears to be the case in the
application information as well.
• The 'application information", attached, states "Saturday wedding events, late
afternoon services followed by early evening receptions"

Hope all is well. Is there any update on how we can/should handle the citation from the Wilson Wedding? Do we need
to officially appeal it?
Our appeal is based on the fact our TUP permit is about music decibel levels for an event, not whether music is playing
after 10pm. We were in compliance for 9.100.210, which is referenced in our approved special permit and the citation.
The applicant shall conform to the City's Noise Ordinance (Municipal Code Section 9.100.210) and specifically the following noise limitations during
the event:

Before 10:00pm: Sixty-five decibels (65 dB(A))
After 10:00pm: Fifty decibels (50 dB(A))
If the noise consists entirely of impact noise, speech or music, or any combination thereof, each of the noise levels specified above shall be reduced
by five dB(A).

This approval authorizes the applicant to conduct the event pursuant to compliance
with all conditions of approval of this permit. The applicant must obtain any
permits, as may be required below, in order to physically set up the event.
CONDITIONS OF APPROVAL
Completion/confirmation prior to start of each event:
1. Up to eleven (11) indoor/outdoor events are approved within calendar year
2022. The total number of event participants, including staff, security and
guests, shall not exceed the amount provided in the application information on
file. The applicant is required to maintain a count of all event participants on-
site at all times during the event. The event count shall be maintained by
event staff at the main entrance and made available upon request by the La
Quinta Police Department, Office of Fire Marshal or City Staff.
2. Revised exhibits and specific event information for each event shall be
submitted 30 days prior to each event and will be reviewed by City
Departments. If event changes are significant from the approved event
exhibits and description, the Director may require a separate Special Event
Permit for these events and/or additions and modifications to the conditions of
approval listed in this letter. The City of La Quinta has information on file for
eight (8) of the allowed 11 events.
3. The remaining three (3) events out of the 11 events will require information to
be submitted to City staff 30 days prior to the event. However, if the event
proposed exceeds 500 guests and/or has traffic control proposed, it shall be
submitted 90 days prior to event date.
4. This event approval does not grant approval for the annual Coachella Festival
related event that occurs at this project site. Approval of this event would
count towards the 11 events allowed under this permit, but is to be reviewed
independent of this event and information must be submitted 90 days prior to
that event. Additional conditions, review, permits, inspections, and many
other aspects may be added as part of that event.
5. The applicant shall obtain all other applicable permits, if required, from the
appropriate agencies (i.e. Office of Fire Marshal, Building Department, Police

Department, Alcohol Beverage Control, etc.). This includes getting
appropriate City of La Quinta building permits for any structures that are part
of any event.
6. The applicant shall obtain an encroachment permit for any off-site signs. Off-
site signs shall not block the line of sight for traffic. Please contact Amy Yu at
(760)777-7047 for assistance on obtaining an encroachment permit.
7. All vendors shall obtain a City Business License prior to each event. The
serving of food and alcoholic beverages during the event shall be subject to
the rules and requirements of the Riverside County Health Department and
State of California Alcoholic Beverage Control, respectively. The applicant shall
provide the City with proof of ABC approval prior to the event.
8. A vendor list for each event shall be provided 14 days prior to event to ensure
they have obtained City Business License.
9. Fire inspection under the current scope and details provided for the "Regular"
and 'Large" special events of a wedding ceremony, or similar nature as
provided by the applicant and on file, do not require Office of the Fire Marshal
inspection for clearance to operate.
10. Planned events that have an increased attendance greater than 500 persons,
MAY require a separate specific Special Event application for permit. Contact
the City of La Quinta Planning Division and Office of the Fire Marshal to
discuss potential impacts.
11. Review of the submitted documents did not reference any planned use of
Temporary Amusement or Carnival Rides. Separate permit submittal and
approval of such is required by the La Quinta Office of the Fire Marshal.
Amusement and Carnival rides shall have current Cal/OSHA certification tag,
portable fire extinguisher with current annual service tag and be
installed/constructed on stable ground or foundation. All rides shall have a
stopping device within reach of the operator for use in case of an emergency.
Equipment Operators shall be trained in the specific operation of the particular
ride. The operator shall be in good health and of sound mind.

12. Review of the submitted documents did not reference any planned use of
tents or canopies. Therefore, tents over 400 square feet and canopies over
700 square feet require separate permit application with La Quinta Building
Division and Office of the Fire Marshal prior to installation and use, each
occurrence.
13. The applicant shall provide notification of each event to all properties within
500 feet of event site and/or surrounding Home Owners Associations (HOA's)
fourteen (14) days prior to each event. Notification shall include date, time,
event scope, and the name and twenty-four hour contact phone number of the
local contact person for the property and the police department. Proof of
notification shall be provided to the City of La Quinta Planning Division seven
(7) days prior to each event. In addition, the name and phone number of the
local contact person for the property shall be posted at all entrances to the
property.
14. Access and egress to all neighboring properties shall be maintained at all
times. If access and egress is not maintained, due to impacts related to the
event, to the satisfaction of the Code Compliance Division or Police
Department, the event permit may be modified, suspended or revoked.
15. The Design and Development Director may modify Conditions of Approval
regarding business hours, parking, occupancy and other operational conditions
should it be determined that after an event, the proposed uses or conditions
under which the events are being operated or maintained is detrimental to the
public health, welfare, or materially injurious to property, improvements or
other uses in proximity to the subject property, or if the subject property is
operated or maintained so as to constitute a public nuisance.
16. The Applicant and/or City staff may make modifications to circulation plan for
the events, including requiring/applying for Traffic Control to ensure of
adequate drop off during events, especially for the event of 400 people.
Modifications to circulation may include additional measures to ensure drop off
and pick up of guests does not create any issues along Avenue 54 or any
other surrounding streets.
17. The events shall have Noise Control Plans in place, and approved by Staff,
that will allow for monitoring of noise and allowances for Staff to ensure noise

control measures are in place for the event.
ComDletion/confirmation durina the event:
18. The set-up and operation of the events shall be consistent with the attached
exhibits and event information on file.
19. Security personnel shall be easily identifiable to the public by the provision of
uniformed personnel. All designated private security personnel must be
licensed by the State of California and possess a valid private security license.
20. Certain areas providing access to the event area are public and, as such,
general public access may not be denied or restricted in any manner that
extends beyond the limits of this event as approved.
21. The applicant shall conform to the City's Noise Ordinance (Municipal Code
Section 9.100.210) and specifically the following noise limitations during the
event:
Before 10:00pm: Sixty-five decibels (65 dB(A))
After 10:00pm: Fifty decibels (50 dB(A))
If the noise consists entirely of impact noise, speech or music, or any
combination thereof, each of the noise levels specified above shall be reduced
by five dB(A).
22. Portable generators shall be shielded to prevent accidental contact with
guests. Extension cords shall be ground -secured to prevent tripping. Any
lighting shall be directed away from surrounding roadways and surrounding
residential properties. No spot or searchlights are permitted.
23. Surrounding roadways and intersections shall remain readily accessible for
passage of emergency response vehicles and private vehicles. There shall be
no queuing of vehicles along all surrounding roads for the purposes of
dropping off for, picking up for, or entering the event.
24. If parking at any event exceeds what is approved, the parking options for the
next event will need to be modified and submitted to the Planning Division 30
days prior to the next event.

25. Roadways/traffic aisles to structures and activities in and around the event will
be maintained accessible to emergency vehicles at all times. Parking monitors
shall wear light-colored clothing and reflective vests as needed. Flashlights
shall be used after dusk.
26. The event is subject to spot inspections by the Police Department and/or City
staff to ensure compliance with the conditions of this letter.
27. No fireworks, or open flame, or any other device emitting flame or fire or
creating a glow capable of igniting combustibles shall be permitted.
28. No designated fire lanes, fire hydrants or any other Fire Department
appliances shall be blocked or obstructed. Fire lanes shall be clearly identified
in an approved manner throughout the event grounds by posting "NO
PARKING FIRE LANE" or other approved means. All motor vehicles shall be
parked in designated parking areas.
29. Generators (and/or internal combustion power sources) shall be separated
from buildings, temporary membrane structures, tents, canopies by a
minimum of 20 feet and be isolated from contact with the public [CFC
3107.16]. Additional fuel containers will not be allowed to be stored with the
generator. Each generator will need to have a lOBC fire extinguisher, with a
current service tag (within one year). Combustible material (including trash)
shall be kept clear of the generators.
30. Extension cords shall be over -current protected and/or ground -fault
interrupter protected. No additional taps are to be in any device. All extension
cords shall be of 12/3 gauge wire or greater with approved connectors.
31. Installations of rope or string lighting shall be in compliance with the
manufacturer specifications. Consideration for the number of "chains"
connected to a single outlet shall given.
32. At least one 2A10BC fire extinguisher, with a current service tag (within one
year), shall be provided at all vendor booths that are cooking. One Class K
type fire extinguisher, with a current service tag (within one year), shall be

provided for each vendor booth with a deep fat fryer. Deep fat fryers shall be
located outside tents and protected from the public, unless otherwise directed
or approved by The Department of Environmental Health and the Office of Fire
Marshal.
33. All L.P.G. tanks (empty or full) shall be secured with a chain or other approved
device to prevent tipping over/unintentional movement and kept a safe
distance from open flame. The pressure relief vent should be pointed away
from any open flame.
34. Accumulation of combustible material (including trash) will be prohibited near
any ignition sources within 30 -feet of the perimeter of tents and membrane
structures. Such waste shall be stored in approved containers and removed
from the premises not less than once a day.
35. Review of the submitted documents did not reference any planned use of
Mobile Food Preparation Vehicles (i.e. Food Trucks). Therefore, it is required
that any planned use of mobile food preparation vehicles equipped with
appliances that produce smoke or grease -laden vapors shall be approved by
separate permit application each occurrence. Site plans identifying proposed
location(s) of the vehicle(s) along with list of vendors contracted for the
service shall be included in the submittal. Vendors, vehicles and equipment
are required to comply with CFC Section 319 as well as obtain a City Business
License.
36. Smoking shall be permitted only in designated areas. Other areas shall have
approved "No Smoking" signs conspicuously posted and maintained.
37. Review of the submitted documents did not reference any planned use
Fireworks, pyrotechnics, fire performers and/or open flame; and shall require
a separate permit and approval by the Office of the Fire Marshal.
Completion/confirmation after the conclusion of the event (if necessary):
38. The event sites used shall be left clean and in its original manner after the
event. Temporary trash receptacles shall be provided in and around the event
areas. All event areas shall be left free of debris at the end of each day's

activities, and after the event concludes.
39. The City of La Quinta Police Department reserves the right to bill the event
sponsor for any lost police time, equipment, and/or any unforeseen loss that
may occur due to the event that requires police action.
40. Any damage to public hardscape caused by this event shall be repaired as
directed by the City Engineer. This includes but is not limited to sidewalks,
curb and gutter, landscaping, and pavement especially within the surrounding
public streets.

This was the response from our Compliance team:
The citation will stand based on the following reason, please feel free to share with E
• There are specific directions and time limits to request an appeal to an
administrative citation. The time for an appeal has been exceeded, no appeal
request was made to the Citation Processing Center and the full citation amount
has not been paid to date.
• The administrative citation was issued on April 11, 2022 for a violation observed
on April 10, 2022 between 12:00 a.m. and 1:15 a.m. by our Contract Security
Officer.
• The Special Event Permit: The only area that mentions when this event took place
is the MGE Reservation Summary, attached. It seems to indicate that the event
was for April 9, 2022, early afternoon and evening reception.
• The approval action letter as you know list general conditions for several events
and does supersede the STVR conditions while in effect. However, special events
have start times/dates and end times/dates, the events covered under the
approval action letter seem to be single day events, with the exception of the
Orban Wedding that clearly covered two days. This appears to be the case in the
application information as well.
• The "application information", states 'Saturday wedding events, late afternoon

Hope all is well. Is there any update on how we can/should handle the citation from the Wilson Wedding? Do we need
to officially appeal it?
Our appeal is based on the fact our TUP permit is about music decibel levels for an event, not whether music is playing
after 10pm. We were in compliance for 9.100.210, which is referenced in our approved special permit and the citation.
The applicant shall conform to the City's Noise Ordinance (Municipal Code Section 9.100.210) and specifically the following noise limitations during
the event:
Before 10:00pm: Sixty-five decibels (65 dB(A))
After 10:00pm: Fifty decibels (50 dB(A))

• There are specific directions and time limits to request an appeal to an

• The administrative citation was issued on April 11, 2022 for a violation observed
on April 10, 2022 between 12:00 a.m. and 1:15 a.m. by our Contract Security
Officer.
• The Special Event Permit: The only area that mentions when this event took place
is the MGE Reservation Summary, attached. It seems to indicate that the event
was for April 9, 2022, early afternoon and evening reception.
• The approval action letter as you know list general conditions for several events
and does supersede the STVR conditions while in effect. However, special events
have start times/dates and end times/dates, the events covered under the
approval action letter seem to be single day events, with the exception of the
Orban Wedding that clearly covered two days. This appears to be the case in the

Hope all is well. Is there any update on how we can/should handle the citation from the Wilson Wedding? Do we need
to officially appeal it?
Our appeal is based on the fact our TUP permit is about music decibel levels for an event, not whether music is playing
after 10pm. We were in compliance for 9.100.210, which is referenced in our approved special permit and the citation.
The applicant shall conform to the City's Noise Ordinance (Municipal Code Section 9.100.210) and specifically the following noise limitations during
the event:
Before 10:00pm: Sixty-five decibels (65 dB(A))
After 10:00pm: Fifty decibels (50 dB(A))
If the noise consists entirely of impact noise, speech or music, or any combination thereof, each of the noise levels specified above shall be reduced
by five dB(A).
I am hoping we can still do something on it. Any guidance is appreciated.

The Hearing Examiner has conducted a hearing and the circumstances regarding the issuance of your citation have
been carefully reviewed and considered and the results are shown above.
I have reviewed the citation issued by the citing Officer as well as reading your appeal statemert and hearing
testimony from you and the Officer. La Quinta Municipal Code Section 3.25.070(E) states: Occupants of the short-term
vacation rental unit shall comply with the standards and regulations for allowable noise at the property in accordance
with Sections 8.100.210 and 11,08.040 (or successor provision, as may be amended from time to time) of this code.
No radio receiver, musical instrument, phonograph, compact disk player, loudspeaker, karaoke machine, sound
amplifier, or any machine, device or equipment that produces or reproduces any sound shall be used outside or be
audible from the outside of any short-term vacation rental unit between the hours of 10:00 p.m. 9nd 7-00 a.m. Pacific
Standard Time. Observations of noise related violations shall be made by the city or its authonzad designee from any
location at which a city official or authorized designee may lawfully be, including but not limited to any public right-of-
way, any city -owned public property. and any private property to which the city or its authorized designee has been
granted access. Based upon the Officers testimony, the audible sound was not lowered till approximately 12:15AM.
Based upon the information before me, l find to UPHOLD the citation.
It has been determined that the action of the Officer was appropriate and the circumstances presented failed to
establish sufficient cause for the dismissal of this citation. This decision is final. If you wish to appeal further, please
follow the instructions below.
It this letter shows a balance due, and you have not submitted payment, submit payment in full at www.
Citation ProcessingCenter.com or call (800) 969-6158.
If you wish to contest this decision. you must do so by contacting the Court within your jurisdiction and filing the appeal
within 20 days of the date stamped at the top of this document. Should the results of the Administrative Hearing

The Design and Development Department has reviewed Special Event Permit 2023-
0007, pursuant to LQMC Section 9.60.170 (Special events - Residential), and has
approved the permit subject to Conditions of Approval, based on the following Findings:
A. The event will not be detrimental to the health, safety and general welfare of the
community in the area of the proposed event.
B. There is adequate area to conduct the event and to accommodate the anticipated
attendance. Sufficient parking shall be provided for the anticipated attendance.
C. Food service operations, medical facilities, solid waste facilities, sewage disposal
methods and potable water service have been provided.
D. Fire protection plans and facilities have been provided to the satisfaction of the
fire marshal.
E. Security plans and facilities have been provided to the satisfaction of the sheriff.
F. Public roadways providing access to the event are capable of accommodating the
anticipated traffic volumes in a reasonable and safe manner with minimal
disruption to local traffic circulation.
This approval authorizes the applicant to conduct the event pursuant to compliance with
all conditions of approval of this permit. The applicant must obtain any permits, as may
be required below, in order to physically set up the event.

CONDITIONS OF APPROVAL
Completion/confirmation prior to start of the event:
1. The applicant agrees to indemnify, defend and hold harmless the City of La Quinta
('the City"), its agents, officers and employees from any claim, action or
proceeding to attack, set aside, void, or annul the approval of this temporary use
permit. The City of La Quinta shall have sole discretion in selecting its defense
counsel. The City shall promptly notify the applicant of any claim, action or
preceding and shall cooperate fully in the defense.
2. The outdoor event is approved for September 3, 2023, from 9:00 am - 10:00pm.
The total number of event participants, including staff, security and guests, shall
not exceed 250 on-site at any given time. The applicant is required to maintain
a count of all event participants on-site at all times during the event. The event
count shall be maintained by event staff at the main entrance and made available
upon request by the Police Department, Fire Department, and/or City Staff. The
Police department and/or Fire Department can request reduction of total event
participants if amount of participants is detrimental to the health, safety, and
general welfare of the community in the area of the proposed event.
3. The applicant shall provide notification of the event to properties and Home
Owners Associations within 500 feet of event site, at least fourteen (14) days
prior to the event by August 21, 2023. Notification shall include date, time, event
scope, and contact information. Proof of notification shall be provided to the
Design and Development Department by August 28, 2023 and shall include the
following:
a) a map showing all properties within a minimum 500 -foot radius of subject
property,
b) a typed list of all property owners and their mailing address within a 500 -
foot radius, and all residents/tenants of said properties,
c) photographic evidence of addressed envelopes,
d) copy of the written notification, and
e) signed affidavit by the applicant that notices have been mailed or
delivered.
These items may be emailed to the Planning Division at
Planning LaQuintaCA.gov. Please provide the case number with
correspondence.
4. Applicant shall provide the Design and Development department with list of
contact(s) who will be on site during all event hours. Contact(s) will be
responsible to respond to calls or complaints regarding the condition, operation,
or conduct of event in a timely and appropriate manner. Contact information
shall be provided to Design and Development department by August 28, 2023____---

5. The applicant shall obtain all other applicable permits, if required, from the
appropriate agencies (i.e. Fire Department, Building Department, Sheriff's
Department, etc.). Building permits are required for all structures, including
tents and canopies, and portable generators.
6. All temporary tents and membrane structures having an area in excess of 400
square feet require permitting from the Fire Department. Exception: Tents open
on all sides having a maximum size of 700 square feet, including multiple tents
placed side by side, and a minimum clearance of 12 feet to all structures.
7. Based on review of proposed festival site plan applicant shall be required to obtain
separate Special Inspection permit from the Building Division for the following
temporary installations at least one (1) week prior to the event:
a. Temporary Electrical Installations. Examples of temporary installations
would be generator use, or setup of any transformers, subpanels or
receptacle branch circuits, but would not necessarily include cord and
plug lighting - Compliance with the California Electrical Code to be
demonstrated by plan submittal and review, this would include
generator specifications, whether fuel storage is proposed, equipment
locations, conductor specifications and conductor installation
requirements.
b. Inspections must be requested by the applicant in accordance with the
following:
i. Inspections are performed Monday through Friday between the
hours of 8:00 AM and 4:00 PM excluding Holidays.
ii. Inspections will not be scheduled more than one business day in
advance.
iii. Requests are accepted until 4:00 PM during normal business hours
for next business day inspections.
8. A Building Inspection and Fire Inspection are required. City staff conducting an
inspection may request additional or modification of conditions as they arise
during inspection. These additional requests shall be responded to in a timely
manner, prior to first use. Amongst many things, inspections may find structures
that are not per approved plans, not installed correctly, or additional structures
not previously identified. These issues may result in event being required to take
down, not utilize, and/or revise structure(s).
9. FIRE INSPECTION: Prior to this Special Event, you must be cleared by the Fire
Department by way of a Pre -Event Fire Safety Inspection. Applicant/installer shall
be responsible to contact the Fire Department to schedule inspections. Requests
for inspections are to be made at least 48 hours in advance and may be arranged
by calling (760)777-7131. Portable generators shall not be placed direct_ Ikon the

ground but secured and protected per CEC regulations. Extension cords shall be
ground -secured to prevent tripping. Any lighting shall be directed away from
surrounding roadways and surrounding residential properties. No spot or
searchlights are permitted.
10. Any building, structure, facility, complex or improved area, or portions thereof,
which are used by the general public shall be provided barrier free design to
ensure that these improvements are accessible to and usable by persons with
disabilities. Plans shall fully detail how the proposed festival complies with the
California Accessibility Standards defined in Title 24 Chapter 11B and Federal ADA
Regulations.
11. Provide operational permit from the Amusement Ride and Tramway Unit of
Cal/OSHA for proposed amusement ride equipment.
12. The applicant shall obtain an encroachment permit for off-site signs and traffic
controls placed within the City's right-of-way. Encroachment permit shall include
all applicable insurance, to be provided by City Risk Manager and Public Works.
13. All vendors shall obtain a City Business License. The serving of food and alcoholic
beverages during the event shall be subject to the rules and requirements of the
Riverside County Health Department and State of California Alcoholic Beverage
Control, respectively. Vendors shall have Business Licenses approved prior to
the date of the event.
14. Applicant shall adhere to Fire Department Conditions of Approval.
15. All rules and regulations from Chapter 3.25 Short -Term Vacation Rentals shall be
adhered to.
Completion/confirmation during the event:
16. The set-up and operation of the event shall be consistent with the attached
exhibits and event information on file.
17. Security personnel shall be easily identifiable to the public by the provision of
uniformed personnel. All designated private security personnel must be licensed
by the State of California and possess a valid private security license.
18. Certain areas providing access to the event area are public and, as such, general
public access may not be denied or restricted in any manner that extends beyond
the limits of this event as approved.
CALIFORNIA
19. The applicant shall conform to the City's Noise Ordinance (Municipal Code Section
9.100.210) and specifically the following noise limitations during the event:
Before 10:OOpm: Sixty-five decibels (65 dB(A))
After 10:OOpm: Fifty decibels (50 dB(A))
If the noise consists entirely of impact noise, speech or music, or any combination
thereof, each of the noise levels specific above shall be reduced by five dB(A).
20. Fire Lanes/Access [CFC 503]: No designated fire lanes, fire hydrants or any other
Fire Department appliances shall be blocked or obstructed. Fire lanes shall be
clearly identified in an approved manner throughout the event grounds by posting
"NO PARKING FIRE LANE" or other approved means. All motor vehicles shall be
parked in designated parking areas.
21. Generators And Internal Combustion Power Sources: Generators (and/or internal
combustion power sources) shall be separated from temporary membrane
structures, tents, canopies by a minimum of 20 feet and be isolated from contact
with the public [CFC 3107.16]. Additional fuel containers will not be allowed to
be stored with the generator. Each generator will need to have a 10BC fire
extinguisher, with a current service tag (within one year). Combustible material
(including trash) shall be kept clear of the generators.
22. Extension Cords: Extension cords shall be over -current protected and/or ground -
fault interrupter protected. No additional taps are to be in any device. All
extension cords shall be of 12/3 gauge wire or greater with approved connectors.
23. Heating And Cooking Equipment [CFC 3107.12]: At least one 2A10BC fire
extinguisher, with a current service tag (within one year), shall be provided at all
vendor booths that are cooking. One Class K type fire extinguisher, with a current
service tag (within one year), shall be provided for each vendor booth with a deep
fat fryer. Deep fat fryers shall be located outside tents and protected from the
public, unless otherwise directed or approved by The Department of
Environmental Health and the Fire Department.
24. All L.P.G. tanks (empty or full) shall be secured with a chain or other approved
device to prevent tipping over/unintentional movement and kept a safe distance
from open flame. The pressure relief vent should be pointed away from any open
flame.
25. Combustible Material [CFC 3107.19]: Accumulation of combustible material
(including trash) will be prohibited near any ignition sources within 30 -feet of the
perimeter of tents and membrane structures. Such waste shall be stored in
approved containers and removed from the premises not less than once a day.

CALIFORNIA -
26. Food Trucks: All food truck apparatus shall be of the motorized type to provide
easy relocating and evacuation in the event of an emergency or where otherwise
required. All food trucks shall have their own compliment of a minimum 2A1013C
(51b) fire extinguisher under current service tag. All food trucks that have fuel -
fire equipment shall be provided with adequate ventilation and a commercial
kitchen hood extinguishing system. The hood, plenum and duct shall be
maintained in a clean and safe operation. The hood suppression system shall be
operational and provided with current service tag.
27. Temporary Amusement Rides: Amusement and Carnival rides shall have current
Cal/OSHA certification tag, portable fire extinguisher with current annual service
tag and be installed/constructed on stable ground or foundation. All rides shall
have a stopping device within reach of the operator for use in case of an
emergency. Equipment Operators shall be trained in the specific operation of the
particular ride. The operator shall be in good health and of sound mind.
28. Designated Smoking Areas [CFC 3106.4.5]: Smoking shall be permitted only in
designated areas. Other areas shall have approved "No Smoking" signs
conspicuously posted and maintained.
29. Fireworks/Pyro/Fire Performers: Fireworks, pyrotechnics or fire performers shall
require an additional permit and approval. None proposed/permitted.
30. No fireworks, or open flame, or any other device emitting flame or fire or creating
a glow capable of igniting combustibles shall be permitted.
31. Surrounding roadways and intersections shall remain readily accessible for
passage of emergency response vehicles and private vehicles. There shall be no
queuing of vehicles along all surrounding roads for the purposes of dropping off
for, picking up for, or entering the event.
32. Roadways/traffic aisles to structures and activities in and around the event will
be maintained accessible to emergency vehicles at all times. Parking monitors
shall wear light-colored clothing and reflective vests as needed. Flashlights shall
be used after dusk.
33. The event is subject to spot inspections by the Police Department, Fire
Department, and/or City staff to ensure compliance with the conditions of this
letter.
34. Furnishings, decorations or other objects shall not be placed so as to obstruct
exits, access thereto, egress therefrom, or visibility thereof. Hangs and draperies

shall not be placed over exit doors or otherwise be located to conceal or obstruct
an exit.
35. Curtains, draperies, hangings and other decorative materials suspended from
walls or ceilings shall meet the flame propagation performance criteria of CCR
Title 19 in accordance with section 807.2 or be non-combustible. (CFC 807.1)
36. LP -Gas containers- shall be located outside and adequately protected to prevent
tampering, damage by vehicles or other hazards. Equipment such as tanks,
valves, tubing and other related components shall be approved.
37. Tents and Canopy(s) plans shall meet the requirements of the 2016 California
Building and Fire Code. Tents and temporary membrane structure having an area
in excess of 400 square feet shall obtain a permit by submitting plans to the
Riverside County Fire Department. If there are any questions, please contact our
office at (760) 346-1870.
38. Seating Access Title 19 requires, table and seating access width. Isles access
ways shall provide a minimum of 12 inches of width plus 0.5 inches width for
each additional foot or fraction thereof, beyond 12 feet of isle access way length
measured from the center of the seat farthest from an aisle. The length of travel
along the isle access way shall not exceed 30 feet from any seat to the point
where a person has a choice of 2 or more paths of egress travel to separate exits.
39. Tent with sidewalls require occupancy load signage, as approved by the Building
Official, shall be posted in a conspicuous place near the main exit. The location
shall be approved by the Fire Department. Posting shall be by means of an
approved durable sign having a contrasting color from the background to which
it is attached. No person shall deface, remove or change the occupant load on
the sign except as authorized by the Building Official and/or Fire Department.
40. Per the event information, credentials shall be required to validate invited guests
and vehicles allowed to enter event, in order to expedite entry to the event and
avoid the congregation of uninvited persons seeking entry. Credentials shall be
provided to invited guests prior to guests arriving on site. Credentials shall not
be provided at entrances to event site in order to avoid congestion along Avenue
54.
Completion/confirmation after the conclusion of the event (if necessary):
41. The event site shall be left clean and in its original manner after the event.
Temporary trash receptacles shall be provided in and around the event areas. All
event areas shall be left free of debris after the event concludes.

42. Any damage to public hardscape caused by this event shall be repaired as
directed by the City Engineer. This includes but is not limited to sidewalks, curb
and gutter, landscaping, and pavement especially within the surrounding public
streets.

By holding this outdoor event, the applicant agrees to indemnify, defend and hold
harmless the City of La Quinta ("the City"), its agents, officers and employees from any
claim, action or proceeding to attack, set aside, void, or annul the approval of this
temporary use permit. The City of La Quinta shall have sole discretion in selecting its
defense counsel. The City shall promptly notify the applicant of any claim, action or
preceding and shall cooperate fully in the defense.
The City may elect to add Conditions to this application request to mitigate any problems
that arise not previously addressed herein.

My wife and I are homeowners at Griffin Ranch in La Quinta. We bought our home on Mery Griffin Way in
2020 after spending over a year researching and visiting different communities in the area. The primary reason
for our purchase here was the safety and security of Griffin Ranch, as well as the peace and solitude of the
community.
We are well aware of the consequences of living near short-term rental units as we own a short-term rental in
another part of the country. We are very concerned about the impact this could have on our community's
lifestyle and property values. There is considerable documentation showing negative home value impact with
proximity to short-term rentals. We are currently experiencing significant noise and privacy issues related to
the rental of Mery Griffin's estate, which holds regular events for transient visitors.
Adding 78 units with 6-7 bedrooms each and allowing 2-3 people per bedroom would increase density to
levels that will be disruptive for traffic and noise. This is the very reason we voted no to the STIR referendum in
La Quinta last year. Having lived in Indio, we are very familiar with this type of development there and have
seen the exodus of private homeowners in the surrounding areas, some of whom have moved into Griffin
Ranch. These homes generate significant noise, often hosting parties quite late into the evening and early
morning hours, and have been the cause of numerous noise and disturbance complaints.
The planning commission should also draw upon their recent experience with the surf park project, which was
turned down. In addition to the environmental impact, there was also significant pushback from nearby
homeowners regarding lighting, noise and visitor density in a very residential area. This area of La Quinta is
viewed as a quiet, serene destination for single-family homes. Adding 78 party houses is not conducive to that
image.

Dear Sir/Madam,
We are writing to you in relation to the proposed Estates at Griffin Lake development located at the Mery Griffin
Estate. We wanted to express our concerns and opposition to the proposed development and the significant
impact that it will have on our community in Griffin Ranch. We specifically moved to this wonderful area due to
your (La Quinta's City) posture on short-term rentals and the negative impact they have on building a long-term
community. We invested all our savings to purchase our home in Griffin Ranch on the basis we would stay
here long-term. This planned development would most definitely put our investment decision at risk, as it is
proven that having short-term rentals, in close proximity, will severely impact the values of surrounding
residential homes.
Our community is a quiet residential location with no short-term rental activity. We have already had to suffer
many events held at the Mery Griffin Estates with noise pollution into the early hours of the morning and
security issues with people climbing over walls into our community so they can then scale the walls into the
Mery Griffin estate to "sneak" into an event. With the proposed development these types of issues will become
the norm due to the scale and nature of the development and the population they are targeting who will have
little care for our community as they are mainly coming to town to party.
I attended the planning meeting last week and was appalled when the representative from MDM stood up and
suggested he tried to do an "Outreach" to the local community to "no avail". The facts are that MDM provided
pertinent information to our community representative 2 days before Christmas, and then said he was
unavailable to meet for much of the time leading up to the planning meeting this week. So, I am not convinced
that MDM really care about the local community and how we feel about this development.
Thanks for your time and consideration on this matter and we trust you will make the right decision to keep La
Quinta an area that is focused on building a welcoming and warm community that is the envy of the other
surrounding cities.

I am writing this letter to the planning department to voice my disapproval of the Griffin
Estate proposal. My name is Joel Traina, my wife Vicki and I moved from San Jose to retire in
Griffin Ranch a year ago September and are full time La Quinta residents. What convinced us to
live in La Quinta was the community feel of this town. We looked up and down the Palm
Springs corridor but were always drawn back to the quiet community feel of Griffin Ranch. We
invested our life savings from our home in San Jose to buy our home at the peak of the market.
We did our homework before making this major purchase, or at least we thought we had. We
researched the capstone lots adjacent to Griffin Ranch and what that development would
entail. Single family residences, not a problem. Read about the Mery Griffin Estate issues with
noisy parties. We knew these would be infrequent and we could deal with that. Also, we read
about the approved proposal to build 78 Single Family homes on the adjacent parcel to the
estate. Again, thought well that will increase traffic, but not a deal breaker.
Then, just after Christmas we receive a letter from our HOA outlining the developer's request
for an exception to make these short- term rentals. We had no prior notice of this exception
request. No letters from the developers or city. I was at the last hearing when Mark Majerovic,
the developer, stood at the podium, and said he tried to reach out to the community, but
response was weak due to the holidays. That is far from the real truth, he sent a letter to our
manager Adam, on 12/22(after he was out for the holidays) asking for a meeting but said he
would gone for the holidays till 1/7. This developer was hoping to fly this under the radar and
hoping the board would rubber stamp it for approval at the 1/9 meeting with no one
complaining. He only asked for another extension once he learned that the residents were on
to him and this new proposal to make the single-family residences short-term rentals.
The city of La Quinta has banned any new short-term rentals after the voters expressed their
hatred of them. To even consider trying to justify allowing an exception for the 78 parcels since
the Mery Griffin estate's one parcel is grandfathered for short-term rentals is quite the stretch.
From what I have seen, these will be 6- and 7 -bedroom homes. Legally a minimum of 12- 15
people per home, potentially 6 to 7 cars per home. Reality says people will stretch the
occupancy to justify the high price of the rental. Where will these people park? Sure, the
developer will say they have street parking within the property, until the project is complete
and then there is an overflow of cars. We have witnessed other communities with short-term
rentals where the line at the gate for check in stretches down the street, over an hour wait.
They have people parking their cars on the public streets and rolling their suitcases in. This
process continues every 3 days with short-term rentals. The Sherriff's department better be
prepared for a constant stream of noise and parking complaint calls every day and night.
From what I've read of this new proposal, the commission did not require new environmental
impact reports or parking studies. How is that possible? Going from 78 Single family residences
with one family, too a "hotel" style ownership is an entirely different impact on the community.
To summarize I can see no benefit for any resident of La Quinta to justify allowing this
exception to be granted. Allowing the developer to proceed will only set a precedent for
attorneys to argue to have other vacant parcels zoning changed to allow short-term as well. If
passed it will appear that the city and commission are being greedy and only concern is the

transient tax money. This project should not be another Silver Rock fiasco. Would you want this
next to your neighborhood? I think not, Vote No!

My family (of four) is strongly opposed to the proposed development of short term rentals at the Mery Griffin
Estate.
We purchased our home at Griffin Ranch seeking a quiet retirement, where we could take care of our disabled
son.
We have come to discover that when the estate is rented out (in its current configuration), the noise emanating
from the property is very disturbing. Many times the music goes late into the night, and we have trouble
sleeping. This is especially bad during the various musical festivals nearby on Madison. Short term rentals will
increase that noise exponentially, during the festivals AND during short term vacation "partying."
Lastly, when we purchased our home, we used a large portion of our retirement "nest egg," and are very
concerned about what short term rentals, adjacent to our house, will do to our property value.
PLEASE do not approve short term rentals at the Mery Griffin estate!

Dear Planning Dept for LaQuinta,
My husband and I bought our house at 54215 Cananero Circle in the Griffin Ranch last year in January. Part of
why we liked it is is because the neighborhood was quiet. We used to live in Trilogy not too far away but it was
too busy there with people coming and going with cars and golf carts. We are not in favor of renters in this
neighborhood at all. If we had renters there would be more traffic, more noise especially during Coachella and
Stagecoach with more parties going on here, and so forth.
Our wish is that a renting community could be all on its own rather than go into our quiet neighborhood that
takes pride at keeping it beautiful and peaceful here. I doubt if Mery Griffen would have wanted it that way as
well.

Dear Members of the Planning Commission,
I am writing to you in opposition to the proposed development at Griffin Estates which is on your agenda for
February13, 2024.
The owners of Griffin Estates have a long history of violating City laws and regulations. I believe there have been
over 300 police complaints lodged against them in the last several years. They have been and will continue to be a
bad neighbor and a source of poor reputation for the City of LaQuinta.
Griffin Estates is attempting to create an adult amusement park in the middle of a purely residential
community. They disturb the peace with every event they have on their property. Now they want to build short
term rental units to add to the noise and mayhem - a very bad idea for LaQuinta.
The approval of such a development will put additional unnecessary stress on our police services which are solely
needed elsewhere.
The adjacent community, Griffin Ranch, is home to 283 families - mainly senior citizens who are going to bed when
the parties at Griffin Estates are just getting going. Griffin Ranch does not allow short term rentals and we strictly
enforce noise codes on ourselves.
Also included in their plan is a lake. Who needs another lake in the desert?
My wife and I voted recently to continue short term rentals in LaQuinta for two reasons: 1) We did not want the City
to lose the tax income and 2) we did not think it was fair to people who invested in homes here to experience a
potentially catastrophic shortfall in revenue because of new regulations they could have not foreseen. If there is a
proliferation of short term rentals in LaQuinta , particularly in residential neighborhoods, I am sure there will be
another ballot measure to end short term rentals and there will be a lot more support - starting with every full time
resident of Griffin Ranch.
In conclusion, I would say that this is the wrong development, in the wrong place, by the worst possible developer.

I am writing you about the proposed Estates at Griffin Lake development located at the Mery Griffin Estate. I
am expressing my concerns and opposition to the proposed development and the significant impact that it will
have on the Griffin Ranch community.
When I selected this wonderful area, La Quinta, I did it to have a safe and quiet home to care for my mother.
We arrived in 2018 and immediately fell in love with the warmth and caring of the community and the pristine
care put into the village and surrounding lands. We specifically appreciated the peacefulness of the Griffin
Ranch and the sense of security in knowing the residents around us.
True, the noise is thunderous several times a year, and we saw strangers attempting to follow a resident through
the gates. We were prepared to tolerate this disruption because we were warned about the Coachella Music
Festival and even Stagecoach. We also understood about the AmEx PGA golf tournament close to Griffin
Ranch, but that was the extent of the planned events.
When we were moving in October 2018, we heard that Ironman was planned, which, again, we understood.
Renting the Mery Griffin Estate for corporate events or private galas does cause a disturbance; however, we are
usually warned before the party that it will occur, and there will be a start and stop time. Most often, the event is
managed as well as can be expected.
Placing 75+ short-term rentals within yards of our homes may be a bridge too far. We all know that short-
term rentals are not here for the quiet serenity of La Quinta but instead to party all day and night after they
attend the various events held in our valley. Griffin Ranch is NOT a short-term rental community; building
these transient accommodations within earshot will damage our residents on multiple levels.
I attended the planning meeting held on January 9th with many of my neighbors. I was shocked at how the
MDM representative presented the facts and appeared to be uncomfortable with the level of commitment and
enthusiasm of our community.
We are united on this issue, and I trust you will consider this as you decide.
Thanks for your time and consideration on this matter. We know you place the well-being of the city ahead of
corporate greed. We trust you will make the right decision to keep La Quinta the 'Gem of the Valley.'
