TUP 2024-0001 TKB & Haus of Poke Temporary Food Trailers (03.28.2024)111 e October 9, 2024 Mr. Bryan Newman 57565 Santa Rosa Trail La Quinta, CA 92253 M2aa -- CALIFORNIA SUBJECT: TEMPORARY USE PERMIT 2024-0001 MODIFIED AFTER ADMINISTRATIVE APPEAL 2024-0001 TWO TEMPORARY FOOD TRUCKS Dear Mr. Newman: The La Quinta Planning Commission (Commission) at its public meeting of July 9, 2024, considered the Appeal 2024-0001 of TUP2024-0001 and, pursuant to La Quinta Municipal Code Section 9.200.110(C)(6)(c), referred the application back to the administrative authority of the Director of the La Quinta Design and Development Department (Director) with directions to include additional conditions of approval addressing the following: use an alternate ground surface besides decomposed granite (DG) on the site that is compliant with ADA (Americans with Disabilities Act); review electrical power connections for safety; address handwashing and restroom availability; include landscaping, shade, and temporary furniture; provide a schedule of days/times of operation; and listing the City as a named insured on liability insurance; and the Commission authorized the Director to return the application to the Commission for consideration if deemed necessary by the Director. Based on the direction from the Commission, the plans and statement of operation (Attachment 1) have been revised sufficiently by the applicant such that the Director has deemed it unnecessary to return the application to the Commission. The La Quinta Design and Development Department (Department) has reviewed the updated plans and statement of operation, and per the Commission's direction, hereby modifies Temporary Use Permit 2024-0001, to operate two temporary food trailer(s) located on parcels 773-078-016 and 773-078-017, per the attached exhibits and information on file, pursuant to Section 9.210.050 of the La Quinta Municipal Code and subject to the following findings and conditions of approval. FINDINGS • The proposal is consistent with the general plan and provisions of the zoning code. The temporary food truck business is permitted as a Temporary Use. • The proposal is in compliance with the requirements of the California Environmental Quality Act (CEQA) and would be exempt from CEQA pursuant to Section 15304, Minor 78495 Calle Tampico I La Quints, California 92253 1760.717.7000 I www .laquintaca,gov e k M2aa -- CALIFORNIA Alterations to Land. • The proposal would not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity (Attachment 2). CONDITIONS OF APPROVAL: 1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Temporary Use Permit. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense. 2. The temporary use permit is approved with an expiration date of September 28, 2025. 3. The use of this site shall be consistent with the statement of operation provided to staff on file. 4. All operations, including outdoor operations, shall comply with the City of La Quinta's outdoor noise ordinance, per Section 9.100.210. 5. The applicant/operator(s) shall obtain a City Business License. 6. The applicant shall obtain all other applicable permits, if required, from the appropriate agencies (i.e. Fire Department, Building Department, Public Works, etc.). 7 The applicant shall obtain an encroachment permit for utilizing the public right of way. 8. The applicant shall obtain a new electrical permit for any additional electrical work as necessary to accommodate the food trucks. 9. Any damage to public hardscape caused by this use shall be repaired as directed by the City Engineer. This includes but is not limited to sidewalks, curb and gutter, landscaping, and pavement especially within the surrounding public streets. 10. The site is to be kept clean, tidy and free of debris or graffiti at all times. Trash receptacles shall be removed from the site by the end of the day. 11. There shall be no parking along Avenida Bermudas. 12. The pavers and synthetic turf shall remain in good condition. Any pavers that are damaged shall be replaced and the synthetic turf shall be recompacted and secured as necessary. Use of an alternate ground surface besides decomposed granite (DG) shall be compliant with the ADA (Americans with Disabilities Act). 13. The applicant shall review electrical power connections for safety. Consistent with Condition of Approval No. 22, City staff reserves the right to inspect at any time to review compliance with electrical power connections. 14. The applicant shall address handwashing and restroom availability. 15. The applicant shall include landscaping, shade, and temporary furniture, as appropriate, depending on weather conditions, anticipated customers, and other similar criteria exercised in the applicant's reasonable discretion to further customer comfort and favorable environment surroundings. 16. The applicant shall provide a schedule of days/times of operation to the Director or the Director's designee. 17. Tables, chairs and umbrellas shall be stored neatly and secured at the end of each day. 18. Any proposed lighting shall be reviewed by staff prior to installation. All exterior lighting shall be located and directed so as not to shine directly on adjacent properties. All exterior lights shall be compliant with the requirements per section 9.100.150 outdoor lighting. 19. All umbrellas shall have a weighted base of at least 50 lbs. 20. Any building, structure, facility, complex or improved area, or portions thereof, which are used by the general public shall be provided barrier free design to ensure that these improvements are accessible to and usable by persons with disabilities. The proposed facility shall comply with the California Accessibility Standards defined in Title 24 Chapter 11B and Federal ADA Regulations as applicable. 22. City staff reserves the right to inspect at any time to review compliance with this permit. Staff may add, modify, or revoke this permit if not in compliance with this permit or if activity is harmful to the public. Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding properties will be minimized. The City may elect to add conditions to this application to mitigate any problems that arise not previously addressed herein. Part of the requirements of being a Category 5 MFF is having a freshwater tank and an Instant water heater to provide hot water to our 3 -compartment dishwashing sink and our hand washing sink. Both sinks dump out wastewater to a wastewater tank for future disposal. Both tanks are filled or disposed of at our Health Department approved commissary Sacher Enterprises located at 83711 Peach Street in Indio. As it pertains to parking our food truck at 51125 Avenida Bermudas, we have secured permission in writing from the property owners during hours that are still to be determined. During these hours our staff plans and has been instructed to use the restroom facilities at the nearby La Quinta City Park.
