Responsibilities Ubaldo Ayon (760) 275-2789, Public Works Assistant Construction Manager, City of La Quinta will serve as Construction Manager for day-to-day operations. Bryan McKinney, P.E., Public Works Director/City Engineer shall serve as the Resident Engineer for the Project. 2. Responsibilities of the Contractor Conserve Landcare will perform contract work in accordance with the project plans and specifications. 3. General Discussion of Contract NTP issued on January 22, 2024, first contract day — February 5, 2024. Contractor shall begin construction within 10 calendar days, on or before February 15, 2024. All construction shall be completed within 60 working days, on or before April 30, 2024. Liquidated Damages - $2,000 per day beginning on the 61 st day. Early Completion Incentive — N/A All requests for time extensions shall be prepared in accordance with Section 1400, sub- section 6.4 of the General Conditions. Partial payments shall be made in accordance with Section 1400, sub -section 9 — monthly on a percentage of completion basis. No payment will be made for materials delivered to the site that are not yet incorporated into the work. City will pay 50% mobilization following satisfactory move in, remaining 50% will be paid following satisfactory project completion and demobilization. Contractor will warranty work for one year following acceptance by City. In accordance with the Project's General Conditions, Section 4.10, Contractor's Responsibility for the Work and Materials: Until acceptance of the work, the Contractor shall bear the risk of injury, loss, damage, to any part thereof (regardless of whether partial payments have been made on such damaged portions of the work) by the action of the elements or from any other cause, whether (or not) arising from non -execution of the work. The Contractor shall rebuild, repair, restore, and make good all injuries, losses, or damages to any portion of the work or the materials occasioned by any cause before its completion and acceptance and shall bear the expense thereof, except for such injuries, losses, or damages as are directly and approximately caused by acts of the City. Contractor's Schedule Critical Path Method (CPM) Schedule is required within 5 days — No progress payments will be processed until an initial CPM is accepted by the City. 6. Sub -Contracts Prevailing wage requirements are in effect. 7. Status of Materials Furnished by the Owner: N/A 8. Change Orders: Field directive changes will be confirmed in writing by Contractor. All change orders will be requested and processed as outlined in Modification Procedures within the Project Specifications. 9. Staking of Work and Material Testing: Construction staking and material testing will be provided by the City of La Quinta. Contractor shall request staking/testing activities 48 hours prior to need, utilizing City provided forms. 10. Project Inspection: Ubaldo Ayon, Mark Bustamante, and Ernesto Sanabria, City of La Quinta shall be the project inspectors. With Mark Bustamante being the primary inspector. Safety — Contractor shall maintain CAL OSHA Safety Standards and as outlined within the Green Book and Project Special Provision. Traffic Control shall be in accordance with the current version of the WATCH Manual and CAMUTCD. Traffic control measures are subject to approval by the City Engineer. 11.
