CEQA: THE PLANNING DIVISION HAS DETERMINED THAT THIS
PROPOSAL IS CATEGORICALLY EXEMPT FROM
ENVIRONMENTAL REVIEW PURSUANT TO PROVISIONS
OF SECTION 15301 OF THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA), IN THAT THIS
PROPOSAL INCLUDES ON -PREMISES SIGNS.

WASHINGTON STREET AND HIGHWAY 111.
EXECUTIVE SUMMARY
• The applicant proposes to amend the Point Happy Sign Program to allow
additional signage for second level tenants in Buildings 11 & 12 on the south and
west elevations located within the Point Happy center.
BACKGROUND
The Point Happy Sign Program was originally submitted in 2005 and has been
previously amended four times, not including amendments currently proposed. The
existing sign program allows for the following:
• Second level tenants shall utilize exterior awnings on the north elevation only.
• Lettering affixed to the north facing parking structure shall be back -lit "Halo"
letters.
PROPOSAL AND ANALYSIS
The applicant requests a fifth amendment to the sign program be approved for the Point
Happy center. The proposed amendment will provide additional signage to Buildings 11
& 12 located at 78-370 Highway 111 as described below.
1. The amendment will allow additional signage to Buildings 11 & 12 on the south
and west elevations. Second level (north elevation) tenants are allowed one sign
on the awnings, one sign on the parking structure, one sign on the south or west
elevations for a total of three maximum. Only three signs total will be allowed on
the parking structure per landlord approval.
2. The amendment will permit the use of standard channel lettering.
The proposed sign program amendment will not substantially alter the aesthetics of the
commercial center and will provide increased visibility for tenants occupying the second
level of Buildings 11 & 12. Future signs for this location shall be submitted under the
general sign permit process as they are identified and reviewed against the parameters
of this approval.
ENVIRONMENTAL REVIEW
The Design and Development Department has determined that this project is exempt
from environmental review pursuant to Section 15301 (Existing Facilities) of the
California Environmental Quality Act in that the proposed project includes on -premises
signs.

Sign program amendments are authorized by the Zoning Code and the proposed sign
program amendment is consistent with the purpose and intent of Chapter 9.160.
The sign program amendment would allow additional signage on the south and west
elevations for second level tenants in Buildings 11 & 12 located within the Point Happy
center. The sign program amendment is in harmony with and visually related to:
a. All signs within the planned sign program, via the incorporation of several common
design elements such as materials, letter style, colors, illumination, sign type or
sign shape. The new tenant signs would be similar in design to the existing tenant
signs.
b. The buildings the signs identify may be accomplished by utilizing materials, colors,
or design motifs included in the building being identified. The amendment allows
for larger identification for major tenants.
c. Surrounding development. Implementation of the planned sign program will not
adversely affect surrounding land uses or obscure adjacent conforming signs.
2. The sign program allows additional area in order to:
a. Allow signs compatible with other conforming signs within the Point Happy center.
The new signs will be similar in design to other tenant signs on Buildings 11 & 12.
b. To allow additional signage in proper scale with buildings and uses.
c. To allow additional signage that is compatible with other conforming signs in the
shopping center.

As conditioned, approval of the application will not create conditions materially
detrimental to the public health, safety and general welfare or injurious to or
incompatible with other properties or land uses in the vicinity. The proposed sign
program amendment design elements are consistent in size and scale with the
existing signage in the Point Happy center and surrounding commercial centers.
GENERAL
1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta
("City"), its agents, officers and employees from any claim, action or proceeding to
attack, set aside, void, or annul the approval of this Sign Program Amendment. The
City shall have sole discretion in selecting its defense counsel. The City shall promptly
notify the applicant of any claim, action or proceeding and shall cooperate fully in the

defense.
2. Any subsequent changes to the sign program, including sign size, sign placement
and/or sign design, will require a sign program amendment application to be filed with
the Design and Development Department.
3. Tenants shall obtain sign permits for signage permitted under this sign program.

The purpose of these criteria is to establish the sign standards necessary to insure coordinated
proportional exposure for all tenants while maintaining integrated compatibility with the projecfs
architectural design. The program is intended to allow each business room for ereativity within
limits oftheir store front width. The attached figures illustrate special concepts, sign locations, letter
styles and instal lationdetails thatmightbe utilized.
EN ERAL CR1TERiA
1. All signs and their installation must comply with all local building and electrical codes.
. No exposed lamps shall be permitted except as listed herein.
3. All tenants must have sign installed prior to opening for business and must maintain one or more
ofthe following signs:
a. individual metal Channel Letters with Plexiglas faces, interior illuminated_
Recommended colors are: lied, Blue, Yellow and Whine or other color with
LandlordlDeveloper approval.
b. Individual back -lit "halo" letters.
c. The detailed sign plans specific to each tenant and/or owner must be submitted and
approved before issuance ofa sign permit.
d. Compan logosinavarietyof forms, subject to the approval aftheDeveloper_
e. Lighted box with architectural elements matching building deign.
4. Upon removal ofany sign by tenant, any damage to the sign band fa will be repaired by
tenant or by Landlord [Developer at tenant cost.

6. Acccptable signage on doorsand windows is as follows:
a. Window signs: Any graphics applied to the glass of Pad or Shop buildings,
unless otherwise noted with this Sign Program, shall not exceed 5% of
window area and shall be subject to Landlord/Developer's total discretion and
approval. Any window sign displaying hours of operation, credit cards accepted,
and other such items shall not exceed a cumulative square footage of two ()
square.
b. Illuminated signs are permtted with the express written approval of
the Land] ordfDeveloper when in compliance with City regulations.
e. Numbers identifying the address of the premises.
d. A sign listing the store business hours.
e. A sign or signs displaying the credit card(s) accepted by the rnerchant.
All signs must be prepared in a professional manner.
g. Signs may not be hand lettered or scripted presenting an unprofessional
appearance.
7. All signing shall be of materials compatible with exterior building calms,
materials, finishes, and of a high quality of fabrication.
8. Except as noted in this Sign Program, no signing is permitted which does not
directly relate to the primary service or function of the tenants activity.
9. All signs shall be kept in a "like newt' condition. On notice by the
Landlord. Developer, a tenant will be required to refurbish any signing which sloes
not qualify as being an acceptable standard.
10. All signs and installation cif sums will con rorm to the appropriate building and
electrical codes and bear the U.L. Label.
11. Electrical service to tenant signs shall be the responsibility of each tenant.
1. Exceptions to these criteria must receive written approval.
13. Wording of signs shall not include the product sold except as part ofTemant's
trade name or insignia. No slogans or catchphr-ases are permitted as storefront
signage.
14. Storefront sighs may only list the Tenant's name as shown on his.,her lease. No
product names are permitted.
15. Tenants are encouraged to have signs designed as an integral part of the
storefront design with letter size and location appropriately scaled and
proportioned to the overall shorefront design. The design of all signs, includi11g
style and placement of lettering, size, color, material and method of
illumination, shall be subject to prior approval ofthe Land] ord,Dcveloper.

The design of all signs in the complex shall conform to this Sign Program. Sign plans
shall be prepared by a Iicensed and insured sign contractor. Sign plans for all signs,
shall be submitted to the Landlord/Developer for approval prior to submitting to the
City application for a sign permit. Only signs approved by the Landlord/Developer
shall be submitted for approval to the City of La Quinta. The Cornmunity Development
Director may approve signs for the City of La Quinta.

A sign prograrn for Point Happy cornmercial center, located in La Quinta, California, has been preparers
and a mended three (3) tirnes. It is now the Managers intent to amend it a fourth (4) tirne to clarify one
part of the Sign Program so future problems for permitting will not occur.
AMENDMENT to the original Sign Program and the other three (3) Amendments is as follows
In the event an owner or tenant of a parcel only has one user and that user desires to
enlarge their overall sign or lettering size they may seek approval from bath the Manager
and the city to do so and apply for an amendment. If the Manager approves the amendment
and the city allows for the permitting of the enlarge! sign then the city could issue a Sign
Permit for an extra Perrnitting Fee.
