trailer. The exterior surfaces of the trailer shall be painted (or
may be stuccoed) and in overall good condition.
7. No temporary signs are permitted unless separated approved
by this Department.
8. No exterior lighting for the trailer is allowed unless approved by
the Building and Safety Department. All security light fixtures
shall be hooded to prevent light glare from being cast onto
adjacent residential properties.
9. Install one 2A1OBC fire extinguisher inside the sales office.
10. A cash deposit of $1,000.00 shall be posted with the City
to ensure the office is removed from the site within 90 days
after the expiration of this permit. The deposit will be
refunded when the office has been removed.
11. The installation of parking lot improvements as shown on the
attached site plans.
12. Dust control measures shall be employed during construction of
the parking lot and sales trailer. Such control measures may
.include paving the parking lot and adding landscaping around
the parking area. A PM-10 may be required, if not already
approved under the original development plans.
13. The sales office shall be permitted to remain until February 7,
2006, unless a time extension is applied for, and granted by
this Department. The Community Development Director may
extend the permit for a set time period if needed. No fee is
.charged to extend this period.
14. The City may elect to add Conditions to this application
request to mitigate any problems that arise not previously
addressed herein.
15. The applicant/property owner agrees to defend, indemnify,
and hold harmless the City of La Quinta (the "City"), it's agents,
officers and employees from any claim, or litigation arising out
of the City's approval of this project. This indemnification shall
include any award toward attorney's fees. The City of La
Quinta shall have the right to select its defense counsel in its
sole discretion.

Fugitive Dust Control Bond
WHEREAS, the City of La Quinta, California, is prepared to authorize Santa Rosa
Development, Inc. , as Principal, to proceed with certain construction activities
pursuant to one, or more permits issued by the City, for various infrastructure improvements and/or
structures on, or associated with, privately -owned property generally known to the City and others as
Adams and Ave 48 ; and
WHEREAS, all such construction and demolition activities must be performed in such
manner as to conform with La Quinta Municipal Code, Chaper 6.16, entitled Fugitive Dust Control to
reduce fugitive dust and corresponding PM10 emissions; and
WHEREAS, said Principal is required by LQMC 6.16.050(A)(4) to ensure that Fugitive
Dust Control Plan # , prepared specifically for the subject construction site, is financially
secure by furnishing security for the faithful performance of the dust control activitities required in the
Fugitive Dust Mitigation Plan.
NOW, therefore, we the Principal and Insurance Company( of the West
as Surety, are held and firmly bound unto the City of La Quinta, as Obligee, in the penal
sum of Fiftv Thousand Dollars and 00/100
Dollars ($ 50,000.00 ) lawful money of the United States, for the payment of which sum well and truly
to be made, we bind ourselves, our heirs, successors, executors and administrators, jointly and severally,
firmly by these presents.
The condition of this obligation is such that if the above bonded Principal, his or its heirs, executors,
administrators, successors or assigns, shall in all things stand to and abide by, and well and truly keep
and perform the covenants, conditions and provisions in the said dust control plan and any alteration
thereof made as therein provided, on his or their part, to be kept and performed at the time and in the
manner therein specified, and in all respects according to their true intent and meaning, and shall
indemnify and save harmless the Obligee, its officers, agents and employees, as therein stipulated, then
this obligation shall become null and void; otherwise, it shall be and remain in full force and effect.
As a part of the obligaton secured hereby and in addition to the face amount specified therefor, there
shall be included costs and reasonable expenses and fees, including reasonable attorney's fees, incurred
by the Obligee in successfully enforcing such obligation, all to be taxed as costs and included in any
judgement rendered.
The surety hereby stipulates and agrees that no change, extension of time, alteration or addition to the
terms of the dust control plan or to the work to be performed thereunder or the specifications
accompanying the same shall in anywise affect its obligations on this bond, and it does hereby waive
notice of any such change, extension of time, alteration or addition to the terms of the dust control plan or
to the work, the specifications, or the conditions of approval of said plan.

The City Council adopted a Resolution granting conditional approval of the Final Maps
and Off -site & On -site Subdivision Improvement Agreements (SIA) for Tract Map No.
31310 and 31311, Market Rate and Senior Housing. I am transferring to you the two (2)
Final Tract Maps, eight (8) SIA's, and four (4) bonds for you to perform the following
tasks:
1. Sign and return the Tract Map.
2. Have the City Manager, City Attorney, and yourself sign the SIA's. Keep the
original and provide a copy for our files.
3. Keep the following original bonds:
a. Tract Map 31310 (Market Rate)
