SUBJECT: MODIFICATION BY APPLICANT 2024-0007
HYUNDAI DEALERSHIP ADDITIONS AND EXTERIOR MODIFICATIONS
Dear Mr. Mac Dermott:
The Design and Development Department has reviewed your request to make modifications to
the existing Hyundai Dealership located at 79025 Highway 111 (Subject Site). The proposal
includes the creation of a new single automobile display pad within existing landscaping, an
expansion of the showroom, an addition of an Electric Vehicle storage room, an increase in the
height of the parapet, and installation of molded architectural panels onto the exterior of the
parapet of the Hyundai Dealership.
Specific Plan (SP) 1997-029, Development Agreement (DA) 1997-002, Conditional Use
Permit (CUP) 1997-034, Site Development Permit (SDP) 1997-603, and Tentative Parcel Map
(TPM) 28524 were approved on July 15, 1997, for a multiple use development plan, including
an automobile dealership on the Subject Site. SDP 1997-603 was amended on November 17,
1998 (Amendment 1) and on May 18, 1999 (Amendment 2) which resulted in the approval of a
34,500 square foot dealership on the Subject Site. CUP 2009-120 was approved on July 14,
2009, to allow the sale of used vehicles at the Subject Site.
The additional showroom area is less than 10% of the original approved area and exterior
modifications are minor and will not result in a significant change in the original project as
approved by the decision-making authority. The expanded dealership building will result in the
requirement of 50 employee and customer parking spaces that will be provided on-site.
Therefore, the modification is approved as shown on the attached exhibit, subject to the following
conditions of approval:
1. The applicant agrees to defend, indemnify, and hold harmless the City of La Quinta
("City"), its agents, officers and employees from any claim, action or proceeding to attack,
set aside, void, or annul the approval of this Modification By Applicant. The City shall have
sole discretion in selecting its defense counsel.
The City shall promptly notify the applicant of any claim, action or proceeding and shall
cooperate fully in the defense.

The applicant shall conform to Specific Plan 1997-029 and all other corresponding
conditions of approval for CUP1997-034, CUP 2009-120, and SDP 1997-603 and
their amendments.

CALIFORNIA
3. The applicant shall inform the City of La Quinta's Planning Division of any subsequent
changes. Additional modifications may require subsequent review and may result in
additional condition(s) of approval.
4. Approval of a Sign Permit shall be obtained prior to the installation of any new sign.
Please be advised that additional signage and/or signage area may require an approval
of a Sign Program or Sign Program Amendment.
5. The applicant shall apply for and obtain all necessary City of La Quinta building permits
and grading permits as required.
FIRE DEPARTMENT
6. Indoor display of liquid and gas fueled vehicles shall comply with the following:
A. The engine starting system is made inoperable or batteries are disconnected.
B. Fuel in fuel tanks do not exceed one-quarter tank or 5 gallons (whichever is less).
C. Fuel tanks and fill openings are closed and sealed to prevent tampering.
D. Vehicles are not fueled or defueled within the building.
7. A permit is required from the Office of the Fire Marshal to modify the existing fire sprinkler
system.
BUILDING DEPARTMENT
8. Plans shall be prepared to the applicable code at the time of submittal for the building
permit. As of January 1, 2023, these are the 2022 California Building Codes.
9. Commercial projects are required to be prepared by a Licensed Architect or Engineer. On
each sheet of construction documents provide the preparer's name and telephone
number and electronic -signature and his/her stamp as prescribed by California Business
and Professions Code 5536.
