BACKGROUND In 2002 the Planning Commission approved the first Program amendment for the One Eleven Shopping Center (Center). This amendment establishes new sign allowances for the major tenants and shop tenants within the Center, to supplement the Program's allowances for the other existing tenants. PROPOSAL AND ANALYSIS The applicant requests a fourth amendment to the Sign Program (Attachment 1). The proposed amendment changes sign allowances for the Five Below retail store, located at 78950 Highway 111 along with the other major tenants and shop tenants in the center. The proposal is to allow a 138.47 square foot sign for Five Below, to identify the new retail store. The sign will be blue and white to match the major retailers' branding. The proposed sign program amendment also provides allowances for window signs to screen the stock area which is located on the right side of the store. Building D major tenants are also allowed to have 100 square feet of sign area as identified on page 2. Building D will be renovated with a new facade at a later date. The proposed sign program amendment will not substantially alter the aesthetics of the commercial center and will provide increased visibility to the new and existing retail tenants. This proposed sign program amendment is consistent with other sign programs along the Highway 111 corridor, allowing for additional sign visibility for buildings that are north of Highway 111. Future signs for this location shall be submitted under the general sign permit process as they are identified and reviewed against the parameters of this approval. ENVIRONMENTAL REVIEW The Design and Development Department has determined that this project is exempt from environmental review pursuant to Section 15301 (g) (Existing Facilities) of the California Environmental Quality Act in that the proposed project includes on -premise signs. Sign program amendments are authorized by the Zoning Code and the proposed sign program amendment is consistent with the purpose and intent of Chapter 9.160. 2. The sign program amendment would allow more square footage and visibility for individual signs in order to overcome a disadvantage as a result of the location of the commercial building and to increase visibility for patrons traveling on Washington Street and Highway 111. The sign program amendment is in harmony with and visually related to: a. All signs within the planned sign program, via the incorporation of several common design elements such as materials, letter style, colors, illumination, sign type or sign shape. The new tenant signs would be similar in design with the existing tenant signs. b. The buildings they identify. This may be accomplished by utilizing materials, colors, or design motif included in the building being identified. The amendment allows for larger identification for major tenants. c. Surrounding development. Implementation of the planned sign program will not adversely affect surrounding land uses or obscure adjacent conforming signs. 3. The sign program allows additional area in order to: a. Achieve an effect which is essentially architectural. The monument sign and building signs provides compatible and reasonable architectural designs. b. Allow a sign compatible with other conforming signs in the vicinity. The new sign will be similar in design with the other tenant signs on the building. c. To allow a sign to be in proper scale with its building or use. The individual business will be allowed signs and monument sign will be approved for a business. d. To allow a sign compatible with other conforming signs in the vicinity. 4. As conditioned, approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. The proposed sign program amendment design elements are consistent in size and scale with the existing signage in surrounding commercial centers. CONDITIONS OF APPROVAL 1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Sign Program Amendment. The City shall have sole discretion in selecting its defense counsel. Where these criteria and the City both are in effect, the most restrictive provisions of either shall be applicable. • No sign shall be installed without the Milan Capital Association (hereinafter referred to as "Landlord") written approval and the required City permits. GENERAL SIGN REGULATIONS A. REQUIREMENTS FOR SIGNAGE IMPLEMENTATION: 1. Each Tenant shall provide a minimum of one primary identification wall sign in accordancewith the approved Sign program. 2. The tenant shall be responsible for the following expenses relating to signage for Tenant's store: Permit processing and application fees. • Fabrication and installation ofsignage. Maintenance and repair. All costs relating to signage removal, including repair ofanydamageto building. 3. The Tenant agreesto abide byall provisions; guidelines and criteria contained within this Cityof La Quinta approved Master Sign Program. Only those sign types provided for and specifically approved in writing bythe Landlord will be allowed. The Landlord may, at his sole discretion, and at the Tenants expense, correct, replace or remove any sign that is installed without his written approval and/or that is deemed not to be in conformance with the plans as submitted and with requirements and documents referenced herein. All signs shall be submitted to the City of La Quinta, California for approval before installation of sign. 4. The Tenant shall maintain all storefront in a like -new condition. The Landlord may, at his sole discretion and the Tenant's expenses, replace, refurbish or remove any sign that has become deteriorated. Landlord may, at his sole discretion, maintain a service contract for Tenant's sign subjectto reimbursement byTenant. p.03 GENERAL SIGN REGULATIONS B. SUBMITTALS AND APPROVALS Prior to sign fabrication, Tenant or his sign contractor shall submit for Landlord approval three (3) sets of complete and fully dimensioned and detailed shop drawings reflecting the concept design to the Landlord. These drawings shall include: 1. Elevation of storefront showing design, location, size and layout of sign, drawn to scale, indicating dimensions, attachment devices and construction detail. 2. Section through letter showing the dimensioned projection of theface of the letter and the illumination. Within ten (10) business days after receipt of Tenant's drawings, Landlord shall either approve the submittal contingent upon modifications or disapprove Tenants sign submittal. Approval or disapproval shall remain the sole right and discretion of the Landlord. Tenant must continue to resubmit rejected plans until approval is obtained. Landlord must approve a full set of final plans in writing prior to permit application or sign fabrication. All re -submittals shall bewithin a ten (10) -business day period following the dayof rejection by the Landlord. Following Landlord's approval of proposed signage, Tenant or his agent shall submit to the City of La Quinta, California three (3) sets of sign plans and one set of plans approved by Landlord, together with application for all permits for fabrication and installation by sign contractor. Tenant shall furnish Landlord with a copyofsaid permits prior to installation of Tenant's sign(s). Fabrication and installation of all signs shall be performed in accordance with the standards and specifications outlined in these criteria and in the final approved plan and shop drawings. Landlord may, at his option, perform an in -shop inspection of the signage prior to installation. Any work deemed unacceptable shall be rejected and shall be corrected or modified at the Tenant's expense as required by the Landlord, the Cityor its agent. Not withstanding anything of the above- the Landlord at his cost, has the right to require any sign to be replaced or altered if it is found to not conform to this master sign program or to be in nonconformance with the overall design intent, MSP, or local code and/ or AHJ requirements, even after original approval. C. TENANT SIGN GUIDELINES Each tenant is allowed one (1) sign each. One (1) sign per building elevation. The approved MSP requires lighted signs that only consist of internally illuminated channel letters. Length of the sign is permitted to be up to 75% of the leased building/space frontage, up to a maximum of 50 square feet per tenant. Maximum sign height for Major tenants is30"and a max.sign height for Shop tenants. Relationship to City of La Quinta Zoning Ordinance: If any of the regulations contained herein conflict with the existing provision of the City regulations, the criteria contained in the City of La Quinta Municipal Code shall take precedence. p.04 GENERAL SIGN REGULATIONS D. Window Graphics Each tenant will be allowed thefollowing windowgraphicsfortheir store entry. Their store name and/or store logo, together with the hours of operation The maximum area will be 2'-6" x2'-6" and the copy must bewhitevinyl precision cut letters installed on the second surface. SIGN COLORS Thefollowing guidelines areto be adhered to in selecting colorsfortenant signage: Signs can incorporate regionally and nationally recognized logo colors. Sign colors should be selected to provide sufficient contrast against building background colors. Sign colors should be compatiblewith building background colors. Color of letter returns can vary by sign branding design needs. Painted or standard aluminum coil colors are acceptable. Colors should contrast with face color & maintain good daytime readability. All sign colors are subjectto review and approval bythe Landlord as part ofthe tenant sign submittal. Type styles and logos: The use of logos and distinctive type styles is encouraged for all tenant signs. Tenants may adapt established type styles, logos and/or images that are in use on similar buildings operated by them in California, provided that said images are architecturally compatible and approved bythe Landlord. Type may be arranged in one ortwo lines of copy and mayconsist of upper and/or lower case letters. p.05 SIGN DESIGN &STYLE STAN DARDS: The intent of this criteria is to insure a standardized uniform style throughout the center while encouraging the creativity of typographical and iconic elements to develop interest and style. Signs must be architecturally compatible with the entire center. STOREFRONT SIGNS The following types of construction will be allowed: • Front -lit internally illuminated channel letters/ logos or icons. • Back -lit / Halo internally illuminated reverse pan channels letters, logos or icons. • Front & Back -lit internally illuminated channel letters, logos or icons. In order to allow creativity and artistic designs, ascending and descending shapes will be allowed to extend beyond the envelope limits, provided that the overall allocated square footage is not exceeded. In other words, these areas shall be calculated individually and added to the "boxed" area for the main sign body. (See diagram A below): Irregular shaped icons & logos should be considered in sign design for increased visual impact. Diagram A Tenant Co Descender: ( The part of the lowercase letters, such as g, p, and y, which extends below the other lowercase letters ) p.06 SIGN CONSTRUCTION GENERAL PROVISIONS AND CONSTRUCTION REQUIREMENTS: 1. Maintaining and adhering to the maximum square footage specified for copy area allowances. Signs and typography in all cases shall appear balanced and in scale within the context of the sign space and the building as a whole. Thickness, height, and color of sign lettering shall be visually balanced and in proportion to other signs on the building. 2. Dimensional letters shall be affixed without visible means of attachment. 3. All sign fabrication work shall be of excellent quality. All logo images and type styles shall be accurately reproduced. Lettering that approximates type styles shall not be acceptable. The landlord reserves the right to reject any fabrication work deemed to be below standard. 4. Signs must be made of durable non -corrosion materials that are appropriate and complementary to the building. 5. All ferrous and non-ferrous metals shall be separated with non-conductive gaskets to prevent electrolysis. In addition to gaskets, stainless steel fasteners shall be used to secure ferrous to non-ferrous metals. 6. Threaded rods or anchor bolts shall be used to mount sign letters that are spaced out from background panel. Angle clips attached to letter sides will not be permitted. 7. Paint colors and finishes must be reviewed and approved by the landlord. Color coatings shall exactly match the colors specified on the approved plans. 8. Joining of materials shall be finished in such a way as to be unnoticeable. Visible welds shall be ground smooth and finished with auto body filler. Rivets, screws and other fasteners that extend to visible surfaces shall be flush, filled, and finished so as to be unnoticeable. 9. Finished surfaces of metal shall be free from canning and warping. All sign finishes shall be free of dust, orange peel, drips and runs and shall have a uniform surface conforming to the highest standards of the industry. 10. Signs illuminated with neon shall use 30 m.a. transformers. 11. Surface brightness of all illuminated materials shall be consistent in all letters and components of the sign. Light leaks will not be permitted. 12. All conduit, wireways, crossovers, wiring, ballast boxes, transformers, and other equipment necessary for sign connection shall be concealed. All bolts, fastenings and clips shall consist of enameling iron with porcelain enamel finish; stainless steel, anodized aluminum, brass or bronze: or carbon -bearing steel with painted finish. No black iron materials will be allowed. 13. Sign circuits provided from the shopping centers common area panel should power electrical signs. 14. Underwriter's Laboratory approved labels shall be affixed to all electrical fixtures, one per sign only. Fabrication and installation of electrical signs shall comply with all national and local building and electrical codes. 15. Penetrations into building walls, where required, shall be made waterproof. 16. Location of all openings for conduit sleeves and support in sign panels and building walls shall be indicated by the sign contractor on drawings submitted to the landlord. Sign contractor shall install same in accordance with the approved drawings. 17. In no case shall any manufacturer's label, stamp, or decal be visible from the street or from normal viewing angles. 18. Each tenant must submit color samples of acrylic and/or vinyl contained in the sign to the Landlord for a permanent inclusion in the Landlord's file. 19. Landlord reserves the right to change the sign criteria. p.07 PROHIBITED SIGNAGE The Regulations and control of the location, size, type, and number of signs permitted shall be grated by the provisions of the City of La Quinta Municipal Code. Additionally, the following shall apply. The following are prohibited: 1. Pennants,flags, inflatable displays or sandwich boards are prohibited. 2. Human signs,temporary wall signs and banners are prohibited unless specifically approved bythe Landlord and City. 3. Windowsigns except where specifically approved bythe Landlord. 4. Exposed junction boxes, transformers, Iamps, tubing, conduits, raceways or neon crossovers ofanytype. 5. Pre -manufactured signs, such asfranchisesignsthat have not been modified to meet the criteria. 6. Paper, cardboard, or Styrofoam signs,stickers, or decals hung around, on or behind storefronts. 7. Exposed fastenings, unlessfastenings make an intentional statement. 8. Simulated materials (i.e. wood grained plastic laminates, etc.) or wall covering. 9. Animated lights or other"moving" sign components. 10. Signs consisting solelyofa rectangular cabinet. 11. Rooftop signs, signs projecting above rooflines or parapets, signs on mansard roofs or equipment screens. 12.
