PC Resolution 2024-007 Munoz Barn Structure SDP 2023-1000PLANNING COMMISSION RESOLUTION 2024 - 007 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA QUINTA, CALIFORNIA, APPROVING A SITE DEVELOPMENT PERMIT FOR A NEW 2,082 SQUARE FOOT ACCESSORY BARN STRUCTURE LOCATED AT 50275 VISTA MONTANA AND FINDING THE PROJECT EXEMPT FROM CALIFORNIA ENVIRONMENTAL QUALITY ACT CASE NUMBER: SITE DEVELOPMENT PERMIT 2023-1000 PROJECT: MUNOZ BARN STRUCTURE APPLICANT: GABRIEL AND KARINA MUNOZ WHEREAS, the Planning Commission of the City of La Quinta, California did, on May 28, 2024, hold a duly noticed Public Hearing to consider a request by Gabriel and Karina Munoz for approval of a 2,082 square foot accessory barn structure, located at 50275 Vista Montana, more particularly described as: APN: 777-020-003 WHEREAS, the Design and Development Department published a public hearing notice in The Desert Sun newspaper on May 17, 2024, as prescribed by the Municipal Code. Public hearing notices were also mailed to all property owners within 500 feet of the site; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did make the following mandatory findings pursuant to Section 9.210.010 of the Municipal Code to justify approval of said Site Development Permit: 1. Consistency with General Plan The proposed development is consistent with the General Plan land use designation of Low Density Residential. The City's General Plan policies relating to low density residential encourage a full range of single-family residential units within the City, and the proposed accessory use maintains those policies. 2. Consistency with Zoning Code The proposed development, as conditioned, is consistent with the development standards of the City's Zoning Code in terms of architectural style and use. The project is within the City's Very Low -Density Residential Zoning district and the Equestrian Overlay District. The project, as conditioned, establishes a new PLANNING COMMISSION RESOLUTION 2024-007 SITE DEVELOPMENT PERMIT 2023-1000 PROJECT: MUNOZ BARN ADOPTED: MAY 28, 2024 PAGE 2OF3 equestrian use as accessory to a future residence, compliant with all Equestrian Overlay District required regulations from the La Quinta Municipal Code. 3. Compliance with CEQA The Design and Development Department has determined that this project is exempt from California Environmental Quality act review pursuant to section 15303(e) New Construction or Conversion of Small Structures, as this project includes construction of an accessory structure. 4. Architectural Design The architecture and layout of the project is compatible with, and not detrimental to, the residential structure planned for the site and surrounding land uses and is consistent with the development standards in the Municipal Code. 5. Site Design The site design of the project is compatible with surrounding development and with the quality of design prevalent in the city. 6. Landscape Design The proposed project is consistent with the landscaping standards established in the General Plan and Zoning Code. The landscape design compliments the architecture of the proposed buildings and the overall site design, NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of La Quinta, California, as follows: SECTION 1. That the above recitations are true and constitute the Findings of the Planning Commission in this case. SECTION 2. That the above project be determined by the Planning Commission to be exempt from the California Environmental Quality Act pursuant to Section 15303(e) New Construction or Conversion of Small Structures. SECTION 3. That it does hereby approve Site Development Permit 2023-1000 for the reasons set forth in this Resolution and subject to the attached Conditions of Approval [Exhibit A]. NIETO, Chairperson City of La Quinta, California ATTEST: DANNY CASTRO, Design and Development Director CRC of 1_a Qij4 t;;, alifornia PLANNING COMMISSION RESOLUTION 2024-007 EXHIBIT A CONDITIONS OF APPROVAL - ADOPTED SITE DEVELOPMENT PERMIT 2023-1000 PROJECT: MUNOZ BARN ADOPTED: MAY 28, 2024 PAGE 1 OF 3 GENERAL The applicant agrees to defend, indemnify, and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Site Development Permit. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense. 2. This Site Development Permit shall expire on May 28, 2026, and shall become null and void in accordance with La Quinta Municipal Code (LQMC) Section 9.200.080, unless the required ministerial permits have been issued. A time extension may be requested per LQMC Section 9.200.080 3. Prior to the issuance of any grading, construction, or building permit by the City, the applicant shall obtain any necessary clearances and/or permits from the following agencies, if required: • Riverside County Fire Marshal • La Quinta Development Services Division (Grading Permit, Green Sheet (Public Works Clearance) for Building Permits, Water Quality Management Plan (WQMP) Exemption Form — Whitewater River Region, Improvement Permit) • La Quinta Design and Development Department • Riverside Co. Environmental Health Department • Desert Sands Unified School District (DSUSD) • Coachella Valley Water District (CVWD) • Imperial Irrigation District (IID) • California Regional Water Quality Control Board (CRWQCB) • State Water Resources Control Board • SunLine Transit Agency (SunLine) • South Coast Air Quality Management District Coachella Valley (SCAQMD) The applicant is responsible for all requirements for the permits and/or clearances from the above -listed agencies. When these requirements include approval of improvement plans, the applicant shall furnish proof of such approvals when submitting those improvements plans for City approval. 4. In the event of any conflict(s) between approval conditions and/or provisions of these approvals, the Design and Development Director shall adjudicate the conflict by determining the precedence. The applicant shall comply with all other rules and regulations of the LQMC Equestrian Overlay District, including Section 9.140.060. 6. Corrals, stables, exercise rings and arenas, and any other disturbed soil area shall be regularly sprinklered or otherwise treated to a degree so as to prevent the emanation of dust, and in addition, all accumulation of manure, mud, or refuse shall be eliminated so as to prevent the breeding of flies. Any open areas shall be subject to the requirements of Chapter 6.16 whenever applicable. All nuisance water runoff must be detained on the subject property. 7. Removal and treatment of manure must occur on a regular basis so as to promote the health, safety and welfare of residents and visitors to the area in accordance with the following standards: • Stalls shall be cleaned on a daily basis. Straw, hay, sawdust, or other bedding materials may be stored or composted for later disposal but shall not be spread with manure over open areas. • Manure shall be collected from all source areas daily and may be stored for later disposal in an enclosed container of adequate size. Open manure stockpiles are not permitted. Manure stored for disposal shall be removed from the property within seven (7) days. • Manure to be used for composting purposes shall be placed in an appropriately designed composting bin in order to properly decompose and eliminate parasites. • Spreading of manure is not allowed under this permit. It may only occur in conjunction with commercial equestrian uses and must be conducted over an adequately sized area capable of assimilating the nutrients in the spread material. Such an area may only be operated as part of the overall disposal and treatment program approved by the city or established as part of a conditional use permit application. Only composted manure may be used in any spreading operation. A commercial equestrian use requires submittal of a Conditional Use Permit. Method for removal of manure from the property is at the owner's discretion. Off-site delivery to agricultural or related operations for fertilizer use is permitted. On-site use of composted material is permitted in new or established vegetated areas, such as gardens, landscaping, re-establishment of pasture vegetation, etc. Any condition that results in odors, unsightly areas, or infestation shall be deemed a public nuisance and/or health hazard and shall be abated within seven (7) days of proper notice. All violations are subject to enforcement provisions of the LQMC and applicable county health codes. Any lighting must comply with Sections 9.60.160 and 9.100.150 (Outdoor lighting). Lighting of equestrian and related activity areas shall not occur beyond 10:00 p.m. 9. Loudspeaker systems or other amplified sound are limited to operation or use between 8:00 a.m. and 10:00 p.m. unless otherwise specified by an approved conditional use permit. 10. Use of the horse -riding area shall not be used for commercial purposes and shall be consistent with the operations presented by applicant, on file with Design and Development Department. 11. Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be performed, shall first make application to the building official and obtain the required permit. 12. Fire Sprinklers: Residential fire sprinklers are required in all one- and two-family dwellings per the California Residential Code (CRC). A residential fire sprinkler system shall also protect the horse stable for the allowance to extend the maximum fire access travel distance and the maximum distance from a fire hydrant. Plans must be submitted to the Office of the Fire Marshal for review and approval prior to installation. Ref. CRC 313.2, California Fire Code 503. 13. Driveway Gate Access: Electronically operated gates shall be provided with a Knox key switch for emergency access. Ref. CFC 506.1. 14. Addressing: All residential dwellings shall display street numbers in a prominent location on the street side of the residence. Minimum numeral height shall be 4 - inches with contrasting color.
