taQa�tra CALIFORNIA August 15, 2024 Mr. David Laughter Spirit Halloween 6826 Black Horse Pike Egg Harbor Twp, NJ 08234 SUBJECT: TEMPORARY USE PERMIT 2024-0004: SEASONAL SALES BUSINESS SPIRIT HALLOWEEN STORE AT 79840 HIGHWAY 111 Dear Mr. Laughter: The City of La Quinta Design and Development Department has reviewed and approved Temporary Use Permit (TUP) 2024-0004, for a seasonal sales business located at 79840 Highway 111, pursuant to Section 9.100.140 of the La Quinta Municipal Code and subject to the information on file and the following findings and conditions of approval. DESCRIPTION Temporary Halloween store in the former 99 Cents Only space. Spirit Halloween is a retail store selling costumes and decorations. Space will have no permanent tenant improvements to the space. Temporary fixtures and a temporary banner sign will be used. Planned merchandising to begin July 25, 2024, with a planned open date of August 15, 2024. Planned closing date of November 10, 2024, with operating hours between 9 a.m. and 11 p.m. FINDINGS The proposal is consistent with the general plan and provisions of the zoning code. The seasonal sales business is permitted in the Regional Commercial zone and in Specific Plan 1996-027. The proposal would not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. CONDITIONS OF APPROVAL: The applicant agrees to defend, indemnify and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Temporary Use Permit. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense. taQa�tra CALIFORNIA 2. The business is permitted to operate for up to 90 -days. 3. Permitted temporary sign material shall be limited to a minimum one -inch thick plastic formed lettering affixed to the building fapade. All sign lettering shall promptly be removed upon expiration of the temporary use permit and the fapade shall be restored to its prior condition. 4. Any additional signage or banners are prohibited. Buildina Division 5. Applicant must apply for and obtain a Special Inspection permit through the Building Division. Note: A floor plan showing the proposed fixtures, racking, etc as well as exits will be required. Fire Deaartment 6. All the building exits shall be maintained accessible and unobstructed. 7. Illuminated exit signs, emergency egress lighting, and door exit hardware shall be maintained operational. 8. Portable fire extinguishers with a minimum rating of 2A:10BC shall be available throughout the store such that a fire extinguisher is available within 75 feet travel distance. Fire extinguishers shall be serviced and tagged annually. 9. A copy of the key to access the building shall be provided to the Fire Department to be placed inside of the building Knox box. 10. Fire sprinkler systems shall be inspected, tested and maintained periodically. Prior to obtaining Fire clearance for the Temporary Use Permit, the applicant shall provide to the Office of the Fire Marshal a copy of the latest inspection, testing and maintenance report (dated within one year) or a service tag showing the fire sprinkler system received the maintenance within one year. Reference California Fire Code 901.6 11. Prior to obtaining Fire Department clearance for this Temporary Use Permit, an Inspection shall be conducted by the Office of the Fire Marshal. The City may add further conditions to this application request to mitigate any problems that arise not previously addressed herein. This decision may be appealed to the Planning Commission by any party who submits the necessary paperwork to this office within 15 days of the date of approval of this permit.
