The Pollution Legal Liability Program is a standalone coverage program in which member agencies can choose to participate. It provides coverage for first -party (i.e. contamination of city property) and third -party (i.e. contamination of others' property) losses that arise out of a pollution event. The city has not participated in this program for a number of years, however, Pam requested a quote for the 2020-21 coverage period. The quoted annual premium for City of La Quinta is $3,783. Attached is the program summary for 2019-20 to give you a better sense of the coverage. One significant change is that the deductible is increasing from $50,000 to $250,000 per claim this year. While the city's pollution exposure appears low, unexpected losses can occur. Common pollution threats to municipalities include the following: i • Storage Tanks-Underground/Above Ground — leaks from tanks, ruptures during a catastrophic release and spills during loading/unloading process • Construction Activity • Waterborne Pathogens (including Legionella) • Wastewater — nuisance odor claims, raw sewage rupture and chlorine gas emissions • Indoor Air Quality including Mold and Fungal Infections • Waste Management including vicarious liability associated with disposal/collection/storage and transportation of waste • Maintenance Garage Services — storage tanks, parts washer solvents, petroleum waste products and vehicle storage • Parks, lakes, river and open land — midnight dumping, discharge of raw sewage/industrial waste, asphalt paving projects with storm discharge to open waters and unknown subsurface conditions • Reputational Damage Related to a Pollution Incident Alex Smith is our CFO and is contacting member agencies who requested quotes to confirm if they want to participate. Keep in mind that the deductible is increasing from $50,000 to $250,000 per claim this year. As for cyber liability insurance, we suggest requiring a minimum of $1M per occurrence. It really isn't necessary to require an aggregate limit. Take a look at pages 65-67 of our Contractual Risk Transfer Manual (attached) for additional detail.
