ENC2024-0093 Ironman 70.3 Indian Wells La Quinta / Traffic Control / Various Streets; See Attached Traffic Control Plan (No asphalt or earthwork permitted) The following permit conditions shall apply: 1. Pursuant to Section 14.16.320 of the La Quinta Municipal Code (Ordinance 10 § 1 (part), 1982), all work shall be performed in accordance with the latest edition of the Standard Specifications for Public Works Construction (SSPWC) and as directed by and to the satisfaction of the City Engineer. 2. This permit or copy of it shall be on the work site (usually the job trailer) for inspection during the actual work performed. 3. The permittee must maintain proper stopping and sight distances for the vehicular traffic users using the public right of way. 4. The City of La Quinta reserves the right to require modifications of the work be made at permittee's sole cost for proper sight distance requirements per guidelines in the AASHTO "A Policy on Geometric Design of Highways and Streets, 51h Edition" or latest, in the installation of all appurtenances abutting and within the public street right-of-way. 5. Streets shall be kept clean. They shall be completely cleaned at the end of each working day and more frequently, if required. 6. The Applicant or Contractor shall furnish the City satisfactory evidence of insurance in the amounts provided in the Engineering Bulletin #97-04 for Indemnification & Insurance Requirements. This insurance shall be kept in full force and effect at all times by Applicant or Contractor during the prosecution of the permitted work and updated Certificate of Liability Insurance and endorsements shall be submitted to the City. Each policy shall name the City as an additional insured. 7. Pursuant to Section 14.16.250 of the La Quinta Municipal Code (Ordinance 10 § 1 (part), 1982), at residential streets, advance warning signs and traffic control shall be installed and maintained in accordance the latest edition of the California Manual of Uniform Traffic Control Devices (CA MUTCD) or the latest edition of the Work Area Traffic Control Handbook (WATCH). On Collectors to Arterial Streets, the permittee must submit a traffic control plan which shall be from or prepared under the guidance of the latest edition of the California Manual of Uniform Traffic Control Devices (CA MUTCD) or the latest edition of the Work Area Traffic Control Handbook (WATCH). Traffic Control plans not from the CA MUTCD or the WATCH shall be signed and stamped by a civil or traffic engineer registered in the State of California. It shall be the Permittee's responsibility to appropriately detour and barricade all construction sites. 8. If public traffic lanes are required to be closed, this permit is not valid until the permittee submits, to the Public Works Department, a traffic control plan for review and approval prior to start of construction or parking on the paved R/W. Pursuant to Section 14.16.110 of the La Quinta Municipal Code (Ordinance 10 § 1 (part), 1982), Permittee shall assume responsibility for repair of any pavement damage to any public or private street and for any damage to other City streets or facilities as a result of work performed under this permit. 10. Prior to excavating, if required, the Permittee shall contact Underground Service Alert at 1- 800-422-4133. It shall be the Permittee's responsibility to notify the Public Works Department of anticipated excavation which impact City facilities, including but not limited to traffic signal conduits and loops, irrigation lines, electrical conduits, and storm drain facilities. 11. Should additional work, materials, or modifications of the work be required in order to meet City standards, safety requirements, signage requirements, or to fit actual field conditions, the work shall be performed by the Permittee as directed by and to the satisfaction of the City Engineer at no cost to the City of La Quinta. 12. The permittee shall not encroach upon private property without prior written approval (submit to the Design and Development Department, attention to the Associate Engineer) of the private land owner whom is being encroached upon. 13. All landscaping, irrigation, decorative rock, decorative concrete, sidewalk, lighting, etc., shall be replaced to its original condition. 14. Access and egress to all local properties shall be maintained at all times. 15. Permittee shall permanently stabilize any and all soil that was disturbed as a result of work performed under this permit with an approved dust control treatment. Soil stabilization shall be done immediately after completing the operation. 16. Pursuant to Chapter 12.56 of the La Quinta Municipal Code (Ordinance 10 § 1 (part), 1982) the City has designated certain city streets as Truck Routes. The weight limit for restricted streets (i.e., streets not part of the Truck Route network) is three (3) tons; trucks exceeding the weight limit may use a restricted street if making a delivery or pickup on the subject street, or if this permit specifically grants permission to use the street to deliver street construction materials and/or equipment. 17. The City of La Quinta reserves the right to revoke, suspend or void this permit at any time. 18. Read the entire policy carefully to determine rights, duties and what is and is not covered. Throughout the policy; the words "you" and "your"refer to the Named Insured shown in the Declarations. The words "we, `"us," and "our"refer to the company providing this insurance. The word "insured means any other person or organization qualifying as such in SECTION 11— WHO IS AN INSURED. Other words and phrases that appear in quotation marks in this policy have the meanings given them in SECTION V = DEFINITIONS. Unless contradicted in this policy, words and phrases defined by "controlling underlying insurance" have the meanings given them in "controlling underlying' insurance." SECTION I — COVERAGE 1. Insuring Agreement We will pay on behalf of the insured and in excess of "underlying limits"those sums the insured becomes legally obligated to pay as damages because of "injury or damage" to which this insurance applies. This insurance only applies if a. the "injury or damage" is caused by an "ever$" in the coverage territory; b. the "injury or damage" first occurs during the policy period; and c. "controlling underlying insurance" applies to the "injury or damage" and is exhausted by the payment of, or agreement to pay, judgments or settlements to which this insurance also applies. The amount we will pay is limited as described in SECTION III — LIMITS OF INSURANCE. 2. Defense When there is a reasonable expectation that this insurance may be involved in a loss,. we may investigate any claim, defend any suit, or associate with any insured or insurer. We may settle any claim at our discretion. We have no duty to investigate claims or defend suits until the expressed and unlimited obligation of all "underlyinginsurance" terminates because of the exhaustion of "underlying limits" by payment of, or agreement to pay, judgments or settlements.. "Defense expenses" will not reduce our limit unless such expenses also reduce "underlying limits." Any duty to defend that we may have ends when we pay or agree to payour applicable limit. 3. Exclusions Exclusions applicable to "controlling underlying insurance" also apply to this insurance. Even when "controlling underlying insurance" applies, this insurance does not apply to: a, Asbestos "Injury or damage" arising out of the actual; alleged or threatened exposure to "asbestos" or any goods or products containing "asbestos;" b_. Law Any liability that is or would be imposed under. 1) The Employment Retirement income Securities Act of 1974 or any amendments thereto, or any similar law; 2) Medical payments, no-fault; personal injury protection or any similar law; 3) Uninsured or underinSured motorist or any similar law, or 4) Workers compensation, disability benefits, unemployment compensation or similar law; c. Sub4imits "Injury or damage" to which "underlying insurance" applies but at amounts less than COMMERCIAL EXCESS LV4 ILITY. SECTION 11—WHO IS AN INSURED 1. You are an insured. 2 Any other person or organization who is an insured on "controlling_ underlying insurance is an insured on this policy. However, no one is an insured for broader coverage than that provided by "controlling underlying insurance." SECTION III - LIMITS OF INSURANCE The Limits of Insurance shown in the Declarations and the rules below fix the most we will pay regardless of the number of insureds, claims made, suits brought, or persons or organizations making claims or bringing suits. 1_ Aggregate The Aggregate Limit shown in the Declarations is the most we will pay for the sum of all damages to which this insurance applies except injury or damage arising out of the ownership; maintenance, operation or use, including loading or unloading, of an automobile when such damages are not subject to an Aggregate on "controlling underlying insurance. When all "underlying policies" apply a separate Aggregate Limit to damages because of bodily injury or property damage included in a products -completed operations hazard, the AggregateLimit Will apply in the same manner. 2. Each Event Subject to the Aggregate Limit described above, the Each Event Limit shown in the Declarations is the most we will pay for the sum of all damages because of "injury or damage" arising out of any "event:" 3. /U1ti-Stacking If this policy and any previous or subsequent policy we issued to you apply to "injury or damage" from the same aevent," the policy with the highest Limits of Insurance will be the only one to, apply. This provision does not apply to any policy we may have issued as excess to this insurance. SECTION IV - CONDITIONS Conditions applicable to "controlling underlying insurance" also apply to this insurance unless contradicted by the following: 1. Bankruptcy Bankruptcy of the insured or any insurer providing "underlying insurance" will not change your or our obligations under this policy. 2. Cancellation The first Named Insured may cancel this policy for any reason by returning the policy to us or the Producer shown in the Declarations. We may cancel this policy_ by providing the first Named insured written notice: a. 10 days in advance if we cancel for non-payment of premium; or b. 30 days in advance if we cancel for any other reason. If we cancel, the return premium amount will be calculated on apro rata basis. If you cancel, the return premium amount, subject to the Minimum Earned Premium shown in the Declarations, will be less than Pro- rata_ Proof of Mailing will be proof of notice_ 3. Duties in the Event of a Claim, Event or Suit You must see to it that we are notified in writing as soon as possible of any claim, "event' or suit that may be reasonably expected to involve this insurance. You and any other involved insured have the same duties to us that you have to "controlling underlying insurance." 4. Maintenance of Underlying You must immediately notify us of any cancellation, non -renewal or change to "underlying insurance" that broadens the coverage. We will not follow such changes unless and until an endorsement is issued and you have paid the premium due to us. Reduction of .underlying limits" by the payment of judgments, settlements or defense expenses; to which this insurance applies, will not be considered a failure to comply with this condition. Non -Renewal If we decide not to renew this policy, We Will provide advance notice of that decision, in the manner and timeframe required by applicable statute or regulation, to the first Named Insured.
