LOWE'S CHRISTMAS TREE LOT

The Design and Development Department has reviewed and approved your request to establish
a temporary Christmas tree sales lot located within the Lowe's parking lot. The approval of the
sales lot is granted under Section 9.100.080 of the La Quinta Municipal Code subject to the
Conditions of Approval listed below and the attached Conditions of Approval from the Fire
Marshal's office:
1. By holding this Christmas tree sale, the applicant agrees to indemnify, defend and
hold harmless the City of La Quinta in the event of any legal claim or litigation arising
out of the City's approval of this project. The City of La Quinta shall have the right to
select its defense counsel at its sole discretion
2. The Christmas tree sales lot may be open on the following dates:
November 24, 2024 — December 24, 2024; Monday through Sunday, between the
hours of 8:00a.m. and 8:00p.m.
3. The Christmas tree sales lot shall be removed, and the premises cleared of all debris
and restored to pre -event conditions no later than January 9, 2024.
4. The location of the sale is limited to the Lowe's parking lot per the attached site plan.
Traffic aisles shall not be blocked.
5. The facility shall not engage in the sale of any merchandise not directly associated
with Christmas trees or decorations.
6. The applicant shall apply for a Building Special Inspection Permit, which can be
applied for in The HUB Online Portal.

7. Per information on file, tents are not proposed and are not approved as part of this
permit.
8. All electrical wirings must comply with the California Electrical Code as well as Building
and Safety Requirements. No zip cords will be allowed. All extension cords must be
connected to a circuit protected outlet. Use of generators shall comply with the
California Fire Code and Building Code.
9. All aisles between the grouping of trees must be maintained at a minimum of 36 -
inches in width.
10. All waste, trimmings, and dried trees must be removed from the site daily or placed in
an approved waste container.
11. A temporary fence surrounding the Christmas tree lot is permitted. The proposed
fence shall be constructed of chain link fencing material and shall not exceed a height
of six (6) feet. No other temporary structures are proposed or permitted as part of this
permit.
12. Temporary lighting shall not be directed towards surrounding properties. All temporary
lighting shall conform to the City's Outdoor Lighting Ordinance; Section 9.100.150 of
the City's Municipal Code.
13. If portable generators are used for electricity, they shall be shielded to prevent
accidental contact with guests. If extension cords are used, they shall be ground -
secured to prevent tripping. Power equipment (i.e. chain saws, etc.) shall not be
operated before 7:00 a.m.
14. Smoking shall not be permitted in any part of the event area.
15. Displays, decorations or other objects shall not be placed to obstruct exits, access
thereto, or egress therefrom or visibility thereof. Hangings and draperies shall not be
placed over exit doors or otherwise be located to conceal or obstruct an exit.
16. Roadways, parking areas, and pedestrian traffic aisles outside the proposed area shall
be always maintained accessible.
17. Signs shall be restricted to one (1) banner sign per street frontage, each sign not

exceeding thirty-two square feet. Banners may be placed on the temporary fence or
adjacent within the parking area, but not on Highway 111. Other signs and advertising
devices such as pennants, flags, A -frame signs, are prohibited.
18. All trees sold for commercial use to businesses, schools, churches, or health care
facilities shall be flame retardant and bear a tag with the information of when it was
treated and what material was used during the treatment in accordance with the
California State Fire Marshal's Office. Flocking for these uses shall be done with
non-flammable materials.
19. Adequate trash receptacles shall be provided.
20. A security guard is permitted on-site if needed during the operations of the Christmas
tree sales lot. Security personnel shall be easily identifiable to the public by the
provision of uniformed personnel. All designated private security personnel must be
licensed by the State of California and possess a valid private security license. No
overnight camping, either in tents or vehicles, is permitted as part of this permit.
Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding
properties and businesses will be minimized. The City may elect to add conditions to this
application to mitigate any problems that arise not previously addressed herein.

The plan for the above referenced project was reviewed and approved by the Riverside County Fire
Department with the following conditions.
1. Fire lanes, fire hydrants or any other Fire Department appliances shall be maintained unobstructed.
2. According to the application, there is no canopy or tent to be erected. If the plan changes and a tent
or canopy greater than 400 square feet is desired, a permit from the Office of the Fire Marshal is
required before erecting the tent or canopy.

We are requesting a temp permit for our annual Christmas tree lot. These trees will be purchased inside, so the lot is more for trimming and
displaying trees. We will have trained employees in the lot.
Lot Size
62ft x 72ft
Full chain link fence panels 12x8 and will have posts for partitions.
11 Partitions will divide the tree lot into 13 sections to hold different size trees and a cutting station.
We will have 2 exit/entrance at the long end of the lot. Secured with chains and locks.
Safety lights will be placed at the cutting stations and at the end of the partitions to light entire lot.
We will have illuminated exit signs
Fire extinguishers
Power will be pulled directly from a light pole.
The lot will be decorated with Christmas themed lights
Burlap will surround fence to help protect trees.
Lot will have staffing from 8am to 8pm during the season.
