CC Resolution 2024-047 Surplus Land APN 600-020-057RESOLUTION NO. 2024 — 047 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, DECLARING CERTAIN LAND LOCATED IN THE CITY OF LA QUINTA, CALIFORNIA AS SURPLUS LAND WHEREAS, the Surplus Land Act (Gov. Code, § 54220 et seq.) requires that before a local agency takes any action to sell or enter into a long-term lease for its property, it must declare to property to be "exempt surplus land" or "surplus land;" and WHEREAS, "surplus land" means land owned in fee simple by any local agency for which the local agency's governing body takes formal action in a regular public meeting declaring that the land is surplus and is not necessary for the agency's use; and WHEREAS, "exempt surplus land" means land owned in fee simple by any local agency which falls into one (1) or more of several categories included in the Surplus Land Act; and WHEREAS, the City of La Quinta ("City") owns an approximately 6-acre parcel located in the City of La Quinta, California, more specifically identified as Assessor Parcel Number (APN) 600-020-057 in fee simple (the "Land"), depicted in the site map enclosed as Exhibit A, incorporated herewith by this reference; and WHEREAS, pursuant to Government Code Section 54221(b), the City Council of the City of La Quinta hereby declares the Land to be surplus land not necessary for the City's use which does not fall into any category for "exempt surplus land"; and WHEREAS, pursuant to Section 15312 of the State California Environmental Quality Act ("CEQA") Guidelines, the declaration is exempt from review under the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, as follows: SECTION 1. The foregoing recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Council of the City of La Quinta hereby finds and determines that the Land is no longer necessary for the City's use and is surplus land as defined in the Surplus Land Act based on the evidence in the record. SECTION 3. The City Manager or Designee is hereby authorized to send a notice of availability to the entities designated in the Surplus Land Act ("Designated Entities"), to negotiate with any Designated Entities who respond to the notice of availability, and otherwise follow the procedures of the Surplus Land Act applicable to the land. The declaration of the Land as surplus land is exempt from environmental review under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15312, however, any subsequent development of the Land would be further reviewed pursuant to CEQA and other environmental laws. SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
