MA 2024-0007 Caskey Residence at 52530 Diaz (Avenida) (12.26.2024) December 26, 2024 Santiago Lopez Ocampo PO Box 1018 La Quinta, CA 92247 SUBJECT: MINOR ADJUSTMENT 2024–0007 52530 AVENIDA DIAZ Dear Santiago Lopez Ocampo: The Design and Development Department has reviewed your Minor Adjustment application (MA 2024-0007), pursuant to Section 9.210.040 of the City of La Quinta Zoning Code. REQUEST: To grant a maximum 10% adjustment to decrease the rear yard setback, the front yard setback, and the interior width of a garage at a new single family residence proposed to be constructed at 52530 Avenida Diaz. The rear yard setback will be decreased from ten feet (10’) to nine feet (9’). The front yard setback will be decreased from twenty feet (20’) to eighteen feet (18’). The interior width of the garage will be decreased from twenty feet (20’) wide to nineteen feet, nine inches (19’-9”). These adjustments are being utilized to accommodate the architectural design per the attached site plan exhibit. The parcel’s front property line is twelve feet (12’) from the edge of Avenida Diaz roadway which will result in the garage being placed thirty (30’) from the edge of the street pavement. DECISION: Approval is granted for the requested adjustment based on the following findings and subject to the conditions of approval listed below: 1. Minor Adjustment 2024-0007 is consistent with the La Quinta General Plan, in that the proposal does not alter the approved land use for the property or affect land use on surrounding similar properties as the project consists of the construction of a single family residence within a residential neighborhood of single family homes. 2. Minor Adjustment 2024-0007 is consistent with the intent of the La Quinta Zoning Code in that the requested adjustment will be conditioned to comply with all other development standards as required under said Zoning Code. 3. Processing and approval of Minor Adjustment 2024-0007 is in compliance with the California Environmental Quality Act. The adjustment requested falls under CEQA Guidelines Section 15305(a) as a “Minor Alterations to Land” - Class 5 Categorical Exemption in that the project proposes a minor setback adjustment. 4. Approval of Minor Adjustment 2024-0007 is not detrimental to the public health, safety and general welfare, nor injurious or incompatible with other properties and land use in the vicinity. The adjustments have no impact on health or safety issues and will not affect physical land use characteristics in the vicinity. The adjustments will be compatible with the architectural styles of the neighboring existing single-family homes. CONDITIONS OF APPROVAL: 1. A building permit shall be obtained prior to construction. The proposed construction shall comply with all other development standards as required by the La Quinta Zoning Code. Please be advised that the City only approves three Minor Adjustments per lot, regardless of the percentage of the development standard adjusted. This approval relates only to the minor adjustments referenced herein and does not imply any entitlement or approval of a building permit for any structures shown on the plans on file. This approval consists of the maximum of three Minor Adjustments, as previously described. No further Minor Adjustments will be allowed on this parcel. All other development standards of the La Quinta Zoning Code are applicable and shall be adhered to in preparing plans for building plan check.
