SPEV 2024-0019 AM/EX Golf Tournament 2025 (12.27.2024)1 December 27, 2024 CASE NUMBER Special Event Permit 2024-0019 ACTIVITY/EVENT The American Express Golf Tournament January 13 – January 19, 2025 La Quinta Country Club PGA West’s Nicklaus Tournament Course Stadium Course at PGA West APPLICANT Tucker Mitchell Sportfive Golf LLC 7077 E Marilyn Road Suite 140 Scottsdale AZ, 85254 APPROVAL The Design and Development Department has reviewed and approved Special Event Permit 2024-0019, pursuant to LQMC 9.100.130 (Special Events – Nonresidential), your permit is approved based on the following Findings: A. The event, as conditioned, will not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. B. There is adequate area to conduct the event and to accommodate the anticipated attendance, as conditioned. C. Sufficient parking will be provided for the anticipated attendance. D. Food service operations, medical facilities, solid waste facilities, sewage disposal methods and potable water service have been provided. E. Fire protection plans and facilities have been provided to the satisfaction of the fire marshal. 2 F. Security plans and facilities have been provided to the satisfaction of the sheriff. G. Public roadways providing access to the event are capable of accommodating the anticipated traffic volumes in a reasonable and safe manner with minimal disruption to local traffic circulation. The applicant-provided traffic control plan was approved by the City Traffic Engineer and will manage traffic and ensure safety throughout the event. This approval authorizes the applicant to conduct the event pursuant to compliance with all conditions of approval of this permit and does not constitute approval of the necessary building, fire and encroachment permits, or other permits as necessary. The applicant must obtain any permits, as required below, in order to physically set up the event. CONDITIONS OF APPROVAL Completion/confirmation prior to start of the event: 1. The applicant agrees to indemnify, defend and hold harmless the City of La Quinta (“the City”), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this temporary use permit. The City of La Quinta shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or preceding and shall cooperate fully in the defense. 2. The applicant shall obtain all other applicable permits, if required, from the appropriate agencies (i.e. Fire Department, Building Department, Police Department, Alcohol Beverage Control, etc.). This includes applicable permits and contracts secured from City of Indian Wells, City of Indio, Riverside County Sherriff’s Department, County of Riverside, and California Highway Patrol. 3. The applicant shall provide notification of the event to Home Owners Associations within 500 feet of event site, including PGA West, La Quinta Country Club, Hideaway, Madison Club, Citrus, and any other residential developments to be affected by event and traffic control, at least fourteen (14) days prior to the event, by December 31, 2024. Notification shall include date, time, event scope, contact information, and traffic plans. Proof of notification shall be provided to the Design and Development Department by January 7, 2025 and shall include the following: a) a map showing all properties within a minimum 500-foot radius of subject property, 3 b) a typed list of all property owners and their mailing address within a 500-foot radius, and all residents/tenants of said properties, c) photographic evidence of addressed envelopes, d) copy of the written notification, and e) signed affidavit by the applicant that notices have been mailed or delivered. These items may be emailed to the Planning Division at Planning@LaQuintaCA.gov. Please provide the case number with correspondence. 4. The applicant shall finalize and adhere to contract between applicant and Riverside County Sheriff’s Department for Police presence throughout event. Contract shall be finalized no later than thirty (30) days prior to event. 5. A Special Inspection Permit will be required for TV towers, tent structures (over 400sf if tent has walls, over 700sf if no walls), tent platforms/grandstands, and generators. Plans and layouts complying with ICC-300 and structural calculations are required for review and approval - note: a structural observation by the engineer of record is required of the completed structures and its review and approval by the Building Division prior to occupancy. 6. All attached Conditions of Approval issued by County of Riverside Fire Department shall be complied with. 7. The applicant shall provide copies of their contracts with traffic, security and crowd control companies for review and approval by the Fire Department and Sheriff Department. Such contracts shall be approved and finalized no later than twenty (20) days prior to event. 8. The applicant shall obtain and adhere to an encroachment permit for the traffic control plan off-site signs and traffic controls placed within the City’s right-of-way. Encroachment Permit will include requirements for insurance that shall be provided by the applicant. Please contact Amy Yu at (760)777-7047 for assistance on obtaining an Encroachment Permit. 9. All vendors conducting business in the City of La Quinta shall obtain a City Business License prior to event. 10. If ground excavations are required, please contact Underground Service Alert (USA) at 1-800-227-2600 or 1-800-422-4133. This service is free of charge provided USA is given a two-day notice prior to commencement of work. 4 11. The applicant shall adhere to any conditions of approval, requirements, and fees required by the County of Riverside Fire Department (Attached). 12. The Design and Development Director may modify Conditions of Approval regarding operational conditions should it be determined, the proposed uses or conditions under which the events are being operated or maintained is detrimental to the public health, welfare, or materially injurious to property, improvements or other uses in proximity to the subject property, or if the subject property is operated or maintained so as to constitute a public nuisance. Completion/confirmation during the event: 13. The set-up and operation of the events shall be consistent with the attached exhibits and event information on file. 14. Security and volunteer personnel shall be easily identifiable to the public by the provision of uniformed personnel. Any designated private security personnel must be licensed by the State of California and possess a valid private security license. 15. Certain areas providing access to the event area are public and, as such, general public access may not be denied or restricted in any manner that extends beyond the limits of this event as approved. 16. The use of amplified equipment for music presentations is permitted, provided that all provisions of the City of La Quinta’s Noise Ordinance (LQMC 9.100.210) are complied with. 17. The use of amplified equipment for a music concert on Friday January 17, 2025 and Saturday, January 18, 2025 from 5:00 p.m. – 8:00 p.m. each day is permitted, along with sound checks occurring between 4:00 p.m. and 5:30 p.m. on Friday and Saturday, provided that all provisions of the City of La Quinta’s Noise Ordinance (LQMC 9.100.210) are complied with, with the exception of the Noise Standard temporarily being raised from 60 dB(A) to 85 dB(A) for the neighboring homes and the applicant shall implement noise limiters, gates, or compressors per technology mitigation measure #2 from the noise study dated January 12, 2018 and on file. If the noise consists entirely of impact noise, speech or music, or any combination thereof, each of the noise levels specific above shall be reduced by five dB(A). 5 18. Portable generators shall be shielded to prevent accidental contact with the public. Extension cords shall be ground-secured to prevent tripping. Any lighting shall be directed away from surrounding roadways and surrounding residential properties. No spot or searchlights are permitted. 19. Surrounding roadways and intersections shall remain readily accessible for passage of emergency response vehicles and private vehicles. 20. The event is subject to spot inspections by the Police Department and/or City staff to ensure compliance with the conditions of this letter. Completion/confirmation after the conclusion of the event (if necessary): 21. The event route and any sites used shall be left clean and in its original manner after the event. Temporary trash receptacles shall be provided in and around the event areas. All event areas shall be left free of debris at the end of each day’s activities, and after the event concludes. 22. All signage shall be removed after event, or each sign is subject to a $50.00 fine. Removal of signs shall happen by end of day January 20, 2025. Contact the Code Compliance Division at (760) 777-7050 if you have any questions regarding the removal of signage. 23. The City of La Quinta Police department reserves the right to bill the event sponsor for any lost police time, equipment, and/or any unforeseen loss that may occur due to the event that requires police action. 24. Any damage to public hardscape caused by this event shall be repaired as directed by the City Engineer. This includes but is not limited to sidewalks, curb and gutter, landscaping, and pavement especially within the surrounding public streets. FINAL ACKNOWLEDGEMENT/CONTACT INFORMATION By holding this outdoor event, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta (“the City”), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this temporary use permit. The City of La Quinta shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or preceding and shall cooperate fully in the 6 defense. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. The City of La Quinta reserves the right to revoke, suspend or void this permit at any time. This decision may be appealed to the Planning Commission, provided the written appeal and filing fee of $1,575.00 are submitted to this Department within 15 calendar days of this approval. Please contact this office should you wish to file an appeal, and we will assist you in that regard.
