RE: Declaration of Easements, Covenants, Conditions and Restrictions dated
effective as of October 31, 2023, executed by BP Dune Palms LP, a California limited
partnership ("BP"), as declarant thereunder which was recorded in the Official Records of
Riverside County on November 2, 2023 as Document No. 2023-327914 (the "Declaration")
concerning certain real property located on the northeast corner of Highway 111 and Dune
Palms Road, in the City of La Quinta, County of Riverside, California. BP is the owner of Parcel
2 (or the CFA Parcel) and Parcel 3 (or the QQ Parcel), and La Quinta Housing Authority, a
public body, corporate and politic ("LQHA") is the owner of Parcel 1 (or the Housing Parcel), all
as described in more detail in the Declaration.
The undersigned each hereby certifies as of � V(UQC S' 2025, to its
respective actual knowledge, the following:
1. The Declaration is in full force and effect.
2. There are no defaults or violations under the terms of the Declaration.
3. There are no amendments, written or unwritten to the Declaration.
This Declaration Estoppel Certificate is given in connection with the sale of Parcel 3 (or
the QQ Parcel) as defined in the Declaration from BP to John Mourier, III, as Trustee of the Lois
E. Mourier Surviving Spouse's Trust ("Buyer"), and is given solely for the information of Buyer,
its successors and assigns, and their respective lenders (collectively, the "Reliance Parties"),
and may not be relied upon by any other person or entity. This Declaration Estoppel Certificate
shall not result in any modification of or amendment to the Declaration. The undersigned has all
requisite authority to execute this Declaration Estoppel Certificate. The undersigned
acknowledges that Buyer has requested the information contained herein for purposes of
confirming certain factual matters related to the Declaration and the Reliance Parties will be
relying upon the truth and accuracy of the representations made herein and upon the authority
of the undersigned to execute this Declaration Estoppel Certificate.
