The exhibits are located at (APNs) 604-630-007 and 604-630-012 located at the southeast corner of Washington and Miles Avenue. The exhibits may be on display from February 27, 2025 through March 9, 2025 and accessible between the hours of 10:00 am until 6:00 pm. The event is subject to the information on file and attached, including the following Findings and Conditions of Approval. FINDINGS • The event will not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. • There is adequate area to conduct the event and to accommodate the anticipated attendance. • Parking plan has been provided that demonstrates sufficient parking will be provided for the anticipated attendance and the potential impacts on the surrounding residential streets are minimized, to the satisfaction of the Design and Development Director. • Fire protection plans and facilities have been provided to the satisfaction of the fire marshal. • Public roadways providing access to the event are capable of accommodating the anticipated traffic volumes in a reasonable and safe manner with minimal disruption to local traffic circulation. CONDITIONS OF APPROVAL: 1. By issuance of this permit, the applicant agrees to indemnify, defend, and hold harmless the City of La Quinta ("the City"), its agents, officers and employees in the event of any ta �GLINW legal claim or litigation arising out of the City's approval of this project. The City of La Quinta shall have the right to select its defense counsel at its sole discretion. The City shall promptly notify the applicant of any claim, action or preceding and shall cooperate fully in the defense. 2. The location of the exhibits is limited to legal parcels (APNs) 604-630-007 and 604-630- 012 located at the southeast corner of Washington and Miles Avenue. 3. The exhibits may be on display from February 27, 2025 through March 9, 2025 and are accessible between the hours of 10.00 am until 6.00 pm. 4. The exhibit display shall be conducted per the Statement of Operations attached to this approval and on file with the City. 5. The applicant shall pay Open Space Use Fees for use of the City property at APN 604- 630-007, consistent with the 2024 Master Fee Schedule (City Council Resolution 2024- 031), at the maximum daily rate of $440 for the duration of the exhibit (11 days) including set-up and tear -down dates, in the amount of $4,840 . 6. The applicant shall provide insurance with the City as named insured for the exhibition with the following coverages: • General Liability — $1 M per occurrence / $2M general aggregate • General Liability — Additional Insured Endorsement (for ongoing and completed operations) • General Liability — Primary / Non-contributory Endorsement • Automobile Liability — $1 M combined single limit • Workers' Compensation — Statutory Limits / Employer's Liability $1 M per accident or disease • Workers' Compensation — Waiver of Subrogation Endorsement 7. The exhibits shall be removed and the premises cleared of all debris and restored to pre - exhibit conditions by the end of March 9, 2025. The permittee may be required to stabilize all disturbed areas of the site for an additional cost if the City Engineer deems necessary. 8. Any damage to public hardscape due to the installation and/or removal of the directional signs shall be repaired as directed by the City Engineer. This includes but is not limited to sidewalks, curb and gutter, landscaping, and pavement especially within the surrounding public streets. 9. Temporary signs shall not be located closer than five (5) feet from the edge of the paved ta aura area of any public road or street and shall not be posted within any medianlocated in a public road or street. Temporary signs shall not be posted in a manner which obstructs the visibility of traffic or street signs, signals, and emergency equipment pursuant to La Quinta Municipal Code Section 9.160.060. All signage must be removed at the conclusion of the event, or each sign is subject to a $50.00 fine. Please contact the Code Compliance Department at (760) 777-7050 regarding removal of signage. 10.Outdoor operations shall comply with the City of La Quinta's outdoor noise ordinance, per Section 9.100.210 and the City of La Quinta's outdoor lighting ordinance, per Section 9.100.150 of the La Quinta Municipal Code. 11.Adequate pedestrian and vehicular access shall be maintained around displays, temporary structures, and the generator. Roadways, parking areas, and pedestrian traffic aisles outside the proposed area shall be always maintained accessible. 12. The facility shall not engage in the sale of any merchandise or other activities not contained herein. 13.All electrical wirings must comply with the California Electrical Code as well as Building and Safety Requirements. No zip cords will be allowed. All extension cords must be connected to a circuit protected outlet. Use of generators shall comply with the California Fire Code and Building Code. 14. A separate Building and Fire Special Inspection shall be required. Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding properties and businesses will be minimized. The City may elect to add conditions to this application to mitigate any problems that arise not previously addressed herein. WHO IS AN INSURED is amended to include as an Insured any person or organization described in paragraphs A. through K. below whom a Named Insured is required to add as an additional insured on this Coverage Part under a written contract or written agreement, provided such contract or agreement: (1) is currently in effect or becomes effective during the term of this Coverage Part; and (2) was executed prior to: (a) the bodily injury or property damage; or (b) the offense that caused the personal and advertising injury, for which such additional insured seeks coverage. b. However, subject always to the terms and conditions of this policy, including the limits of insurance, the Insurer will not provide such additional insured with: (1) a higher limit of insurance than required by such contract or agreement; or (2) coverage broader than required by such contract or agreement, and in no event broader than that described by the applicable paragraph A. through K. below. Any coverage granted by this endorsement shall apply only to the extent permissible by law. A. Controlling Interest Any person or organization with a controlling interest in a Named Insure , but only with respect to such person or orqanization's liability for bodily injury, property damage or personal and advertising injury arising out of: 1. such person or organization's financial control of a Named Insured; or 2. premises such person or organization owns, maintains or controls while a Named Insured leases or occupios such promisos; provided that the coverage granted by this paragraph does not apply to structural alterations, new construction or demolition operations performed by, on behalf or, or rut suds additional insured. B. Co-owner of Insured Premises A co-owner of a premises co -owned by a Named Insured and covered under this insurance but only with respect to such co -owner's liability for bodily injury, property damage or personal and advertising injury as co-owner of such premises. Grantor of Franchise Any person or organization that has granted a franchise to a Named Insured, but only with respect to such person or organization's liability for bodily injury, property damage or personal and advertising injury as grantor of a franchise to the Named Insured. D. Lessor of Equipment Any person or organization from whom a Named Insured leases equipment, but only with respect to liability for bodily injury, property damage or personal and advertising injury caused, in whole or in part, by the Named Insured's maintenance, operation or use of such equipment, provided that the occurrence giving rise to such bodily injury, property damage or the offense giving rise to such personal and advertising injury takes place prior to the termination of such lease. The coverage granted by this paragraph does not apply to structural alterations, new construction or demolition operations performed by, on behalf of, or for such additional insured. F. Lessor of Premises An owner or lessor of premises leased to the Named Insured, or such owner or lessor's real estate manager, but only with respect to liability for bodily injury, property damage or personal and advertising injury arising out of the ownership, maintenance or use of such part of the premises leased to the Named Insured, and provided that the occurrence giving rise to such bodily injury, property damage or the offense giving rise to such personal and advertising injury takes place prior to the termination of such lease. The coverage granted by this paragraph does not apply to structural alterations, new construction or demolition operations performed by, on behalf of, or for such additional insured. G. Mortgagee, Assignee or Receiver A mortgagee, assignee or receiver of premises but only with respect to such mortgagee, assignee or receiver's liability for bodily injury, property damage or personal and advertising injury arising out of the Named Insured's ownership, maintenance, or use of a premises by a Named Insured. The coverage granted by this paragraph does not apply to structural alterations, new construction or demolition operations performed by, on behalf of, or for such additional insured. H. State or Governmental Agency or Subdivision or Political Subdivisions — Permits A state or governmental agency or subdivision or political subdivision that has issued a permit or authorization, but only with respect to such state or governmental agency or subdivision or political subdivision's liability for bodily injury, property damage or personal and advertising injury arising out of: 1. the following hazards in connection with premises a Named Insured owns, rents, or controls and to which this insurance applies: a. the existence, maintenance, repair, construction, erection, or removal of advertising signs, awnings, canopies, cellar entrances, coal holes, driveways, manholes, marquees, hoistaway openings, sidewalk vaults, street banners, or decorations and similar exposures; or b. the construction, erection, or removal of elevators; or c. the ownership, maintenance or use of any elevators covered by this insurance; or 2. the permitted or authorized operations performed by a Named Insured or on a Named Insured's behalf. The coverage granted by this paragraph does not apply to: a. Bodily injury, property damage or personal and advertising injury arising out of operations performed for the state or governmental agency or subdivision or political subdivision; or b. Bodily injury or property damage included within the products -completed operations hazard. With respect to a Named Insured's participation in a trade show event as an exhibitor, presenter or displayer, any person or organization whom the Named Insured is required to include as an additional insured, but only with respect to such person or organization's liability for bodily injury, property damage or personal and advertising injury caused by: a. the Named Insured's acts or omissions; or b. the acts or omissions of those acting on the Named Insured's behalf, in the performance of the Named Insured's ongoing operations at the trade show event premises during the trade show event. 2. ADDITIONAL INSURED - PRIMARY AND NON-CONTRIBUTORY TO ADDITIONAL INSURED'S INSURANCE A. The Other Insurance Condition in the COMMERCIAL GENERAL LIABILITY CONDITIONS Section is amended to add the following paragraph: If the Named Insured has agreed in writing in a contract or agreement that this insurance is primary and non- contributory relative to an additional insured's own insurance, then this insurance is primary, and the Insurer will not seek contribution from that other insurance. However, the Named Insured shall give written notice of such occurrence, offense or claim to the Insurer as soon as the Named Insured is aware that this insurance may apply to such occurrence, offense or claim. 5. BROAD NAMED INSURED WHO IS AN INSURED is amended to delete its Paragraph 3. in its entirety and replace it with the following: 3. Pursuant to the limitations described in Paragraph 4. below, any organization in which a Named Insured has management control: a. on the effective date of this Coverage Part; or b. by reason of a Named Insured creating or acquiring the organization during the policy period, qualifies as a Named Insured, provided that there is no other similar liability insurance, whether primary, contributory, excess, contingent or otherwise, which provides coverage to such organization, or which would have provided coverage but for the exhaustion of its limit, and without regard to whether its coverage is broader or narrower than that provided by this insurance. This insurance applies to bodily injury provided that the professional health care services are incidental to the Named Insured's primary business purpose, and only if: (1) such bodily injury is caused by an occurrence that takes place in the coverage territory. This Provision 11. does not apply if liability for damage to premises rented to a Named Insured is excluded by another endorsement attached to this Coverage Part. 12. MEDICAL PAYMCNTS A. LIMITS OF INSURANCE is amended to delete Paragraph 7. (the Medical Expense Limit) and replace it with the following: 7. Subject to Paragraph 5. above (the Each Occurrence Limit), the Medical Expense Limit is the most the Insurer will pay under Coverage C - Medical Payments for all medical expenses because of bodily injury sustained by any one person. Primary Insurance This insurance is primary. The Insurer's obligations are not affected unless any of the other insurance is also primary. Then, the Insurer will share with all that other insurance by the method described in Paragraph b. below. B. Method of Sharing If all of the other insurance permits contribution by equal shares, the Insurer will follow this method also. Under this approach each insurer contributes equal amounts until it has paid its applicable limit of insurance or none of the loss remains, whichever comes first. If any of the other insurance does not permit contribution by equal shares, the Insurer will contribute by limits.
