of Division 3 of the Business and Professions

DECLARATION REGARDING CONSTRUCTION LENDING AGENCY (If
applicable)
A construction lender will be used for completion of the improvements
covered by this permit and the name and information of which is on file for
public inspection during the regular business hours of the public entity.
Failure of the applicant to indicate the construction lender on the
WORKERS’ COMPENSATION DECLARATION (1, 2 or 3)
WARNING: FAILURE TO SECURE WORKERS’ COMPENSATION COVERAGE IS
UNLAWFUL, AND SHALL SUBJECT AN EMPLOYER TO CRIMINAL PENALTIES AND
CIVIL FINES UP TO ONE HUNDRED THOUSAND DOLLARS ($100,000), IN ADDITION
TO THE COST OF COMPENSATION, DAMAGES AS PROVIDED FOR IN SECTION
3706 OF THE LABOR CODE, INTEREST, AND ATTORNEY’S FEES.
1) Has and will maintain a certificate of consent to self-insure for workers’
compensation, issued by the Director of Industrial Relations as provided for
by Section 3700 of the Labor Code, for the performance of the work for
which this permit is issued.
2) Has and will maintain workers’ compensation insurance, as required by
Section 3700 of the Labor Code, for the performance of the work for which
this permit is issued.
3) Certifies that, in the performance of the work for which this permit is
issued, shall not employ any person in any manner so as to become subject
to the workers’ compensation laws of California, and agree that, if should
become subject to the workers’ compensation provisions of Section 3700 of
the Labor Code, shall forthwith comply with those provisions.
NOTICE TO APPLICANT (1, 2 and 3)
1) Each person upon whose behalf this application was made, each person
at whose request and for whose benefit work is being performed under or
pursuant to any permit issued as a result of this application, the owner, and
the applicant, each agrees to, and shall defend, indemnify and hold harmless
the City of La Quinta, its officers, agents, and employees for any act or
omission related to the work being performed under or following issuance of
this permit.
2) Any permit issued as a result of this application becomes null and void if
work is not commenced within 360 days from date of issuance of such
permit, or if cessation of work for 180 days will subject permit to
cancellation. On or after January 1, 2019, every permit issued shall become
invalid unless the work on the site authorized by such permit is commenced
within 12 months after its issuance, or if the work authorized on the site by
such permit is suspended or abandoned for a period of 12 months after the
time the work is commenced.
3) Certified that they read the application and state that the information
provided is correct. Agree to comply with all city and county ordinances and
state laws relating to building construction, and hereby authorize
representatives of this city to enter upon the above-mentioned property for
inspection purposes.
IMPORTANT: An Application for Permit was made to the Building Official,
subject to the conditions and restrictions set forth at the time of application,
which is now hereby an Issued Permit. If any part of the information being
supplied on this permit is inaccurate or untrue, please contact the City of La

Construction or work for which a permit is required shall be subject to inspection by the building official and such construction or work
shall remain visible and able to be accessed for inspection purposes until approved. Approval as a result of an inspection shall not be
construed to be an approval of a violation of the provisions of the applicable code and other ordinances of the jurisdiction. Inspections
presuming to give authority to violate or cancel the provisions of the applicable code and other ordinances of the jurisdiction shall not be
valid. It shall be the duty of the owner or the owner's authorized agent to cause the work to remain visible and able to be accessed for
inspection purposes. Neither the building official nor the jurisdiction shall be liable for expense entailed in the removal or replacement of
any material required to allow inspection.
It shall be the duty of the holder of the building permit or their duly authorized agent to notify the building official when work is ready for
inspection. It shall be the duty of the permit holder to provide access to and means for inspections of such work that are required by this
code.
Inspections
A building or structure shall not be used or occupied in whole or in part, and a change of occupancy of a building or structure or portion
thereof shall not be made, until the building official has issued a certificate of occupancy therefor as provided herein. Issuance of a
certificate of occupancy shall not be construed as an approval of a violation of the provisions of the applicable code and other ordinances
of the jurisdiction. Certificates presuming to give authority to violate or cancel the provisions of this code or other ordinances of the
jurisdiction shall not be valid.
Certificate of Occupancy
A person shall not make connections from a utility, a source of energy, fuel, or power, or a water system or sewer system to any building
or system that is regulated by the applicable code and other ordinances of the jurisdiction for which a permit is required, until approved by
the building official.

1. NOTWITHSTANDING ANY OMISSIONS, IT SHALL BE THE SOLE DUTY AND
RESPONSIBILITY OF THE CONTRACTOR TO REVIEW DESIGNED CONSTRUCTION
DETAILS AND FABRICATE AND INSTALL SAID DESIGN IN ACCORDANCE WITH
ACCEPTED GOOD PRACTICE AND PROCEDURES. ANY DEVIATIONS TO DETAILS
MUST BE SUBMITTED TO ARCHITECT AND OWNER FOR REVIEW AND APPROVAL
PRIOR TO FABRICATION.
2. ALL REQUIRED WORK SHALL BE PERFORMED BY THE GENERAL CONTRACTOR,
UNLESS OTHERWISE NOTED. ALL REFERENCES TO THE "CONTRACTOR" INCLUDE THE
GENERAL CONTRACTOR AND HIS SUBCONTRACTORS, THEY SHALL BE ONE AND THE
SAME.
3. IT IS THE CONTRACTOR'S RESPONSIBILITY TO ENSURE THAT INSTALLATION
METHODS CONFORM TO ALL BUILDING CODE REQUIREMENTS. THE MATERIALS
SPECIFIED ARE INTENDED TO MEET CODE REQUIREMENTS; ANY DISCREPANCY
BETWEEN THE CONSTRUCTION DOCUMENT'S AND CODE REQUIREMENTS SHALL BE
BROUGHT TO THE ATTENTION OF OWNER AND HOUSTON/TYNER IMMEDIATELY BY
THE CONTRACTORS, PRIOR TO PROCEEDING WITH THE SPECIFIED WORK.
4. REFER TO TITLE SHEET FOR ALL APPLICABLE BUILDING CODES.
5. ALL MATERIALS PROVIDED SHALL CONFORM TO ALL LOCAL, CITY AND/OR
COUNTY FIRE REGULATIONS. CERTIFICATES OR APPROVED FIRE RETARDANT
PROCESSING FLAME SPREAD RATES, ETC., SHALL BE OBTAINED WITHOUT SPECIFIC
REQUEST AND SUBMITTED TO THE ARCHITECT FOR REVIEW
6. THE DRAWINGS AND SPECIFICATIONS ARE COMPLEMENTARY; WHAT IS REQUIRED
BY ONE SHALL BE AS BINDING AS IF REQUIRED BY ALL. REFER TO HOUSTON/TYNER
GENERAL REQUIREMENTS AND SPECIFICATIONS FOR ADDITIONAL INFORMATION.
7. NO SUBSTITUTIONS OF SPECIFIED MATERIAL SHALL BE PERMITTED WITHOUT
FIRST SUBMITTING SPECIFICATIONS, SAMPLES, AND COST IMPACT FOR
HOUSTON/TYNER'S AND OWNER'S APPROVAL.
8. THE CONTRACTOR SHALL COORDINATE HIS WORK WITH ALL OTHER TRADES ON
THE PROJECT. ANY CHANGES OR DELAYS ARISING FROM CONFLICT BETWEEN
TRADES SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR AT NO ADDITIONAL
COST TO THE OWNER.
9. AT THE TIME OF BID SUBMITTAL, THE CONTRACTOR SHALL ADVISE
HOUSTON/TYNER (IN WRITING) OF ANY SPECIFIED MATERIALS OR EQUIPMENT
WHICH ARE EITHER UNAVAILABLE OR WILL CAUSE A DELAY IN THE CONSTRUCTION
COMPLETION SCHEDULE.
10. IMMEDIATELY AFTER BEING AWARDED THE CONTRACT, THE CONTRACTOR
SHALL SUBMIT A CONSTRUCTION SCHEDULE IN ACCORDANCE WITH THE BID R.F.P.
THE CONSTRUCTION SCHEDULE SHALL BE CONTINUOUSLY UPDATED AND POSTED
ON THE JOB SITE AT ALL TIMES AND PROVIDED TO THE OWNER AT THE WEEKLY
CONSTRUCTION MEETING. NOTE: POSTED SCHEDULE SHALL INCLUDE SHOP
DRAWING SUBMITTAL DATES.
11. ELASTASIL OR CONCRETE FLOORS NOT RUNNING TRUE TO LEVEL SHALL BE
LEVELED WITH APPROPRIATE FLOOR LEVELING COMPOUND PRIOR TO INSTALLATION
OF FLOOR COVERING. CEILINGS AND FLOORS ARE TO BE INSTALLED LEVEL WITHIN
REASONABLE TOLERANCES OF +1/4", WITHIN A 10 FOOT SPAN.
12. GENERAL CONTRACTOR SHALL MAKE ALLOWANCE IN BID PROPOSAL FOR
ENSURING A LEVELING COMPOUND IS USED IN AREAS WHERE CONCRETE FLOOR IS
TO RECEIVE NEW FLOOR FINISH.
13. UNLESS OTHERWISE NOTED, DO NOT SCALE DRAWINGS; DIMENSIONS
GOVERN. LARGE SCALE DETAILS GOVERN OVER SMALL DETAILS.
14. THE CONTRACTOR SHALL PROVIDE AND INSTALL ROUGH PLUMBING AND FINAL
HOOK-UP FOR ALL SPECIFIED FIXTURES AND APPLIANCES, AND SHALL SUPPLY ALL
SUCH FIXTURES AND APPLIANCES, UNLESS OTHERWISE NOTED. ANY PLANNED
TEMPORARY SHUTDOWN OF WATER / ELECTRIC / HEATING / COOLING SYSTEM MUST
BE MADE 48 HOURS BEFOREHAND TO THE OWNER'S REPRESENTATIVE.
15. ANY FLOOR PENETRATION REQUIRING CORE DRILLING OF ANY KIND IS
SUBJECT TO X-RAY SCAN (GPR OR SIMILAR) BEFOREHAND TO IDENTIFY ANY HIDDEN
UTILITIES.
16. THE CONTRACTOR SHALL COORDINATE WITH ALL EQUIPMENT
MANUFACTURERS FOR EQUIPMENT ROUGH-IN REQUIREMENTS.
17. THE CONTRACTOR SHALL VERIFY REQUIRED LOCATION OF ALL NECESSARY
ACCESS PANELS (IN PARTITIONS, FLOORS, OR CEILINGS) AND COORDINATE EXACT
LOCATIONS WITH HOUSTON/TYNER AND OWNER PRIOR TO INSTALLATION. ALL
ACCESS PANELS SHALL BE INSTALLED FLUSH WITH THE SURFACE IN WHICH THEY
ARE INSTALLED WITH NO EXPOSED TRIM.
18. THE CONTRACTOR SHALL SUPPLY AND INSTALL BLOCKING AND SUPPORTS IN
PARTITIONS AND CEILINGS AS REQUIRED FOR INSTALLATION OF SPECIFIED
EQUIPMENT, ACCESSORIES, AND CABINETRY.
19. THE CONTRACTOR SHALL SUBMIT ALL PERTINENT SHOP DRAWINGS AND FINISH
SAMPLES FOR HOUSTON/TYNER'S AND OWNER'S REVIEW. CONTRACTOR TO
PROVIDE ARCHITECT AND OWNER A SCHEDULE FOR SHOP DRAWING SUBMITTAL
WITHIN 30 DAYS OF "NOTICE TO PROCEED" OR EXECUTION OF THE CONTACT.
CONTRACTOR SHALL ALLOW 10 WORKING DAYS FOR ARCHITECT AND OWNER
REVIEW OF THE SHOP DRAWINGS. CONTRACTOR SHALL ALLOW SUFFICIENT TIME IN
THE SCHEDULE FOR CORRECTING DEFICIENCIES IN SHOP DRAWING SUBMITTALS.
20. THE CONTRACTOR SHALL BE RESPONSIBLE FOR INSTALLATION OF ALL
MECHANICAL EQUIPMENT, AND ALL MOUNTING AND SEISMIC BRACING OF SUCH
EQUIPMENT.
21. THE CONTRACTOR IS TO PROVIDE A FIRE SPRINKLER SHOP DRAWING
COORDINATED TO THE REFLECTED CEILING LAYOUT.
36. THE MECHANICAL AND ELECTRICAL DRAWINGS ARE SUPPLEMENTARY TO THE
ARCHITECTURAL DRAWINGS. IT SHALL BE THE RESPONSIBILITY BY THE
CONTRACTOR TO CHECK WITH THE ARCHITECTURAL DRAWINGS PRIOR TO
SUBMITTAL OF BID AND AGAIN BEFORE THE INSTALLATION OF MECHANICAL AND
ELECTRICAL WORK. ANY DISCREPANCY BETWEEN THE ARCHITECTURAL DRAWINGS
AND FIELD CONDITIONS SHALL BE BROUGHT TO THE ATTENTION OF
HOUSTON/TYNER FOR CLARIFICATION. WORK INSTALLED IN CONFLICT WITH THE
ARCHITECTURAL DRAWINGS SHALL BE CORRECTED BY THE CONTRACTOR AT HIS
OWN EXPENSE AND SHALL NOT IMPACT THE SCHEDULE.
37. ALL ELECTRICAL ITEMS NOTED FOR INSTALLATION IN CABINET WORK SHALL BE
SUPPLIED, INSTALLED AND COORDINATED BY THE CONTRACTOR, UNLESS
OTHERWISE NOTED.
38. MECHANICAL AND ELECTRICAL ENGINEERING SHOP DRAWINGS SHALL BE
SUBMITTED TO HOUSTON/TYNER FOR REVIEW, PRIOR TO START OF
CONSTRUCTION. THE CONTRACTOR IS RESPONSIBLE FOR COORDINATING ANY
PENETRATIONS INTO STRUCTURAL SHOP DRAWINGS.
39. ALL CONDUIT, OTHER THAN THAT USED FOR ELECTRICAL OUTLETS AND
JUNCTION BOXES, SHALL RECEIVE PULL WIRES INSTALLED BY THE CONTRACTOR.
40. ALL LIGHT FIXTURES SHALL BE LOCATED EXACTLY AS NOTED ON ARCHITECT'S
DRAWINGS. NO EXCEPTIONS. CEILING GRIDS SHALL BE CUT AND REWORKED AS
REQUIRED TO ACCOMMODATE LIGHT FIXTURES AND OTHER ITEMS NOTED WITH A
SPECIFIC LOCATION.
41. THE CONTRACTOR SHALL OBTAIN HOUSTON/TYNER'S APPROVAL OF LAYOUT
OF LIGHT FIXTURES PRIOR TO FINAL CONNECTIONS AND SECURING IN PLACE OF
FIXTURES.
42. ALL SWITCHES SHALL BE GANG PLATED, WHERE APPLICABLE.
43. ALL TELEPHONE AND ELECTRICAL OUTLETS SHALL BE INSTALLED EXACTLY AS
DIMENSIONED AND/OR NOTED. ANY DISCREPANCIES BETWEEN NOTED
DIMENSIONS AND FIELD CONDITIONS SHALL BE REPORTED TO HOUSTON/TYNER
AND OWNER IMMEDIATELY, PRIOR TO INSTALLATION.
44. DO NOT INSTALL OUTLETS EITHER BACK-TO-BACK OR SIDE-TO-SIDE ON
OPPOSITE SIDES OF SAME WALL. SEPARATE ALL SUCH OUTLETS WITH ONE STUD
(VERTICAL OR HORIZONTAL).
45. WHERE CEILINGS ARE SPECIFIED TO BE FIRE RATED CONSTRUCTION, ALL
MECHANICAL DUCTS, RECESSED LIGHT FIXTURES AND SPEAKERS SHALL BE BOXED
OUT ABOVE THE CEILING WITH A FIRE RATED ENCLOSURE EQUAL TO THE RATING
OF THE CEILING.
22. THE CONTRACTOR SHALL MAINTAIN THE PREMISES CLEAN AND FREE OF TRASH
AND DEBRIS, AND SHALL PROTECT ALL ADJACENT WORK FROM DAMAGE, SOILING,
PAINT OVERSPRAY, ETC. ON A DAILY BASIS. ALL FIXTURES, EQUIPMENT, GLAZING,
FLOORS, ETC., SHALL BE LEFT CLEAN AND READY FOR OCCUPANCY. NO FLAMMABLE
MATERIAL IS TO BE STORED ON THE GUESTROOM FLOORS OVERNIGHT.
23. JUST PRIOR TO INSTALLATION OF CARPET AND WINDOW COVERING, THE
CONTRACTOR SHALL MAINTAIN DAILY THE SPACE IN "BROOM CLEAN" CONDITION
WHETHER OR NOT INSTALLATION OF CARPET AND WINDOW COVERING ARE THE
RESPONSIBILITY OF THE CONTRACTOR.
24. UPON COMPLETION OF EACH PHASE OF CONSTRUCTION, THE CONTRACTOR
SHALL PROVIDE THE ARCHITECT WITH THREE COMPLETE SETS OF MARKED UP
DRAWINGS SHOWING AS-BUILT CONDITIONS. ARCHITECT SHALL REVIEW FOR
COMPLETENESS AND SUBMIT TO OWNER.
25. THE CONTRACTOR AND SUBCONTRACTOR SHALL CHECK AND VERIFY ALL
DIMENSIONS, ELEVATIONS, AND CONDITIONS AT THE SITE BEFORE COMMENCING
ANY WORK. ANY DISCREPANCIES OR OMISSIONS SHALL BE BROUGHT TO THE
ARCHITECT'S ATTENTION PRIOR TO COMMENCING SUCH WORK.
26. REFERENCE TO ANY DETAIL OR DRAWINGS IS FOR CONVENIENCE ONLY AND
DOES NOT LIMIT THE APPLICATION OF SUCH DETAIL OR DRAWING.
27. THE CONTRACTOR TO VERIFY LOCATION AND SIZE OF ALL OPENINGS WITH ALL
