HOUSING AUTHORITY MINUTES Page 1 of 3 JANUARY 21, 2025 HOUSING AUTHORITY MINUTES TUESDAY, JANUARY 21, 2025 CALL TO ORDER A regular quarterly meeting of the La Quinta Housing Authority (Authority) was called to order at 7:24 p.m. by Chairperson Fitzpatrick. PRESENT: Authority Members: Evans, McGarrey, Peña, Sanchez, and Chairperson Fitzpatrick ABSENT: None VERBAL ANNOUNCEMENT – AB 23 was made by the Authority Secretary PUBLIC COMMENT ON MATTERS NOT ON THE AGENDA PUBLIC SPEAKER: Patsy Zimmerman, La Quinta – was not present to speak when called upon by the Chairperson. PUBLIC SPEAKER: Christopher Morgan, La Quinta – resides at the Watercolors residential development and expressed concerns regarding the upcoming mandatory bulk cable service being implemented by the homeowners’ association (HOA) with little notice, and inaccurate information; the bulk rate will decrease the monthly rate for those currently with service, but will mandate those who do not have or wish to have the service, pay the $75 monthly rate, which some cannot afford. PUBLIC SPEAKER: James Lewis, La Quinta – resides at the Watercolors residential development and provided information on his and his wife’s career and financial background; expressed concerns regarding the continuing increase in HOA dues; current primary concern is the upcoming mandatory bulk cable service being implemented improperly by the HOA as it is a violation of the community’s Covenants, Conditions and Restrictions (CC&Rs); the mandatory service will adversely affect affordability of housing units, and force those who cannot afford, or just do not want the service, to pay the monthly charge. Mr. Lewis added that the HOA is currently collecting ballots on this issue from residents, and expects to release the voting results at their February 28, 2025, meeting. In response to Chairperson Fitzpatrick, Authority Counsel Ihrke explained that the City has no jurisdiction over the HOA Board’s decisions however, Mr. Ihrke’s office, as representative of the Authority, did send a letter to the HOA’s legal counsel, with a copy to the current HOA Boardmembers, informing them that the Authority has received several concerns on this matter from Watercolors residents, and highlighted two issues: (1) being the liability faced by the HOA Board if the legal procedures in the HOA’s governing documents are not followed regarding contracting for this mandatory service CONSENT CALENDAR ITEM NO. 1 5 HOUSING AUTHORITY MINUTES Page 2 of 3 JANUARY 21, 2025 charge; and (2) causing the housing units to exceed the sale price set by State law for affordable housing since this mandatory charge would be factored into the sale price calculation. The Authority discussed the items included in the State’s formula for the sale price of affordable housing such as assessments like cable, taxes, and electricity; the purpose of contracting bulk cable service; understanding that some residents are unable to pay the mandatory service charge, and do not wish to have the service; suggested that residents contact the service provider for senior or discounted service fees for lower income households; and suggested that residents against the bulk service continue their campaign with fellow residents. The Authority requested that (1) Authority Counsel follow up on the previous letter to the HOA’s attorney requesting a response, and (2) the City Manager investigate discounts available from the service provider. Motion passed unanimously. 2. RECEIVE AND FILE FISCAL YEAR 2023/24 HOUSING AUTHORITY YEAR- END BUDGET Finance Manager Martinez presented the staff report, which is on file in the Clerk’s Office. MOTION – A motion was made and seconded by Authority Members Evans/McGarrey to receive and file fiscal year 2023/24 Housing Authority Year-End Budget report as presented. HOUSING AUTHORITY MEMBERS' ITEMS Authority Member Evans noted at the last Coachella Valley Association of Governments Executive Committee meeting, there was a blanket request for all cities to contribute to the Housing First Program at $125,000 per year for three to five years, and noted that the City of La Quinta currently contributes annually $100,000 to this Program as well as $100,000 each to two other local housing programs. EXECUTIVE SUMMARY On January 17, 2023, the Housing Authority (Authority) approved an Agreement for Purchase and Sale and Escrow Instructions (PSA) with BP Dune Palms, LP, by General Partner Blackpoint Properties, LLC (Blackpoint) to purchase 5.2 acres of vacant real property located west of the Home Depot Center on Highway 111, on the northeast corner of Highway 111 and Dune Palms Road (Property), for an affordable housing development. On July 16, 2024, the Authority and Blackpoint executed a Side Letter Agreement (Agreement) formalizing the Authority's reimbursement obligation for construction of utility undergrounding costs, with future costs from Imperial Irrigation District (IID) to be brought back upon final invoicing. On November 5, 2024, and January 21, 2025, the Authority approved partial reimbursements in the amount of $366,542 and $179,958, respectively, for utility improvements related to the Property. On February 27, 2025, IID provided allocation fees to complete the offsite conduit connections. The total cost for this is $381,051, of which the Authority’s share is 54.324% of the total fees, equating to $207,003. FISCAL IMPACT An appropriation of $207,003 to Account No. 249-0000-80050 is necessary to cover the Authority’s share of the IID fees. CONSENT CALENDAR ITEM NO. 2 9 Total utility improvements reimbursement costs for the Property to date are $753,503 as detailed below: 2024 (November 5) $366,542 2025 (January 21) $179,958 2025 (March) $207,003 BACKGROUND/ANALYSIS On January 17, 2023, the Authority approved a PSA with Blackpoint to purchase the Property located at the northeast corner of Highway 111 and Dune Palms Road for the purpose of developing affordable housing with a connecting thoroughfare to CV Link. The agreement stipulated the Authority’s responsibility for relocating and undergrounding utility lines along Dune Palms Road, or reimbursing Blackpoint if they performed the work themselves. In October 2023, Blackpoint recorded Final Parcel Map No. 38668 (DOC # 2023-031546) with the Riverside County Recorder, subdividing the vacant lot into three parcels, and the Authority took ownership of the norther portion of the lot (parcel 1), which fronts Dune Palms Road, and Blackpoint retained the southern portion along Highway 111 comprised of two new parcels 2 and 3. Blackpoint subsequently commenced utility relocation and undergrounding work, which has now been substantially completed. On July 16, 2024, the Authority and Blackpoint executed a Side Letter Agreement pursuant to Sections 5.8.1 and 5.8.4 of the PSA, which formalized the Authority’s reimbursement obligation for utility undergrounding costs as detailed under the Fiscal Impact section of this report, with permitting and construction costs each subject to final invoicing from IID. The current construction costs were provided by Blackpoint on March 5, 2025, detailing a total cost of $381,051, which includes offsite mitigation work required to deliver adequate power to the site, including installation of a new IID vault abutting the City property with an underground connection crossing the street to the vault on the west side, south of the bridge. The Authority’s share, based on the proportional linear footage of conduit installed along Dune Palms Road (54.324%), calculates to $207,003 (Attachment 1). Blackpoint will pay the full IID fee immediately to prevent project delays, and, per the PSA, the Authority must reimburse its share within 30 days. Staff recommends approval of the appropriation and reimbursement to ensure the timely completion of the project. ALTERNATIVES As the Authority approved the PSA terms which stipulate reimbursement for utility improvements and undergrounding, staff does not recommend an alternative.
