Weber Architect 2276 Via Alba Palm Desert, CA 92260 SUBJECT: MINOR USE PERMIT 2025-0003 — THREE (3) ATTACHED CASITAS/GUESTHOUSES MINOR ADJUSTMENT 2025-0004 — REDUCTION IN FRONT YARD SETBACK 80585 VIA SAVONA (APN 777-120-007) Dear Andrzej Weber: The City of La Quinta Design and Development Department has reviewed Minor Use Permit (MUP) 2025-0003, a project resulting in three attached casitas/guesthouses at an existing residence at 80585 Via Savona. The project also includes Minor Adjustment (MA) 2025-004, which will allow a reduction in the front yard setback to 17.66 feet, since the project includes conversion of an existing side entry garage (previously permitted with a reduced front -yard setback of 17.66 feet), into living space. Pursuant to Specific Plan (SP) 1999-035 and the findings listed in Section 9.210.025 and Section 9.210.040 of La Quinta Municipal Code, MUP2025-0003 and MA2025-0004 are hereby approved, subject to the information on file and the conditions of approval included herein. Findings 1. Consistency with General Plan. The proposed use includes construction of casitas at residence with a General Plan Land Use Designation of Low Density Residential (LDR) which allows single family residential development. Casitas/guesthouses are an accessory use that is allowed in Low Density Residential areas. Furthermore, the General Plan promotes the use of Specific Plans as a valuable tool for creative development as they allow more flexible standards for development. The project, which consists of three casitas/guesthouses, falls within Specific Plan (SP) 1999-035 which allows up to three guesthouses or casitas on a single family home site in the Hideaway Golf Club with a MUP. 2. Consistency with Zoning Code. Casitas/guesthouses are permitted as an accessory use, and consistent with the intent of the zone. The casitas will be constructed within an existing side -entry garage, which was permitted to have a reduced setback. The existing side -entry garage is 17.66 feet and their conversion into casitas will not encroach any further into the front yard area. Conversion of the garage into living space will be consistent with the adjoining neighborhood and will match the nearby homes with respect to architecture and building setbacks. 3. Compliance with CEQA. The Minor Use Permit is exempt from the California Environmental Quality Act (CEQA) per Section 15301 (e) as it involves additions to existing areas that do not result in an increase of 50 percent of the floor area before the addition or 2,500 square feet. The project will result in an expansion totaling 375 square feet or 11.4% of the existing area. 4. Surrounding Uses. Approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. The proposed conversion of an existing side entry garage into two casitas will not result in a change in the architectural design of the building and will be consistent with the use and building setbacks of nearby properties. Conditions of Approval 1. The applicant shall obtain Building permit approval for this project. Additional permits from Riverside County Fire Department may be required. 2. The living area of each casita/guest house on the site shall not exceed the limit allowed in the approved SP 1999-035. Prior to any expansion of a casita/guesthouse, the applicant shall obtain a Building Permit approval. 3. A deed restriction shall be recorded prohibiting rental of the casitas/guesthouses, prior to the issuance of any building permit for the project. 4. Operations shall be consistent with statement of operations and floor plan on file. Please be advised that the City only approves three Minor Adjustments per lot, regardless of the percentage of the development standard adjusted. This approval relates only to the minor adjustments referenced herein and does not imply any entitlement or approval of a building permit for any structures shown on the plans on file.
