Respectfully submitted, TANIA FLORES, Commission Secretary City of La Quinta, California PLANNING COMMISSION MINUTES Page 3 of 3 MARCH 25, 2025 11 PUBLIC HEARING ITEM NO. 1 City of La Quinta PLANNING COMMISSION MEETING May 13, 2025 STAFF REPORT AGENDA TITLE: CONSIDER ADOPTING A RESOLUTION TO APPROVE CONDITIONAL USE PERMIT 2024-0004 AND SITE DEVELOPMENT PERMIT 2024-0010 FOR AN APPROXIMATE 16,000 SQUARE FOOT DENTAL OFFICE BUILDING; CEQA: THIS PROJECT IS EXEMPT FROM ENVIRONMENTAL REVIEW PURSUANT TO SECTION 15332 (CLASS 32) IN -FILL DEVELOPMENT; PROJECT LOCATION 47705 CALEO BAY RECOMMENDATION • Consider a resolution to approve Conditional Use Permit 2024-0004 and Site Development Permit 2024-0010. EXECUTIVE SUMMARY • Conditional Use Permit (CUP) 2018-0004 and Site Development Permit (SDP) 2018-0003 were approved by the Planning Commission on November 13, 2018, for the construction and operation of an art museum. The project site (Site) is located at 47705 Caleo Bay (Attachment 1). Construction of the art museum was started but not completed, and the use of the site was never established. The SDP and the CUP for the Art Museum have since expired. • The property has a new owner, Dr. Aaron Kelsey of Bliss Dentistry, who is proposing to finish construction of the building and establish a new use as a dental office building. • In order to make a recommendation for approval of the project, the Planning Commission must: 1) Determine that this project is exempt from environmental review pursuant to Section 15332 (Class 32) in -fill development project for compliance with the requirements of the California Environmental Quality Act (CEQA) in that the proposed project can be characterized as in -fill development. 2) Make findings and apply conditions of approval (COAs) in support of the SDP relating to architectural, site, and landscape design, and find the project consistent with the City's zoning and General Plan, and make findings and apply COAs in support of the CUP (Attachment 2). 12 BACKGROUND/ANALYSIS The subject site was initially designated commercial in 1989 as part of the approval of Tract Map 24230 for the Lake La Quinta development. The site is zoned Community Commercial (Attachment 3). A COA of the map requires approval of a Conditional Use Permit prior to the establishment of a new commercial use. The project site consists of approximately 1.2 acres and is located between Washington Street and Caleo Bay Drive, north of Avenue 48 and directly west of the existing Lake La Quinta residential development. In 2018, an SDP and CUP for the Desert Art Museum were approved by the Planning Commission. Construction of the art museum building started in February 2020. Construction stopped later in the year, leaving a partially framed structure and an unfinished construction site. The applicant requests approval to complete the building with minor exterior and interior modifications to accommodate dental offices. SDP approval is requested for landscaping and architectural design of the office building. The dental office building is two stories, with the second floor being used for storage. The dental practice is proposed to include suites for hygienists, dental treatment, and dental surgery. Site ueveiopment Permit (suv) The building will consist of hygienist, dental treatment, and dental surgery suites, offices, a reception area, and a break room on the ground floor. The entire second floor will be a storage area. The building reflects a modern design with architectural breaks and varying roof lines on all frontages and a simple color design incorporating grey, white, and tan colors. The maximum height of the building is 22 feet and incorporates a flat roof design. The building meets the development standards of the Community Commercial zone. The project plans are included as Attachment 4. .andscaping New landscaping is proposed all throughout the perimeter of the site, the parking lot, and the entrance to the museum. The assorted species of plants and trees, including date and fan palms, assorted agave plants, and century plants, add character to the proposed development, are consistent with desert landscaping palettes in the City, and provide sufficient screening and accents around the vehicular circulation areas. Parking The site provides 46 parking spaces, which is an increase from the 38 parking spaces provided by the previous art museum project. However, the site does not meet the 63 parking space requirement based on use as outlined in the Parking by Use section of La Quinta Municipal Code (LQMC) 9.150.070. To address this, the applicant provided an alternative methodology for demonstrating adequate parking, as provided for in LQMC 9.150.050(C), to allow flexibility with site design and accommodate a variety of uses. The applicant provided two methods for analyzing parking (Attachment 5). The first method uses a utilization rate for all 21 dental suites. This method assumes that each type of dental suite (hygienist, treatment, or operatory) will be utilized by an average of 1.5 people (patient and staff) per suite, resulting in 31.5 spaces for all suites. This method further expects that at any one time, only 70% of the dental suites will be occupied, resulting in 22 spaces 13 needed for patients at peak times. When one space per employee (15) is added, this methodology demonstrates the need for 37 spaces to be provided. The second alternative parking assessment is based on an evaluation of historical daily patient capacity of Bliss Dentistry's operations, which is the owner's current dental office located in the Village. After moving the Old Town practice to the new facility, Bliss Dentistry anticipates 10 patients per hour and a maximum of 15 employees per hour, resulting in a need for 25 parking spaces. Adding a 20% parking space contingency, which accounts for the increased demand for parking spaces during changes in staff shifts and similar situations, results in the need for 30 parking spaces. Since the site includes 46 parking spaces, both alternative parking methodologies conclude that sufficient parking is provided. Site access will be provided from Caleo Bay. Per the Engineering Bulletin #06-13, the project meets the screening criteria as a small project, General Office under 160,000 sf, and does not need to provide a Vehicle Miles Traveled (VMT) analysis. Additionally, the project would generate under 100 peak hour trips and does not require a Traffic Study. Conditional Use Permit A CUP is required as a COA of Tract Map 24230 to ensure compatibility with the surrounding uses within the Lake La Quinta development. The applicant provided a Statement of Operations (Attachment 6). The Dental Office Building will provide a service to local residents and is consistent with the adjacent medical building to the north and a convalescent care facility to the south. A COA of this project stipulates that any increase in the number of dental suites or the addition of new offices or uses or change of uses to the building, such as any change of the second floor storage to office or other use, will require a modification to the CUP along with an update to the parking assessment to demonstrate sufficient on -site parking. AGENCY AND PUBLIC REVIEW Public Agency Review All written comments received are on file and available for review with the Design and Development Department. All applicable comments have been adequately addressed and/or incorporated into the recommended COAs. Public Hearing Notice The public hearing for this project was publicized in The Desert Sun newspaper on May 2, 2025, and distributed to properties within 500 feet of the site. At the time of publication, Staff received no written comments. 14 ENVIRONMENTAL REVIEW The La Quinta Design and Development Department has determined that this project is exempt from environmental review pursuant to Section 15332 (Class 32) of the California Environmental Quality Act, In -Fill Development, since the project consists of an approximate 16,000 square foot building and meets the criteria for in -fill development since it is less than 5 acres and is located in an urbanized and built -out area. The project site has no value as habitat for endangered, rare, or threatened species. Approval of the project will not result in any significant effects relating to traffic, noise, or air quality since the project is not a high noise generating use and meets the VMT screening criteria of the City's Engineering Bulletin (06-13) as a small project resulting in less than 3,000 Metric Tons of Carbon Dioxide Equivalent (MTCO2e) per year as it is classified as General Office under 160,000 sf.. The project would not have impacts related to water quality as it would incorporate Best Management Practices via the City's MS4 permit. The site can be adequately served by all required utilities and public services. Prepared by: Scott Nespor, Senior Planner Approved by: Cheri Flores, Planning Manager Attachments: 1. Vicinity Map 2. The request is supported by practices in common use to assess the parking needs of dental facilities, and specific operational characteristics of the proposed La Quinta Dental Center. Two alternative methods of determining the parking requirements have been analyzed. In both cases, the adequacy of the proposed number of parking spaces onsite (44 spaces) is demonstrated. On behalf of Bliss Dentistry, we are confident in this approach and respectfully request that the City consider this request. History of Bliss Dentistry in La Quinta Dr. Kelsey has had his dental office, Bliss Dentistry, at Old Town La Quinta for the past five years, and has been practicing dentistry in La Quinta for a total of twenty-three years. During his tenure at Old Town La Quinta, with a current average daily patient load of 40-50 patients per day, he has not experienced significant complaints from his patients regarding parking, which comprises approximately twenty-five available spaces. Infrequent patient complaints are related to shared parking with Old Town during the daytime operating hours, particularly in -season. Challenges arise when the twenty-five parking spaces allotted to Bliss are usurped by patrons of other Old Town businesses, particularly restaurant traffic during the lunch hour. Bliss is a good operator and provides much -needed, high -quality dental services in La Quinta to its appreciative, loyal, and ever-growing clientele. Project Benefits • Fixes a Nagging Problem. Resolves a broken project languishing for five years on one of the most trafficked streets in the Coachella Valley. The unfortunate history and circumstances have resulted in aesthetic and potential property value impacts to the City at large ---and particularly neighboring commercial and residential uses. • Grows the City's Sales Tax Base. Expansion of a successful business will generate additional revenue for the City. 1 53 S011A 1 N V E 6 T M ENT 5 1 1411 CUP 2024-0004 & SDP 2024-0010 La Quinta Dental Center - 47705 Caleo Bay, La Quinta, CA Proposed Alternative Methods for Determining Parking Requirements 4/17/2025 • Benefits Old Town. May help ease parking conflicts with Old Town at peak periods, especially "in -season" Proposed Project Location: Former proposed California Desert Museum location at 47705 Caleo Bay, which stalled early in 2020 shortly after commencement of construction. Site Description: Currently in a degraded state with majority of foundation poured, some vertical structural steel, and limited exterior CMU walls. Site condition is disturbed with little to no finish grading or site improvements. A construction fence with a shade screen surrounds the perimeter. The site is subject to vandalism by graffiti. Project Vision: Dr. Kelsey's concept is to bring a "one -of -its -kind" practice to La Quinta, which provides comprehensive general -and -specialty dental care under one roof. To our knowledge, this does not currently exist in Coachella Valley. Proposed Modifications to Previously Approved Occupancy: (1) Interior Changes. The floor plan is being converted from museum to dental office occupancy. (2) West Elevation Modifications. The addition of exterior windows introduces more natural light and creates a better architectural aesthetic to the exterior facing Washington Street. (3) Change of Signage. The signage affixed to the exterior walls will be modified to reflect the change in use. This change will be processed under a separate sign permit. (4) Site. The site plan has been modified slightly to result in additional onsite parking, including electric cart spaces, and optimize the previously proposed underground flood retention storage system. Justification for Request Unique circumstances are applicable based on the museum project's design, and characteristics of the demand drivers for dental office parking: 1. Conversion of the Museum Design (change in code Occupancy). Museums are inherently designed to highlight the display of art, with grand volumes and generous spaces. The result is that spaces are oversized when converted to occupancy for other businesses. 7 54 S011A 1 N V E G T M ENT H INa CUP 2024-0004 & SDP 2024-0010 La Quinta Dental Center - 47705 Caleo Bay, La Quinta, CA Proposed Alternative Methods for Determining Parking Requirements 4/17/2025 2. Were the La Quinta Dental Center to be designed and constructed as a new building, space requirements and economics would dictate a more efficient building envelope of 9,000 — 10,000 square feet, 40-50% of the size of the Museum. Examples of areas that are oversized when applied to dental practice design include: a. Public areas for reception and waiting— repurposed Museum entry and greeting area. b. Circulation — Glorified hallways and corridors intended to function as art display spaces in addition to providing circulation between larger public spaces. c. Art Display Area Conversion. Spaces intended for art display are being divided into sub- spaces for dental treatment purposes. Efficiencies are lost over what would otherwise be planned in a new building design. d. Residual (the "leftover") areas become purposed for back -of -house functions like offices, employee breakrooms, utility, and storage rooms. 3. Parking Drivers of Dental Offices are Unique to Typical Commercial and Office Uses. Operating characteristics of dental practices are anomalous with respect to code interpretation. Parking areas for dental practices are more transient in nature than typical businesses. The average office visit duration is between 15-45 minutes. A patient occupying one parking space may be seen in more than one capacity in areas dedicated to specific types of care (e.g., hygienist, treatment, and/or operatory). Methods of Calculating Parking Requirements 1. COLQ Municipal Code. Based on square footages for `Dental Space' (11.171 SF) and `Office Space' (1,448 SF), parking required is sixty-one spaces. With reductions for shade structures, the revised total is fifty-one spaces. A total of forty-four spaces are proposed on -site. Alternative Methods. Two other approaches of calculating parking demand have been analyzed based on operating characteristics typical to dental practices, including the proposed facility. These are identified as "Method 1 " and "Method 2." a. Method 1: Parking demand based on average Suite occupancy and daily utilization rate. b. Method 2: Parking demand indicated based on average daily and hourly patient loads over hours of operation. Operating Characteristics of the Proposed La Quinta Dental Center • Office Hours: 9am-5pm (7 hours) • Staffing: Office staffing characteristics are as follows, for a total "Full -Time Equivalent" of fifteen staff members onsite during a 7-hour workday: o Doctors on staff (2) o Dental Assistants (4) o Hygienists (5) o Office Staff (4) • Organization and Functions: Three "Suites" (technical spaces where Practitioner -Patient services are provided). Each suite features discrete stations or rooms where specific dental functions are performed: ■ Hygienist (7) ■ Treatment (11) ■ Operatory (3) • Scheduling Interval: For regular office visits (excluding scheduled procedures/emergency appointments) 1 hour is allotted. Patients are scheduled on -the -hour because rooms must be sterilized after the patients depart. • Average Office Visit Duration: 15 to 45 minutes Asa result of the average office duration, the parking lot experiences frequent space turnover. Many patients will be seen in two rooms while parking a single car. For example, one room to see a Doctor, and another to see a hygienist. This results in the "Load Factor" in Method 1 being set at 1.5 persons per room. I am here to request that the Commission do its part to halt the construction of the Barrier Fence on the west side of the project and revisit the Specific Plan and associated Environmental Impact Report to account for the disturbance that the fence will cause for the natural environment and open space now enjoyed by generations of Coachella Valley residents and visitors. If La Quinta is the Gem of the desert, I'd like for our City to start planning to make Coral Mountain Regional Park the Gem of the Desert. The West Phase of the project as now conceived has not received due consideration of its impacts and alternatives at the project boundaries particularly on the west side where it borders designated natural open space zoning, and federally protected lands. We who now live adjacent to these lands have seen that activities have commenced with utilities and roads going in, flagging of the documented archeological and biological resources and staking of the proposed Fence. First the Final EIR that is referenced in the specific plan was not reconsidered after the addition of the Sheep Barrier Fence. Its location and construction were not considered in relation to the adjoining properties, current use, the hundreds of new neighbors that have been added to this part of La Quinta since the original projectwas conceived and reconceived over the past 28 years. The 8' fence was added to check a box with a solution that has been applied at the boundary with the Santa Rosa Mountains to the north in La Quinta with the notion of protecting Bighorn Sheep. The fences in other areas of La Quinta warranted a separate EIR and I challenge that this one should as well. The figures given in the Specific plan and description of the fence does not adequately describe how is expected to be effective, given the geomorphology of the area. The public, agencies, and surrounding landowners need to be given an honest opportunity to provide feedback on this element of the proposed project. I can offer a vision of interagency cooperation to continue to preserve these lands for the enjoyment and discovery of future generations. Topic: Specific Plan Specific Plan 03-067 Amendment 5-Halt the building of the proposed barrier fence- La Quinta Planning commission public comment 13 May Second, I'd like the City to consider that the adjoining lands to this property are designated a Coral Mountain Regional Park on maps. This is heartening as there are significant archaeological sites, human history as well as the shoreline marked by Coral that it is named for. This area was a shoreline a lake as recently as the 1700s. The history back in to prehistoric and geologic time is fascinating and of interest to so many of our citizens. This area is currently used daily for recreation of all types hiking, climbing, horseback riding, camping, OTV use. The free access to our natural spaces has been eroded all along the mountain front. The public --citizens old and those who have been attracted here by the desert open space --has not been adequately informed of this pending loss of access open space, cultural and natural resources. My intent is to continue to dig into the history of this project and find other residents, groups, and new neighbors, and old who have an interest in working with the developer, the City and other adjoining landholders to ensure that the future residents we are hoping to fill these homes will be connected. I am raising a child here and want him to experience and share the wonder that this desert has to offer. It's why we chose La Quinta. Outside developers have the resources to check the administrative boxes, but La Quinta has the obligation to truly consider the actions that are taken and how the proposed project will impact us as a community. Please stop the Barrier Fence indicated in Specific Plan 03-067. It is a small part of this project, but how this boundary with the Wilderness is implemented will impact us that remain for 40 years and beyond and set the stage for how the continued management of these designated open spaces connect us to our larger community and heritage.
