VOLUNTEER ORGANIZATION
SERVICE AGREEMENT
Our organization, the Senate Committee on Rules on behalf of the Office of Senator
Rosalicie Ochoa Bogh will provide volunteers to perform only the services as outlined in
the attached scope of work for the City of La Quinta ("City"). We understand that we will
not be compensated for our work, and we will complete our organization volunteer duties
in a responsible manner. If we decide to discontinue our organization's volunteer
services, our contact person Emily Davalos, will notify Luis Magallanez, City designee.
We understand and agree that:
• No one in the group is to appear for volunteer service under the influence of
any drugs or alcohol.
Our organization will provide the City with a roster of individual participants
including the names and hours worked.
• Our organization will report any injuries sustained by participants during their
volunteer activities to Luis Magallanez, City designee, immediately upon
occurrence.
• Our organization is responsible for directly supervising the activities of all the
individuals in our group who will be doing volunteer work, and therefore, in
consideration of our organization and members being permitted to perform
services on City property, consistent with Attachment A, our organization agrees
to defend, indemnify, and hold harmless the City and its officials, employees,
and agents from any damage claim or lawsuit for injury, illness, (including
exposure to communicable diseases, illnesses, or viruses), damage or other loss
of any kind to anyone including members of our organization that might arise out
of our activities or the actions of any individuals of our group, except for injuries
or damages caused by the sole negligence of the City.
• Insurance shall be governed by Attachment A.
• The City may terminate this agreement at any time without cause, and we agree
that we are volunteering our services at will and may be asked to discontinue
such without prior notice or reason.
This agreement will be in effect for the duration of our volunteer services or one year,
whichever is less, beginning on this date.

ATTACHMENT A
Liability and Indemnification
The State and the City of La Quinta are public entities under Government Code section
895.2. Pursuant to Government Code section 895.4, the State agrees, as between these
entities, to assume liability for bodily injury, death, or property damage arising from or
connected with use of the facility by the office of Senator Ochoa Bogh pursuant to this
agreement, except that the City of La Quinta assumes liability for bodily injury, death, or
property damage that is caused by its own sole negligence or willful misconduct. To this
end, each party shall indemnify and hold the other harmless from and against any
damage, demand, cause of action, loss, cost, expense, or liability arising from or
connected with any bodily injury, death, or property_ damage for which that party has
assumed liability. Each party waives subrogation. The provisions of Civil Code section
2778 are made a part hereof as if fully set forth.
Insurance Coverage
The State shall provide, and the City of La Quinta shall accept, a Letter of Self Insurance
in lieu of any insurance requirements under this Agreement. The City of La Quinta or any
other party shall not be named as additional insured therein.
Scope of Work
The Senate Committee on Rules on behalf of the Office of the Senator Rosalicie Ochoa
Bogh will utilize a meeting space located inside the La Quinta Wellness Center on every
V Wednesday of every month from 11:00 a.m. to 1:00 p.m. to allow for informational
office hours for the residents of La Quinta and Bermuda Dunes.
