In residential zones, mechanical equipment may be located within the setback area with a director's approval (La Quinta Municipal Code (LQMC) Section 9.60.070). This proposal is approved pursuant to the finding and conditions listed below. Finding: Approval of the mechanical equipment location will not create conditions materially detrimental to the public health, safety, and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. The proposed equipment generates noise that does not exceed 45 dB and it will maintain a 3-foot clearance from the nearest property line and there is a 6-foot block wall that separates the site from the neighboring property. Conditions: 1. The mechanical equipment shall provide a minimum 3-foot setback to the side property line. 2. The mechanical equipment shall have 30"x30" of clear working space for the servicing of the equipment per the California Mechanical Code §304.1 and any other required clearances per the manufacturer's installation.
