City of La Quinta 78-495 Calle Tampico La Quinta Ca 92253 RE: SilverRock Park Venue Mr. McKinney, In accordance with Section 6.3(6.3.1) & Section 6.4 (6.4.2 & 6.4.2 (a)) of the SilverRock Park Venue project #2016 project specifications this letter serves as notice of city delay and time extension request. The Contract Work of Urban Habitat (“Urban Habitat”) for the above indicated project has been delayed (the “Delay”) by the acts of parties other than Urban Habitat, and specifically the City of La Quinta (“City”). In particular, Urban Habitat cannot complete its contract work because work of other contractors and/or the City Furnished Materials that is required to be completed before the Contract Work can continue is not yet complete. The incomplete work is along the critical path of the Contract Work and we understand the expected delay to be several weeks or longer. • Fireline Meter • Domestic Meter • Park Venue Power Supply • Restroom Building • Storm Drain Head Wall Design As a result of such Delay, Urban Habitat has incurred additional costs and must also receive a modification of the time to complete the Contract Work (the “Time Extension Request”). The date the Delay by City commenced was December 9, 2019 and remains ongoing. Please consider this Notice and the Time Extension Request a notice that a Request for Change as to the schedule for the Contract Work will be submitted, and the exact duration of the schedule change will be confirmed when the length of the Delay is determined. In addition, Urban Habitat is entitled to receive damages or other compensation for the extra expense incurred due to the Delay. These expenses include but are not limited to increased costs for mobilization, equipment rental and scheduling problems for its personnel and/or subcontractors due to the existence of other scheduled projects or jobs (the “Delay Costs”). The Delay Costs are not yet quantified, but Urban Habitat will submit a Payment Request to City for such Delay Costs when they are quantified. Urban Habitat P.O. Box 1177 La Quinta Ca 92247 Urban Habitat has been keeping the City up to date on the issues relating to this Delay, but is required to provide this Notice to ensure that its rights are protected and to ensure that no waiver of any such rights is intended or agreed upon. Urban Habitat will reasonably do everything it can to minimize the Delay Costs and the length of the Time Extension Request. If Urban Habitat can be of specific help in contributing to a resolution of the problems causing the Delay, and helping the Project to get back on track, please contact us.
