RESOLUTION NO. 85-82
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, AMENDING THE LAND USE
ELEMENT OF THE LA QUINTA GENERAL PLAN FOR GENERAL
PLAN AMENDMENT NO. 85-006.
WHEREAS, the Planning Commission has recommended approval of General
Plan Amendment No. 85-006 pursuant to Section 63350 et seq. of the
California Planning and Zoning Law and has transmitted the same to this
City Council in compliance with Section 65354 of said Law; and
WHEREAS, the City Council has held at least one public hearing on
General Plan Amendment No. 85-006, as required by Section 65355 of the
California Planning and Zoning Law; and
WHEREAS, approval of the requested land use designation for General
Commercial is not consistent with goals and policies set forth in the
Community Development Element of the new La Quinta General Plan which
supports development of existing commercial areas as a first priority; and
WHEREAS, approval of Special Commercial, which accommodates tourist
and recreation needs now while deferring retail and office development
along the Jefferson Street corridor to support existing retail and office
areas as a first priority, is both desirable and appropriate; and
T*,*EREAS, the requested residential and open space designations are
consistent with goals and policies set forth in the Community Development
Element of the new La Quinta General Plan; and
WHEREAS, the proposed project will be consistent with adopted and
proposed specific plans when the Duna La Quinta Specific Plan is amended
and with the imposition of appropriate conditions for the Oak Tree West
Specific Plan; and
WHEREAS, approval of this request will not result in significant
impact on the environment, except as noted for overriding considerations
related to the conversion of agricultural land to urban use, since the
Applicant has agreed to mitigation measures and made changes in the
project to reduce its impact to a level of significance.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
La Quinta does hereby amend the La Quinta General Plan Land Use Element
from Very Low Density Residential 3 or less dwellings per acre) to Low
Density Residential 2-4 dwellings per acre), Open Space and Special
Commercial for certain property shown and depicted for such change on
the map which is attached to and made a part of this Resolution, and
which attached map is labelled Exhibit 1, General Plan Amendment
No. 85-006".

CONDITIONS OF APPROVAL
DECEMBER 3, 1985
1. Said portions of the public street right-of-way ordered vacated
and abandoned are those porti6ns of Eisenhower Drive as shown on
revised Exhibit A", dated November 26, 1985, and as amended by
the following conditions, which conditions shall take precedence
in the event of any conflicts with the provisions of the street
vacation plan.
2. The Applicant shall comply with all conditions of approval for
Plot Plan No. 85-186.
3. That portion of Eisenhower Drive right-of-way approved for vaca-
tion shall be amended in accordance with revised Exhibit A",
dated November 26, 1985.
4. Eisenhower Drive shall comply with the following standards:
a. From Avenida Fernando South) to San Lucas Street, provide
a minimum 79-foot-wide right-of-way with a minimum 73-foot,
curb-to-curb distance to allow for construction of four 4)
travel lanes, an 11-foot-wide, center median, and a 55-foot-
wide parkway area along the southeasterly side of Eisenhower
Drive. Travel lane widths shall be in accordance with
Exhibit A", dated November 26, 1985.
b. From San Isidro Street to San Vicente Street, provide a
minimum 67-foot-wide right-of-way with a minimum 62-foot
curb-to-curb distance to allow for construction of four 4)
travel lanes, an 11-foot-wide, center median, and a 5-foot-
wide parkway along the southeasterly side of Eisenhower
Drive. Travel lane widths shall be in accordance with
Exhibit A", dated November 26, 1985.
c. The Applicant shall provide additional right-of-way to
construct transition improvements as needed in the areas
between the existing and modified public street alignments.
5. The Applicant shall agree to participate in the construction of a
center median through assessment district or similar joint funding
method, including a reimbursement district, unless the medians are
constructed or guaranteed as a part of this project.
6. In the event the City Council, following public hearings, so
requires, the Homeowners Association shall pay for the cost of
right-of-way acquisition and an equitable share of improvement
costs for the installation of a sidewalk along the northwesterly
side of Eisenhower Drive. The Homeowners Association shall agree
to acknowledge and accept this responsibility and shall bone or
otherwise guarantee for these acquisition and improvement costs
for a maximum of $100,000, and for a period not to exceed ten 10)
years. In the form of a deed restriction, the Homeowners

Association shall agree that it has the power and will assess the
costs of the improvements to the Homeowners Association. The
City shall give the Homeowners Association a minimum sixty 60)
day notice of the proposed hearing on this matter.
7. The Applicant shall submit engineered street improvement plans
for Eisenhower Drive, as amended by the requirements of this
approval and that for Plot Plan No. 85-186, to the City Engineer
for review and approval.
a. The plans shall be prepared by a Registered Civil Engineer
and a Registered Traffic Engineer.
b. The plans shall indicate all traffic control devices includ-
ing, but not limited to street striping and traffic signage.

BE IT FURTHER RESOLVED that the City Clerk shall endorse on said
General Plan Amendment No. 85-006 the date of its adoption by the City
Council and the date of its approval by the Planning Commission.
