A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LA QUINTA, CALIFORNIA, FINDING THAT
THE PROPOSED STREET VACATION OF A 386-
SQUARE-FOOT PORTION IN THE NORTHWEST
CORNER OF AVENIDA VILLA AND ALLEY RIGHT-OF-
WAY IS CONSISTENT WITH THE GENERAL PLAN

APPLICANT/OWNER: CITY OF LA QUINTA
WHEREAS, the Planning Commission of the City of La Quinta, California, did, on
October 14, 2025, consider the request for street right-of-way vacation of a 386-square-
foot portion of the northwest corner of Avenida Villa and Alley by the applicant identified
above; and
WHEREAS, the proposed vacation is exempt under Section 15301 (c) – Class 1
of the California Environmental Quality Act (CEQA) Guidelines, in that the vacation of
the subject right-of-way will not result in a direct or reasonably foreseeable indirect
physical change in the environment; and
WHEREAS, street vacation proceedings may be initiated by the City Council or
may act on a petition or request of an interested person, pursuant to Chapter 3, Part 3,
Division 9 of the Streets and Highways Code; and
WHEREAS, California Government Code (CGC) Section 65402 requires that
prior to streets being vacated by the City Council, the Planning Commission make a
finding that the proposed right-of-way vacation is consistent with the City’s General
Plan; and,
WHEREAS, said Planning Commission did make the following Findings
confirming that the proposed street right-of-way vacation is consistent with the City’s
General Plan:
1. The proposed right-of-way vacation will have no environmental effects that
adversely impact the human population, either directly or indirectly, because
the street segment is currently unused by the public and inaccessible to
vehicles; and secondly, the act of vacating the right-of-way will have no
physical environmental effect.
2. The right-of-way vacation will not impact public utility agencies, as easements
are retained for the continued maintenance and operation of existing public
utilities. No utility agency has objected to the street vacation proposal.

3. The portion of Avenida Villa and Alley proposed for street vacation is no
longer needed for public street purposes.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of La Quinta, California, as follows:
SECTION 1. That the above recitations are true and constitute the Findings of the
Planning Commission in this case.
SECTION 2. That it does find the proposed right-of-way vacation LAD2025-0002, as
shown on Exhibits A and B, is consistent with the City's General Plan for the reasons
set forth in this Resolution.
PASSED, APPROVED, and ADOPTED at a regular meeting of the City of La
Quinta Planning Commission, held on October 14, 2025, by the following vote:
AYES: Commissioners Bohlinger, Guerrero, Hernandez, Hundt, McCune,
Nieto, and Chairperson Hassett
