DD 2025-0005 Mechanical Pool Equipment - 56415 Jack Nicklaus Blvd (11.12.2025) November 12, 2025 Rene Leon 83949 Hopi Ave. Indio, CA 92201 SUBJECT: DIRECTOR’S DETERMINATION 2025-0005 FOR ENCROACHMENT OF MECHANICAL POOL EQUIPMENT AT 56415 JACK NICKLAUS BLVD. Dear Mr. Leon: The Design and Development Department has reviewed your proposal to locate mechanical swimming pool equipment within the side yard setback located at 56415 Jack Nicklaus Blvd. In residential zones, pool equipment may be located within the setback area with a Director’s approval (La Quinta Municipal Code (LQMC) Section 9.60.070(d)). This proposal is for the replacement of an existing pump and is approved pursuant to the finding and conditions listed below. Finding: Approval of the mechanical equipment location will not create conditions materially detrimental to the public health, safety, and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. The equipment operates at a sound level of 46 dBA measured at 1 meter which equates to approximately 3.3 feet, and within the permitted noise limits established under Section 9.100.210 – Noise Control of the La Quinta Municipal Code (LQMC). A minimum setback of four (4) feet will be maintained between the equipment and the neighboring property line. Conditions: 1. The mechanical equipment must maintain a minimum three (3) foot clearance of any permanent obstructions. 2. The applicant shall obtain a building permit for the relocation and changeout of equipment. The pool equipment shall comply with all applicable building codes adopted by the City of La Quinta. NXT Gen Pools applied for and received a permit to remove the existing spa/waterfall on this property and add a new pool and spa. The pool/spa equipment was existing and is located in the South side yard approximately 4’ from the property line. The existing pool equipment has remained in place and only the filter pump has been replaced. NXT Gen Pools replaced the existing (noisy) filter pump with a new Hayward TriStar Variable Speed pump which is significantly quieter (46db, see attached specs). All inspections are completed and the pool project is 100% complete. This is the only remaining item before receiving Final sign off. We are requesting a variance based on the fact that the pool equipment is existing and has been in this location for many years. The only change is that we replaced the noisy pump with a quiet one.
