Dear John Vuksic:
The Design and Development Department has reviewed your request to make modifications to
the site plan for the Tradition Golf Club located at 78505 Old Avenue 52. The plan modifications
are minor and will comply with the spirit and intent of Site Development Permit 1996-0599. The
project will result in the construction of an addition to an existing security building. The
modifications are approved as shown on the attached exhibit, subject to the following conditions
of approval:
1. The applicant agrees to defend, indemnify, and hold harmless the City of La Quinta
("City"), its agents, officers and employees from any claim, action or proceeding to attack,
set aside, void, or annul the approval of this Modification By Applicant. The City shall have
sole discretion in selecting its defense counsel.
The City shall promptly notify the applicant of any claim, action or proceeding and shall
cooperate fully in the defense.
2. The applicant shall conform to all other corresponding conditions of approval for Site
Development Permit (SDP) 1996-0599.
3. Plans shall be prepared to the applicable code at the time of submittal for building permit.
Currently these are the 2022 California Building Codes, as of January 1, 2026, it will be
the 2025 California Building Codes.
4. The original plans on file in the city archives show this building as being accessible for
persons with disabilities, with an accessible restroom and accessible route to the
entrance. The removal of the accessible route at the rear of the existing building, where
the office addition is proposed, would bring the building out of compliance with code
requirements. Additionally, the code generally prohibits an alteration that decreases or
has the effect of decreasing the accessibility of a building or facility, which occur in this
case. (CBC §11 B-202.3.1)

• In order for the city to not apply accessibility requirements to this building, it would
need to be demonstrated that this building is not applicable to 11 B / ADA. It is
recommended to consult Tradition Golf Club's legal team on whether that
determination can be made.
5. When alterations or additions are made to existing buildings or facilities, an accessible
path of travel to the specific area of alteration or addition shall be provided. (CBC §11 B-
202.4) This would include providing accessible features and/or upgrading deficiencies to
the accessible route which provides access to the building. Particularly with an exterior
approach (including sidewalks, streets, and parking areas), it would require providing
accessible parking at spaces nearest the entrance and creating an accessible route from
those spaces to the entrance of the area of alteration. For project valuations exceeding
the current valuation threshold of $203,611.00, no limitation on cost would be applicable.
For valuations below at least 20% of the adjusted construction cost would be required for
these improvements.
6. All proposed ground mounted equipment shall be screened from view. Such screening
may consist of screen walls, or landscape planting.
7. Parking shall be provided as required by La Quinta Municipal Code Section 9.150.070.
8. All outdoor lighting shall comply with the La Quinta Municipal Code Section 9.100.150.
9. The applicant shall apply for and obtain all necessary building permits and grading
permits as required.
