Also updated Exhibits A and B with the clearer PDFs previously provided when discussing with Oscar the insurance requirements — the email chain correspondence to this effect has been added to this email chain for continuity as well. The final clean Word doc is attached; and also converted to PDF with updated clean exhibits, as mentioned above — you may send that to the vendor for signature. 2 When submitting the signed agreement back to the Clerk's Office to be executed, please include the attached agreement cover memo completely filled out as well. Quick question — although the agreement is under $50K and within Jon's signing authority — it does require 3 bids. Just want to make sure this is compliant with the City's procurement requirements per the Purchasing Policy; or will this be select sourced, and if so, under what justification? Please let us know. Please take a look and let me know if you have any questions. One of the changes I made was updating the agreement termination date from February 6, 2026, to February 28, 2026. This adjustment was made to allow for buffer time incase the contracted work has to be pushed back for any reason. That said, if you wanted to build in some additional contingency, you could extend the expiration of the agreement to 6/30/2026. 3 Also, would it be possible to get a better image for the cost breakdown you included with Exhibit B? The current image is difficult to read. I hope you had an enjoyable weekend. When evaluating insurance limits, we recommend that members conduct a risk analysis tailored to the specific scope of work. In this case, the analysis could begin with a review of the contractor's proposed work plan to verify that no portion of the operation will impact the roadway. In addition, we suggest assessing a range of potential hazards and risk exposures associated with sidewalk grinding services. A summary of these considerations is provided below for your reference. Please note that this summary is not intended to be all- inclusive; other relevant factors may arise during the risk analysis process, depending on the specific circumstances of the project. The findings from this analysis should help inform a supported determination of the appropriate insurance limits for the project. We hope this is helpful. Please do not hesitate to contact us if you have any questions or wish to discuss further. Thank you, 6 Toni Public Safety Risks • Trip and fall hazards during grinding operations • Pedestrian rerouting or obstruction, especially in high foot traffic areas • Flying debris from grinding equipment that could injure passersby Property Damage • Damage to adjacent property (e.g., landscaping, fences, storefronts) • Damage to public infrastructure (e.g., utility covers, signage, benches) • Surface damage beyond the intended grinding area Environmental Exposures • Airborne dust and noise pollution • Improper disposal of grinding debris • Potential runoff into storm drains Equipment and Vehicle Use • If vehicles or trailers are used for transporting equipment, even if parked off -road, there's potential for: o Minor traffic disruptions o Vehicle -related accidents or claims Contractual and Legal Liability • Claims arising from failure to meet ADA compliance or local accessibility standards • Breach of contract or negligence claims if work is not performed to specification Insurance Considerations Given these exposures, the Agency should evaluate: • General Liability (GL): To cover bodily injury and property damage to third parties • Automobile Liability (AL): If vehicles are used, even if not directly impacting roadways • Workers' Compensation: Mandatory for employee injury coverage • Pollution Liability: If dust or debris poses environmental risks 1ORNIA Toni Consolo, ARM Senior Risk Manager California Joint Powers Insurance Authority 8081 Moody Street, La Palma, CA 90623 t 562.455.5024 tconsolo@cjpia.org cjpia.org 000 From: Oscar Mojica <omoiica@laquintaca.gov> Sent: Friday, October 3, 2025 8:59 AM To: Toni Consolo <tconsolo@cipia.org>; Abraham Han <ahan@cjpia.org> Cc: Oscar Mojica <omoiica@laquintaca.gov> Subject: Insurance Requirements Good morning Toni and Abe, The City is looking to contract for sidewalk grinding services to remove trip hazards. This work doesn't seem to fit any category really well. My contractor will be staying on the sidewalk, driving a small warehouse utility cart, performing sidewalk trip hazard grinds. He will not need traffic control and will not be driving on the roadways except to tow his cart. He will be in a Ford 150 and a small trailer. Does this type of work still require 5 million auto and 5 million general? Thank you!
