TUP 2025-0005 Christmas Tree Lot - Home Depot (11.25.2025) November 25, 2025 Jeremy Boyle Home Depot 79900 Highway 111 La Quinta, CA 92253 SUBJECT: TEMPORARY USE PERMIT 2025-0005 HOME DEPOT CHRISTMAS TREE LOT Dear Mr. Boyle, The Design and Development Department has reviewed and approved your request to establish a temporary Christmas tree sales lot located within the Home Depot parking lot. The approval of the sales lot is granted under Section 9.100.080 of the La Quinta Municipal Code subject to the Conditions of Approval listed below: 1. By holding this Christmas tree sale, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City’s approval of this project. The City of La Quinta shall have the r ight to select its defense counsel at its sole discretion 2. The Christmas tree sales lot may be open on the following dates: November 28, 2025 – December 31, 2025; Monday through Sunday, between the hours of 8:00 a.m. and 8:00 p.m. BUILDING DIVISION 3. Prior to opening/consumer occupancy a special inspection shall be requested and only after approvals have been obtained from all applicable divisions shall the space be utilized. 4. Information has not been provided for the proposed partition/corral construction. If after the special inspection it is determined that a permit for construction is required, the applicant shall submit to the Building Division for review and approval prior to occupancy. 5. Means of egress shall be maintained within the requirements of the California Building Code as applicable, this would include door hardware, width and swing, access to exits based on occupant load, and egress lighting. 6. Temporary Electrical Installations require review and approval, current plans do not have information to determine if applicable. Examples of temporary installations would be generator use, or setup of any transformers, subpanels or receptacle branch circuits, but would not necessarily include cord and plug lighting. In the event this work proposed, applicant shall resubmit to the Building Division for review and approval. 7. Any building, structure, facility, complex or improved area, or portions thereof, which are used by the general public shall be provided barrier free design to ensure that these improvements are accessible to and usable by persons with disabilities. FIRE MARSHAL 8. Fire lanes and fire hydrants shall be maintained accessible and unobstructed. 9. According to the application, there is no canopy or tent to be erected. If the plan changes and a tent or canopy greater than 400 square feet is desired, a permit from the Office of the Fire Marshal is required before erecting the tent or canopy. PLANNING DIVISION 10. The location of the sale is limited to the Home Depot parking lot per the attached site plan. Traffic aisles shall not be blocked. 11. The facility shall not engage in the sale of any merchandise not directly associated with Christmas trees or decorations. 12. All aisles between the grouping of trees must be maintained at a minimum of 36- inches in width. 13. All waste, trimmings, and dried trees must be removed from the site daily or placed in an approved waste container. 14. A temporary fence surrounding the Christmas tree lot is permitted. The proposed fence shall be constructed of chain link fencing material and shall not exceed a height of six (6) feet. No other temporary structures are proposed or permitted as part of this permit. 15. Temporary lighting shall not be directed towards surrounding properties. All temporary lighting shall conform to the City’s Outdoor Lighting Ordinance; Section 9.100.150 of the City’s Municipal Code. 16. If portable generators are used for electricity (also see Condition 6, above), they shall be shielded to prevent accidental contact with guests. If extension cords are used, they shall be ground-secured to prevent tripping. Power equipment (i.e. chain saws, etc.) shall not be operated before 7:00 a.m. 17. Smoking shall not be permitted in any part of the event area. 18. Displays, decorations or other objects shall not be placed to obstruct exits, access thereto, or egress therefrom or visibility thereof. Hangings and draperies shall not be placed over exit doors or otherwise be located to conceal or obstruct an exit. 19. Roadways, parking areas, and pedestrian traffic aisles outside the proposed area shall be always maintained accessible. 20. Signs shall be restricted to one (1) banner sign per street frontage, each sign not exceeding thirty-two square feet. Banners may be placed on the temporary fence or adjacent within the parking area, but not on Highway 111. Other signs and advertising devices such as pennants, flags, A-frame signs, are prohibited. 21. All trees sold for commercial use to businesses, schools, churches, or health care facilities shall be flame retardant and bear a tag with the information of when it was treated and what material was used during the treatment in accordance with the California State Fire Marshal’s Office. Flocking for these uses shall be done with non - flammable materials. 22. Adequate trash receptacles shall be provided. 23. A security guard is permitted on-site if needed during the operations of the Christmas tree sales lot. Security personnel shall be easily identifiable to the public by the provision of uniformed personnel. All designated private security personnel must be licensed by the State of California and possess a valid private security license. No overnight camping, either in tents or vehicles, is permitted as part of this permit. Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding properties and businesses will be minimized. Once the tre lot is built we will be Selling, cutting, and loading christmas trees into vehicles for Home Depot customers. 4. The event will run until 11/20/25 to 12/31/25. 5. After event date the lot will be taken down.
