The plan modifications are minor and will comply with the spirit and intent of Site Development Permit (SDP) 2024-0004 pursuant to Section 9.200.090 of the La Quinta Municipal Code. The proposed parking lot and landscape area reconfiguration does not substantially change the appearance of the site from that of the original approval. The relocation of the trash enclosure, underground fuel storage tank, and fueling canopy are all minor in character and will not alter the intent or appearance of the original plans. The modifications as shown on the attached exhibits are approved, subject to the following conditions of approval: 1. The applicant agrees to defend, indemnify, and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Modification By Applicant. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense. 2. The applicant shall conform to all other corresponding conditions of approval for SDP 2024-0004 and Conditional Use Permit (CUP) 2024-0003. 3. New signage shall require separate permits. All signage shall comply with La Quinta Municipal Code Chapter 9.160 — Signs. 4. The applicant shall inform the City of La Quinta's Planning Division of any subsequent changes. Additional modifications may require subsequent review and may result in additional condition(s) of approval. 5. The applicant shall apply for and obtain all necessary building permits (BCOM2025-0064) and grading permits as required. Dumpsters and containers with an individual capacity of 1.5 cubic yards or more shall not be stored or placed within 5 feet of combustible walls, openings or combustible roof eave lines. 7. Prior to building permit issuance, the Office of the Fire Marshal shall review the fuel canopy construction plan and building construction plan. Additional fire and life safety conditions may be determined during this review. 8. Installation and modification to a fuel dispensing operation will require a permit from the Office of the Fire Marshal. Additional conditions may be determined during this review. Underground work will require a permit from the Riverside County Environmental Health Department — Hazardous Materials Division.
