In accordance with City Council Resolution No. 2022-028, a one-time additional speaker
time donation of three (3) minutes per individual is permitted; please note that the member
of the public donating time must: 1) submit this in writing to the Commission Secretary by
completing a "Request to Speak" form noting the name of the person to whom time is being
donated to, and 2) be present at the time the speaker provides verbal comments.
Members of the public who utilize a translator shall be provided at least twice the allotted
time to ensure non-English speakers receive the same opportunity to directly address the
Commission.
Verbal public comments are defined as comments provided in the speakers' own voice and
may not include video or sound recordings of the speaker or of other individuals or entities,

RECOMMENDATION
Adopt a resolution approving Conditional Use Permit 2026-0001 and find the project
exempt from the California Environmental Quality Act (CEQA), pursuant to Section
15301(a), Existing Facilities (Attachment 1).
EXECUTIVE SUMMARY
• Altus Schools Riverside County (Altus Schools) operates an independent study model
of instruction and offers a course of studies that allows students to recover lost credits
to graduate from high school.
• Altus Schools requests approval of a Conditional Use Permit (CUP) to operate a
charter high school resource center for students in the La Quinta area at the One
Eleven La Quinta Shopping Center (Attachments 2 and 3).
• Findings related to consistency with General Plan, Zoning, CEQA, and surrounding
uses are required to be made by the Planning Commission.
BACKGROUND/ANALYSIS
The City received the application for the Conditional Use Permit on March 9, 2026, and
deemed the application complete on April 22, 2026. At the time that the application was
deemed complete, the site was zoned Regional Commercial (CR) and it was located within
the One Eleven La Quinta Specific Plan (SP) 1989-014. The Highway 111 Specific Plan
and Development Code was adopted on April 21, 2026 and became effective on May 22,
2026. Since the application was deemed complete prior to the effective date of the new
codes, the older codes apply to the application and are reflected in this report.

Altus Schools operates under an independent study model of instruction and offers a
course of studies that allows students to recover lost credits and graduate from high school
and is authorized to operate charter schools within Riverside County. Altus Schools is not
affiliated with either the Desert Sands Unified School District or the Coachella Valley
Unified School District, whose district boundaries both fall within the City of La Quinta.
The resource center in La Quinta will be located within a 5,011 square -foot tenant space at
the One Eleven La Quinta Shopping Center, at 78900 Highway 111. It will operate as a
drop -in center, allowing students and parents to meet with high school officials for tutoring,
counseling, and administrative support. No instruction or classes will be conducted at the
La Quinta resource center. Student meetings will be by appointment only and held during
daytime hours from 8:00 a.m. to 5:00 p.m., Monday through Friday. The statement of
operations is included as Attachment 4 to this report.
The One Eleven La Quinta Shopping Center is comprised of approximately 600,000 square
feet over a 60-acre site. Altus Schools is not proposing any exterior modifications to the
building. Interior tenant improvements (Attachment 5) would finish the interior space for the
high school resource center and are in building plan check at this time. Adjacent uses to
the tenant space include a housewares general store and a sporting goods store.
Sufficient on -site parking exists for the proposed use. A parking evaluation was prepared
by the applicant and is included on the site plan in Attachment 5. It identifies 76 parking
spaces on the subject parcel with the resource center and adjoining retail uses collectively
requiring a total of 70 parking spaces. A reciprocal access and parking agreement has
been recorded and includes the subject property along with the adjoining parcels.
Approval Process
Section 9.210.020 of the La Quinta Zoning Code outlines the process and requirements for
conditional use permit applications. Subsection "F" of this Section specifies four criteria
must be met to approve a conditional use permit application. Staff has evaluated the
subject application and prepared findings supporting approval of the request for Planning
Commission consideration in the attached draft resolution (Attachment 1). The
Commission's decision is final unless appealed, pursuant to subsection "G".
AGENCY AND PUBLIC REVIEW
Public Agency Review
This request was sent to all applicable City departments. All applicable comments have
been adequately addressed and/or incorporated in the recommended Conditions of
Approval.
Public Notice
The public hearing notice was published in The Desert Sun newspaper on May 29, 2026,
and was sent to property owners and occupants within a 500-foot radius of the project site.
As of this writing, no comments have been received.
ENVIRONMENTAL REVIEW
The Design and Development Department has determined that this project is exempt from
environmental review pursuant to Section 15301(a) of the CEQA Guidelines. The project
qualifies for the Class 1 (Existing Facilities) Exemption, as it consists of minor interior
alterations of an existing building involving negligible or no expansion of an existing or
former use.

WHEREAS, the Planning Commission of the City of La Quinta, California, on June
9, 2026, considered a request submitted by MPA Architects to allow the operation of a
high school resource center for students of Altus Schools Riverside County on an
approximate 1.9 acre parcel located within the One Eleven La Quinta Shopping Center,
more particularly described as:
APN: 643-080-003; and
WHEREAS, the Design and Development Department published a public hearing
notice in The Desert Sun newspaper on May 29, 2026, as prescribed by the Municipal
Code. Public hearing notices were also mailed to all property owners within 500 feet of
the site and emailed or mailed to all interested parties who have requested notification
relating to the project; and
WHEREAS, upon hearing and considering all testimony and arguments, if any, of
all interested persons desiring to be heard, said Planning Commission did make the
following mandatory findings pursuant to Section 9.210.020 of the La Quinta Municipal
Code to justify approval of said Conditional Use Permit:
1. The project is consistent with the general plan.
Finding of Fact: The proposed use, a high school resource center, is consistent
with the General Plan land use designation of General Commercial (CG) which
allows for a full range of commercial and professional service businesses. The
proposed high school resource center fulfills the intent of the CG designation as it
provides an alternative high school education resource for nearby residents,
increasing the number of options for local high school students to access
educational opportunities.

2. The project is consistent with the zoning code.
Finding of Fact. The proposed use is consistent with the Regional Commercial
zoning designation of the site and Specific Plan 1989-014 which both encourage
a broad range of goods and services for the entire region. The high school
resource center will provide access to students in adjoining areas and is located
at a convenient location for regional access along Highway 111.
3. Processing and approval of the permit application are in compliance with the
requirements of the California Environmental Quality Act
Finding of Fact. The Conditional Use Permit is exempt from the California
Environmental Quality Act (CEQA) per Section 15301(a) as it consists of minor
alterations of an existing building involving negligible or no expansion of an existing
or former use. The high school resource center will operate within an existing
building and is not proposing any additions or other exterior modifications to the
building.
4. Approval of the application will not create conditions materially detrimental to the
public health, safety and general welfare or injurious to or incompatible with other
properties or land uses in the vicinity.
Finding of Fact. Approval of the application will not create conditions materially

incompatible with other properties or land uses in the vicinity. The proposed use
of a high school resource center is consistent with other nearby uses, including
general retail and restaurant tenants.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of La Quinta, California, as follows:
SECTION 1. That the above recitations are true and constitute the Findings of the
Planning Commission in this case.
SECTION 2. That the Planning Commission finds the above project is exempt from
environmental review pursuant to Section 15301(a) of the CEQA Guidelines, as it consists

GENERAL
The applicant agrees to defend, indemnify, and hold harmless the City of La Quinta
("City"), its agents, officers, and employees from any claim, action, or proceeding to
attack, set aside, void, or annul the approval of this Conditional Use Permit. The City
shall have sole discretion in selecting its defense counsel.
The City shall promptly notify the applicant of any claim, action, or proceeding and
shall cooperate fully in the defense.
2. This Conditional Use Permit shall comply with the requirements and standards of
Section 9.210.020 of the La Quinta Municipal Code ("LQMC").
The City of La Quinta's Municipal Code can be accessed on the City's website at
www.laquintaca.gov.
3. This Conditional Use Permit shall expire twenty-four (24) months after approval and
shall become null and void in accordance with Municipal Code Section 9.200.080
unless the use has been established. A time extension may be requested per LQMC
Section 9.200.080.
4. Any expansion or substantial modifications to the approved plan shall require an
amendment to this Conditional Use Permit. Minor modifications to this Conditional
Use Permit shall be considered by the Design and Development Director and may
require notification of surrounding property owners prior to such approval. All other
amendments shall be processed in accordance with LQMC 9.200.080.
5. Prior to the issuance of any grading, construction, or building permit by the City, the
applicant shall obtain any necessary clearances and/or permits from the following
agencies, if required:
• Riverside County Fire Marshal
• La Quinta Public Works Department (Grading Permit, Green Sheet (Public
Works Development Clearance) for Building Permits, Water Quality
Management Plan (WQMP) Exemption Form — Whitewater River Region,

The applicant is responsible for all requirements for the permits and/or clearances
from the above -listed agencies. When the requirements include approval of
improvement plans, the applicant shall furnish proof of such approvals when
submitting those improvement plans for City approval.
BUILDING
6. A building permit is required for all tenant improvements.
A. Plans shall be prepared for the applicable code at the time of building permit
submittal. As of January 1, 2026, these are the 2025 California Building
Codes.
B. Commercial projects are required to be prepared by a Licensed Architect or
Engineer. On each sheet of construction documents, provide the preparer's
name and telephone number, electronic signature, and his/her stamp as
prescribed by California Business and Professions Code Section 5536.
C. Proposed facility is a Place of Public Accommodation and is required to be
accessible to persons with disabilities in accordance with Chapter 11 B of the
California Building Code, and other relevant State and Federal Laws. Plans
shall be prepared to demonstrate compliance as applicable.
PLANNING
7. The High School Resource Center shall comply with the Statement of Operations on
file with the City of La Quinta, including the operating hours, the types of activities
conducted at the facility, and the maximum number of employees. The City of La
Quinta reserves the right to review and monitor the operation of this facility and
modify conditions of approval regarding hours of operation, occupancy, and other
operational conditions.
8. All activities shall be conducted indoors.

9. The tenant space shall be improved, consistent with the tenant improvements
identified in the building permit. No outdoor modifications to the tenant space are
permitted.
10. Students shall not be allowed to loiter before or after scheduled appointments.
FIRE
11. A manual and automatic fire alarm system that initiates the occupant notification
signal utilizing an emergency voice/alarm communication system shall be installed
in Group E occupancies with an occupant load of 50 or more persons.
12. A copy of the emergency plan shall be provided to the Office of the Fire Marshal.
The plan shall include procedures to be followed in case of fire or other emergency:
• Assignment of a responsible person to call the fire department upon
notification of any fire or activation of the alarm system for any reason other
than fire drills.
• Posting in a conspicuous place in the Resource Area showing paths of travel
to evacuate the room in case of emergency and including an alternate route.
• Instructions to be followed by the teacher, including maintaining order during
evacuation, removal of the roll call book, and calling of roll when designated
evacuation is reached.
• Outdoor assembly areas shall be designated and located at a safe distance
from the building, evacuated so as to avoid interference with fire department
operations.
13. The La Quinta Office of the Fire Marshal shall review building plans for any remodel
of the existing building or any proposed change of use or occupancy classification.
Additional conditions of approval may be applicable and will be determined after the
Fire Department reviews the building plan.

1. Description of Proposed Use
Altus Schools Southern California ("ASSC"), a nonprofit public benefit corporation, oversees and
manages Altus Schools Riverside County ("Altus Schools"), a public charter school operating a
flex -based independent study educational program. The site is located at One Eleven La
Quinta Center located at 78900 CA-111, La Quinta, CA 92253, serves as the La Quinta Resource
Center ("Resource Center").
The La Quinta Resource Center functions as an instructional and administrative support facility
for students enrolled in Altus Schools. The Resource Center is designed to provide
individualized, appointment -based educational support services, student assessment,
counseling and administrative functions.
The facility does not operate as a traditional classroom campus. There is no full -classroom or
bell -schedule instruction at the Resource Center. Student services are limited to one-on-one or
small -group academic support, assessments, counseling, and student/parent meetings
conducted by appointments. No direct instruction occurs at the Resource Center.
The proposed use is consistent with an institutional/office-type educational support facility
and does not include residential use, overnight activities, or large assemblies.
2. Hours of Operation
Student and Public Access
• Students attend the Resource Center by appointment only, with appointments
staggered throughout the day
• Monday through Friday, 8:00 a.m. to 5:00 p.m.
• Staff and Administrative Operations:
Monday through Friday, 7:30 a.m. to 5:30 p.m.

Occasional evening meetings (e.g., parent conferences or staff training) may occur on a limited
basis. Weekend operations are not anticipated.
3. Number of Employees
• Approximately 6 to 7 employees on site during normal operating hours
• Staff include administrative personnel, credentialed teachers, instructional support staff,
and counselors
• Student visits are scheduled by appointment, resulting in limited daily occupancy
4. Licenses, Permits, and Approvals Required
Altus Schools operates under the following authorizations and approvals:
• Public charter school authorization pursuant to California Education Code
• Oversight by the applicable charter authorizing agency
• Compliance with California Department of Education (CDE) requirements
• City of La Quinta Conditional Use Permit approval
• Applicable City of La Quinta building, fire, and occupancy permits
• Business license, if required by the City of La Quinta
No additional local, state, or federal licenses are required for this use.
5. Equipment and Processes
Equipment used at the Resource Center is typical of an educational office environment and
includes:
• Computers and monitors
• Printers, copiers, and scanners
• Telephones and internet/network equipment
• Resource Center office furniture
• Whiteboards and standard instructional materials

Operational activities consist of educational support services, tutoring, assessments,
counseling, administrative work, and meetings. No manufacturing, mechanical, or industrial
processes are proposed.
6. Hazardous Materials
• No hazardous materials are used, stored, or generated on site.
• Only standard office and janitorial supplies are utilized, all of which are non -hazardous
and commercially available.
• No chemicals, fuels, or regulated substances are present.
7. Other Special Characteristics of the Proposed Use
• The proposed use generates minimal traffic, noise, and parking demand, comparable to
a small professional office.
• Student attendance is appointment -based, which limits peak -hour impacts.
• No outdoor instruction, recreational activities, or amplified sound are proposed.
• No food preparation or cafeteria services are provided.
• The use is compatible with surrounding commercial and institutional land uses within
the City of La Quinta.
