DECLARATION REGARDING CONSTRUCTION LENDING AGENCY (If
applicable)
A construction lender will be used for completion of the improvements
covered by this permit and the name and information of which is on file for
public inspection during the regular business hours of the public entity.
Failure of the applicant to indicate the construction lender on the
application does not relieve that person of the requirement to give the
construction lender preliminary notice from that duty.
WORKERS' COMPENSATION DECLARATION (1, 2 or 3)
WARNING: FAILURE TO SECURE WORKERS' COMPENSATION COVERAGE IS
UNLAWFUL, AND SHALL SUBJECT AN EMPLOYER TO CRIMINAL PENALTIES AND
CIVIL FINES UP TO ONE HUNDRED THOUSAND DOLLARS ($100,000), IN ADDITION
TO THE COST OF COMPENSATION, DAMAGES AS PROVIDED FOR IN SECTION
3706 OF THE LABOR CODE, INTEREST, AND ATTORNEY'S FEES.
1) Has and will maintain a certificate of consent to self -insure for workers'
compensation, issued by the Director of Industrial Relations as provided for
by Section 3700 of the Labor Code, for the performance of the work for
which this permit is issued.
2) Has and will maintain workers' compensation insurance, as required by
Section 3700 of the Labor Code, for the performance of the work for which
this permit is issued.
3) Certifies that, in the performance of the work for which this permit is
issued, shall not employ any person in any manner so as to become subject
to the workers' compensation laws of California, and agree that, if should
become subject to the workers' compensation provisions of Section 3700 of
the Labor Code, shall forthwith comply with those provisions.
NOTICE TO APPLICANT (1, 2 and 3)
1) Each person upon whose behalf this application was made, each person
at whose request and for whose benefit work is being performed under or
pursuant to any permit issued as a result of this application, the owner, and
the applicant, each agrees to, and shall defend, indemnify and hold harmless
the City of La Quinta, its officers, agents, and employees for any act or
omission related to the work being performed under or following issuance of
this permit.
2) Any permit issued as a result of this application becomes null and void if
work is not commenced within 360 days from date of issuance of such
permit, or if cessation of work for 180 days will subject permit to
cancellation. On or after January 1, 2019, every permit issued shall become
invalid unless the work on the site authorized by such permit is commenced
within 12 months after its issuance, or if the work authorized on the site by
such permit is suspended or abandoned for a period of 12 months after the
time the work is commenced.
3) Certified that they read the application and state that the information
provided is correct. Agree to comply with all city and county ordinances and
state laws relating to building construction, and hereby authorize
representatives of this city to enter upon the above -mentioned property for
inspection purposes.
IMPORTANT: An Application for Permit was made to the Building Official,
subject to the conditions and restrictions set forth at the time of application,

Construction or work for which a permit is required shall be subject to inspection by the building official and such construction or work
shall remain visible and able to be accessed for inspection purposes until approved. Approval as a result of an inspection shall not be
construed to be an approval of a violation of the provisions of the applicable code and other ordinances of the jurisdiction. Inspections
presuming to give authority to violate or cancel the provisions of the applicable code and other ordinances of the jurisdiction shall not be
valid. It shall be the duty of the owner or the owner's authorized agent to cause the work to remain visible and able to be accessed for
inspection purposes. Neither the building official nor the jurisdiction shall be liable for expense entailed in the removal or replacement of
any material required to allow inspection.
It shall be the duty of the holder of the building permit or their duly authorized agent to notify the building official when work is ready for
inspection. It shall be the duty of the permit holder to provide access to and means for inspections of such work that are required by this
code.
A building or structure shall not be used or occupied in whole or in part, and a change of occupancy of a building or structure or portion
thereof shall not be made, until the building official has issued a certificate of occupancy therefor as provided herein. Issuance of a
certificate of occupancy shall not be construed as an approval of a violation of the provisions of the applicable code and other ordinances
of the jurisdiction. Certificates presuming to give authority to violate or cancel the provisions of this code or other ordinances of the
iurisdiction shall not be valid.
A person shall not make connections from a utility, a source of energy, fuel, or power, or a water system or sewer system to any building
or system that is regulated by the applicable code and other ordinances of the jurisdiction for which a permit is required, until approved by
the building official.

Considering Becoming an Owner -Builder?
Important information you need to know BEFORE pulling your permit!
The term "Owner -Builder" can mean three different things: "Owner as
Worker", "Owner as Contractor" or "Owner as Employer"
Understand each has Benefits or Risk, and it is possible to combine them!
Hiring a California Licensed Contractor means you do not personally perform any of the construction work, the
permit is not taken out in your name, you are not personally responsible for the construction and you are not
an Owner -Builder. Instead, you become a "Customer" and California law provides you the benefit of protection from
poor workmanship, failure to finish the job and financial risk due to worker injury.
Benefit/Risk: Highest Benefits and the Least amount of Risk
Owner -as -Worker is a type of Owner -Builder where you personally perform the construction work, the permit is
taken out in your name and you are personally responsible for the construction management, knowledge,
workmanship, and completion of the job. You benefit by not paying others to perform this work for you and your risk
depends on your own ability to complete the job successfully.
Benefit/Risk: Possible Benefit with Low Financial Risk
Owner -as -Contractor is a type of Owner -Builder where you personally act as your own General Contractor,
the permit is taken out in your name and you hire California licensed sub -contractors to perform portions
of the construction work. WARNING: The benefit of protection provided by law when you hire only California
licensed sub- contractors can turn to serious financial risk if you hire unlicensed contractors to perform any the
work.
Benefit/Risk: Possible Benefit and Significant Financial Risk
Owner -as -Employer is a type of Owner -Builder where you pay any individual to perform any
construction work valued at more than $500.00, the permit is taken out in your name and you are
personally responsible for their employment requirements, supervision, performance, safety and welfare while on
your property. WARNING: Cost savings benefit can turn to serious financial risk if you fail to deduct payroll taxes or
provide workers compensation insurance for each worker.

Assembly Bill 2335 amends California Health and Safety Code, Section 19825, regarding
disclosures and verifications required for all applicants seeking Owner -Builder construction
permits. These new application requirements provide an enhanced level of consumer awareness
and protection for property owners accepting the risks associated with Owner -Builder
construction permits.
"The Legislature hereby finds and declares that there is an urgent and statewide public interest in
assuring that building contractors comply with the Contractors License Law... and provisions of
law relating to Workers' Compensation Insurance for building construction, that property owners
are informed about, and protected from, fraudulent representations, liability for worker's injuries,
liability for material and labor costs unpaid by contractors, licensing requirements, and employer's
tax liabilities when improving their property as owner -builders"

Dear Property Owner:
An application for a building permit has been submitted in your name listing yourself as the builder of the property

We are providing you with an Owner -Builder Acknowledgment and Information Verification Form to make you
aware of your responsibilities and possible risk you may incur by having this permit issued in your name as the
Owner -Builder. We will not issue a building permit until you have read, initialed your understanding of each
provision, signed, and returned this form to us at our official address indicated. An agent of the owner
cannot execute this notice unless you, the property owner, obtain the prior approval of the permitting authority.
OWNER's ACKNOWLEDGMENT AND VERIFICATION OF INFORMATION
DIRECTIONS: Read and initial each statement below to signify you understand or verify this information.
CC 1. 1 understand a frequent practice of unlicensed persons is to have the property owner obtain an "Owner -
Builder" building permit that erroneously implies that the property owner is providing his or her own labor and
material personally. I, as an Owner -Builder, may be held liable and subject to serious financial risk for any injuries
sustained by an unlicensed person and his or her employees while working on my property. My homeowner's
insurance may not provide coverage for those injuries. I am willfully acting as an Owner -Builder and am aware of
the limits of my insurance coverage for injuries to workers on my property.
CC 2 1 understand building permits are not required to be signed by property owners unless they are responsible
for the construction and are not hiring a licensed Contractor to assume this responsibility.
CC 3. 1 understand as an "Owner -Builder" I am the responsible party of record on the permit. I understand that I
may protect myself from potential financial risk by hiring a licensed Contractor and having the permit filed in his or
her name instead of my own.
CC 4. 1 understand Contractors are required by law to be licensed and bonded in California and to list their license

GENERAL INSTRUCTIONS
1. This plan review has been made to verify conformance to minimum requirements of codes
and ordinances adopted by the City of La Quinta. Codes in effect for this project include the
2022 editions of the California Building Code (CBC), California Residential Code (CRC),
California Green Building Code (CGBC), California Plumbing Code (CPC), California
Mechanical Code (CMC), California Electrical Code (CEC), and California Energy Code
(CEnC). The CBC is based on the 2021 editions of the International Building Code, which
was published by the International Code Council. The CPC and CIVIC are based on the 2021
edition of the Uniform Plumbing and Mechanical Codes, respectively, which were published
by IAPMO. The CEC is based on the 2020 edition of the National Electrical Code published
by the National Fire Protection Association (NFPA). Applicable code sections are referenced
after each item in this list.
2. These plans and documents have been reviewed for compliance with the applicable code
requirements and instructions of the jurisdiction. The stamping of these plans shall not be
held to permit or be an approval of a violation of any applicable codes and/or standards nor
relieve the owner, design professional of record or contractor of compliance with any
applicable codes and/or standards. Plan review of documents does not authorize
construction to proceed in violation of any federal, state, nor local regulation.

SECTION A - GENERAL

Plans.

telephone number and electronic -signature. If the preparer is a licensed architect or engineer, all documents
prepared by that licensed individual shall also bear his/her stamp as prescribed by California Business and
Professions Code §5536. Resubmittals will not be accepted with signatures missing.
3) Note on Plans: "All construction shall comply with the 2022 California Residential, Mechanical, Electrical,
Plumbing, Green Building and Energy Codes and the La Quinta Municipal Code." Remove notes referencing

7) In addition to the comments provided for the scope of work proposed, for this submittal to resolve the Active
Code Case please provide the following additional items:
a) The changeout out of fenestration surfaces reviewed on application for permit BRES2024-0009 does not
propose the framing required at the addition of the folding door or removal of openings. Provide a design
by a licensed architect or engineer in accordance with the California Residential Code, including vertical
and lateral calculations, for the proposed installation. A comprehensive structural review will be performed
at the next submittal.
b) Provide at least one wall receptacle outlet within thirty-six (36) inches of the outside edge of each
bathroom basin. The receptacle outlet shall be located on a wall or partition that is adjacent to the basin
or basin countertop, located on the countertop, or installed on the side or face of the basin cabinet. In no
case shall the receptacle be located more than twelve (12) inches below the top of the basin. (CEC
§210.52(D))
c) Kitchen, pantries, breakfast rooms, dining rooms, and similar area receptacles shall comply with the
following: (CEC §210.52(C)):
i) Provide a receptacle outlet at each wall counter space 12 inches or wider.
ii) Provide receptacle outlets at each wall counter so that no point along the wall line is more than 24
inches, measured horizontally from a receptacle outlet in that space.
iii) Provide at least one receptacle outlet at each island counter space with a long dimension of 24
inches or greater and a short dimension of 12 inches or greater.
iv) Provide at least one receptacle outlet at each peninsular counter space with a long dimension of 24"
or greater and a short dimension of 12" or greater. A peninsular countertop is measured from the
connecting edge.
d) Provide one island/peninsular receptacle for the first 9sf, or fraction thereof, of counter space and one
additional outlet for each additional 18sf or fraction thereof of counterspace. (CEC 210.52 (C)(2)).
e) Dishwasher circuits shall be provided with Class A GFCI protection for personnel. (CEC 422.5(A))
f) All 15- and 20-ampere, 125- and 250-volt receptacles in dwelling units, including attached and detached
garages and accessory buildings to dwelling units shall be listed tamper -resistant receptacles. (CEC
406.12)

g) Replacement of receptacles in any areas specified in 210.12 (A-C) shall be arc -fault protected by either a
listed outlet branch -circuit type arc -fault circuit -interrupter type receptacle, a receptacle protected by a
listed outlet branch -circuit type arc -fault circuit -interrupter type receptacle, or a receptacle protected by a
listed combination type arc -fault circuit -interrupter type circuit breaker. (CEC 406.4(D)(4))
SECTION B — PRECISE / SITE PLAN / ZONING
1) Provide a complete site plan showing north arrow, property lines and lot dimensions, location of existing
curbs, all existing and proposed structures, setback dimensions, utility locations, and (if utilized) location of
private sewage disposal system. (CRC §R106.1.1)
a) Show on Site Plan the location, physical size, and capacity of propane tank, demonstrating required
clearances between the tank and structures. (CRC §R106.1.1)
b) Propane tank shall be screened from view from surrounding properties. Specify screening method on Site
Plan. (LQMC §9.60.140.B.2)
2) Provide garage with minimum net clear interior dimensions not less than 20 feet by 20 feet. (LQMC
§9.150.070.C, Table 9-11, 9.150.080.B.8) Relocated water heater obstructs the required space.
SECTION C -ARCHITECTURAL
1) Specify the make, model number, and ICC Evaluation Report Number (or UL Listing Number) of factory -built
fireplaces and/or fire features. (CRC §R106.1.1) Proposed gas fireplaces shall be a direct -vent sealed
combustion type and have provided a current paper copy of its listing report to demonstrate compliance.
(CALGreen §4.503.1)
SECTION D - MECHANICAL
1) Provide permanent, substantial protection for water heater in garage from vehicle impact. (CIVIC §305.1.1)
Not applicable if vehicle parking area is obstructed by water heater, see above comment.
2) Show on Plans a disconnect adjacent to and in sight of the water heating unit. (CIVIC §301.4) Show required
working clearances to disconnect per CEC §110.26(A).
SECTION E — ELECTRICAL
1) For new water heater circuit, if allowed to remain and not moved back to original location, specify conduit size
from service panel to water heater; number of conductors, their size, material, and insulation type.
2) Provide the following information on Electrical Plan: Fixture Legend: Types, Wattages, Efficacy, etc.; Show
how light switching controls comply with California Energy Code §§ 110.9 and 150(k).
3) Note on Electrical Plan: "All 120-volt, single phase, 15- and 20-ampere branch circuits supplying outlets or
devices installed in dwelling unit kitchens, family rooms, dining rooms, living rooms, parlors, libraries, dens,
bedrooms, sunrooms, recreation rooms, closets, hallways, laundry areas or similar rooms or areas shall be
protected by an listed arc -fault circuit interrupter, combination type, installed to provide protection of the
branch circuit or by any of the other means described in 210.12(A)(2) through (6)." (CEC §210.12(A))
4) Note on Electrical Plan: "Modified, replaced, or extended 120-volt, single phase, 15- and 20-ampere branch
circuits supplying outlets or devices installed in dwelling unit kitchens, family rooms, dining rooms, living
rooms, parlors, libraries, dens, bedrooms, sunrooms, recreation rooms, closets, hallways, laundry areas or
similar rooms or areas shall be protected by either a listed combination -type AFCI located at the origin of the
branch circuit or a listed outlet branch -circuit type AFCI located at the first receptacle outlet of the existing
branch circuit." (CEC §210.12(B))

outlets (luminaires, fans, smoke alarms, etc.) and the devices within dwelling unit.

SECTION F - PLUMBING
1) Provide an access panel (12" x 12" minimum) to bathtub trap connection, if a slip joint connection is utilized.

2) Note on Plans: "Hot -mopped shower pan shall be inspected upon completion of hot -mopping and shall be
filled with water for inspection." (CPC §408.7)
3) Note on Plans: "Provide a combination pressure and temperature relief valve at all water heaters, set to open
at not more than 150 psi. The drainpipe shall extend to outside of building and terminate not more than 2 feet
nor less than 6 inches above the ground and point downward with the end unobstructed. Any other
termination location shall require approval by the Building Official." (CPC §608.3, 608.4, 608.5)
4) Provide a schematic piping plan (see Figure 1216.1.1 pg.218 for an example) showing all fuel burning
appliances and their fuel demand. Show pipe lengths and sizes. (CPC Chapter 12 and Tables)
SECTION G — ENERGY EFFICIENCY
1) Provide complete energy calculations showing compliance with the 2022 California Energy Code for the
changeout of the HVAC Equipment and Water Heater, including registration identification from a certified
HERS provider if applicable. Due to lack of information in this submittal, a comprehensive review will be
performed at next submittal.
2) All installed luminaires shall meet the requirements in Table 150.0-A. Specify in lighting schedule for each
luminaire, the luminaire and lamp types, wattage and whether light source requires certification with
Reference Joint Appendix JAB, such as required for all screw -base luminaires and recessed down lighting.
(CEnC §150.0(k)1A)
3) The number of electrical boxes that are more than 5 feet above the finished floor and do not contain a
luminaire or other device shall be no greater than the number of bedrooms. These electrical boxes must be
served by a dimmer, vacancy sensor control, or fan speed control. (CEnC §150.0(k)1 B)
4) All down light luminaires recessed in ceilings (not just those in insulated ceilings) must meet the following
requirements: (CEnC §150.0(k)1C)
a) Shall contain light sources that are certified JA8 compliant that are not of the screw -based type; and
b) Those that are enclosed, such as those often used in showers, must utilize a JA8-E compliant lamp rated
for use at elevated temperatures; and
c) Be listed for zero -clearance insulation contact (IC Rated) by a nationally recognized testing lab that are
certified airtight per ASTM E283-04 (air leakage less than 2.0 CFM at 75 Pascals); and
d) Have a gasket or caulked sealing between the luminaire housing and ceiling; and
e) Allow readily accessible ballasts for maintenance or replacement without needing to cut holes in the
ceilings.
5) In bathrooms, garages, laundry rooms, utility rooms, and walk-in closets at least one luminaire must be
controlled by a vacancy sensor. (CEnC §150.0(k)21)
6) All lighting in habitable spaces must be controlled by either a dimmer or vacancy sensor. (CEnC §150.0(k)2J)
7) Outdoor lighting permanently mounted to the building must be controlled by one of the following combinations
and a manual ON/OFF switch that does not override the chosen combination: (CEC §150.0(k)3)

simply submit copies of a few supplemental calculations. For resubmittal, incorporate any new or
