OPC Y # , .of Etrri klUe lent 90-day Mobile Home Owners July 26, 2019 Alejandro Prebot, Hilda Robles Marco Bedolla Robles and Vanessa Bedolla Robles 46400 Dune Palms Rd. #31 La Quinta, CA 92253 Dear Occupants: The City La Quinta (called here the "Displacing Agency's is proceeding with the project known as Dune Palms Road Bridge Project. To carry out this project, it will be necessary for you to relocate from your dwelling at 46400 Dune Palms Rd. #31, La Quinta CA 92253. You will not be required to move without at least 90 days advance written notice of the day by which you must vacate. However, you can contact us at any time for assistance with your move and to receive the benefits for which you are eligible. This is a notice of eligibility for relocation assistance. The effective date of your eligibility, known as the "initiation of negotiations", is June 17, 2019. You are eligible for relocation assistance and benefits under the Displacing Agency's Relocation Assistance Program. You are entitled to the Relocation Advisory Assistance provided by Overland, Pacific & Cutler, LLC (OPQ, a professional firm hired by the Displacing Agency to provide relocation assistance to you, such as referrals to replacement housing and help with filing for benefits. Additionally, you are entitled to one of the following benefits: You may move your mobile home to another mobile home park (if it is movable and meets current local codes), OR • If it is determined that your mobile home cannot be relocated to a comparable replacement site, you may sell your mobile home to the Displacing Agency for its fair market value and purchase a replacement mobile home in an established mobile home park or purchase or rent a conventional dwelling. A. Moving Your Mobile Home to another Park. If your coach is movable and you elect to have the Displacing Agency move your coach to another park, the Displacing Agency will pay for the following: 1. Preparation of your coach for moving; 2. Transport of your coach to a new site (witm iin 50 miles); 3. Set-up of your coach at the new location (including code required modifications such as earthquake strapping); © 2018 OPC Page 1 of 5 4. Reconstruction or reinstallation of all appurtenances such as porches, awnings and/or storage buildings; which are not acquired; 5. Payment of all fees for reinstallation; 6. Space Rent Differential, as described below; and 7. Other expenses which the City deems to be reasonable and necessary. NOTE: The cost of replacing landreaping and hardscape improvements is not covered. B. Selling your Mobile Home to the Displacing Agency. If you elect to have the Displacing Agency purchase your coach, you may qualify for a Replacement Housing Payment. If you owned and occupied the mobile home for 90 or more consecutive days immediately preceding the initiation of negotiations, you may be eligible for financial assistance to purchase or rent comparable replacement housing. These benefits consist of the following payments: 1. Purchase Price Differential: This payment is to cover the increased cost you may have to pay when you buy a new home. It is the difference between the cost of a comparable replacement dwelling (as determined by the Displacing Agency) or, if less, the cost of the replacement dwelling you purchase, and the price paid by Displacing Agency for your present home. A study was completed to determine the cost of comparable replacement dwelling most nearly representative of your current dwelling. The study indicated that the dwelling located at 80000 Ave 48 #258, Indio, CA 92201, listed at $50,000.00 was the most representative of your current dwelling. Based on the above, your maximum replacement housing payment is calculated as follows: 1 List Price for Comparable Dwelling $50,000.00 2 Offer Price for Your Current Dwelling $35,600.00 3 Purchase Price Differential (Lime 1 minus Line 2) $14,400.00 As indicated, you may be eligible for a Purchase Price Differential payment up to the amount as calculated in the table above. If you decide to purchase a replacement dwelling that costs less than the comparable dwelling, your Purchase Price Differential would be based on the actual purchase price of your replacement dwelling. If you decide to purchase a replacement dwelling that costs more than the comparable dwelling, your Purchase Price Differential would still be based on the comparable dwelling price. If the amount the Displacing Agency pays for your present dwelling is increased, your Purchase Price Differential would be decreased accordingly. Please find attached a listing of other available comparable replacement dwellings that you may want to consider purchasing. If you need any assistance or transportation to inspect in these referrals, please contact the relocation agent identified below. 2. Mortgage Interest Differential: To help pay your increased interest cost, if any, of your new mortgage (with some limitations). 3. Incidental Expenses: Non -recurring incidental costs to cover some of the closing costs you © 2018 OPC Page 2 of 5 may incur in purchasing a replacement dwelling. C. Space Rent Differential. If you decide to purchase another mobile home, rent a conventional dwelling unit, or move your mobile home, you may be eligible for additional assistance to cover any increased space rent at the facility to which you relocate. Your rental assistance benefits will be based upon the difference between the monthly rent and utilities associated with comparable space rent (as determined by the Displacing Agency) and your base monthly rent, multiplied by 42 mont^s (see table below). A study was completed to determine the cost of comparable space rent for eligible occupants most nearly representative of your current space. The study indicated that the space located at 80000 Ave 48, Indio, CA @ Las Palmas De La Quinta MH Community Park, with a monthly rent and estimated utilities of $1,249.00 (rent of $950.00 and utilities of $299.00) was the most representative of your current space. Base monthly rent is defined as the lesser of: (1) $80C.62, which represents the average monthly rent ($536.00) and average monthly utilities ($185.62) at your displacement space (if you are paying little or no rent, the amount is based on the economic rental value of the space); or (2) $2,337.83, which represents thirty (30) percent of your gross monthly household income if your household income is classified as "low income" by the U. S. Department of Housing and Urban Development's Annual Survey of Income Limits for the Public Housing and Section 8 Programs. (If "N/A", income was not used in the calculation because you have been determined to not be "low income" and/or are a dependent, or the income information provided was insufficient evidence of income. Based on the above, your base monthly refit amount is $800.62, and your maximum rental assistance payment is calculated as fellows: WaxiiFEui k �Qi,da, Auz-mstali a Payment Calculation 1 Comparable Space Cost $1,249.00 2 Base Monthly Rent $800.62 3 Monthly Difference (Line 1 minus Line 2) $448.38 4 Maximum payment (difference times 42 months) $18,831.96 This rental assistance payment may be used to lease a replacement site; may be applied to the purchase price of a replacement site; or may be applied, with any replacement housing payment attributable to the mobile home, to the purchase of a replacement mobile home or conventional "decent, safe and sanitary" dwelling. D. Payment: for Moving Personal Possessions. You will receive a payment to assist in moving your personal property. You may select one of the following payments: 1. A Fixed Moving Payment based on the number of rooms you occupy (from Informational Statement). Your entitlement under this option for 8 rooms is $2,505.00; or 2. A payment for your Actual Reasonable Moving and Related Expenses based on at least two © 2018 OPC Page 3 of 5 written estimates and receipted bills; or 3. A combination of both (in some cases). If you wish to rent (rather than buy) a comparable replacement home, let us know. We will help you find comparable rental housing and explain your eligibility for a rental assistance payment. To be eligible for a replacement housing payment described above, you must purchase or rent and occupy a decent, safe and sanitary replacement dwelling within 12 months from the later of the following dates: 1) the date Displacing Agency has paid the Acquisition cost of your current dwelling, or 2) the date first comparable replacement dwelling referral has been made available to you. You must also file all claims for replacement housing or moving payments within 18 months from the later of the following dates: 1) the date which you moved from your displacement dwelling, or 2) the date Displacing Agency has paid the Acquisition cost of your current dwelling. Failure to occupy the replacement dwelling or to submit claims within the above time limits could result in loss of moving and/or replacement housing benefits. Furthermore, displacees not lawfully present in the united States are ineligible for relocation payments and assistance. Displacees must certify legal residency status for all household members in order to receive benefits. However, the City of La Quinta will authorize the payment of relocation assistance benefits to any otherwise eligible residential displacees from non -federally authorized reimbursable funds. You do not have to accept any dwelling referred to you by the Displacing Agency. You may choose your own replacement, but to qualify for relocation assistance payments it must first be inspected to assure that it meets the "decent, safe and sanitary" standards. For this reason, DO NOT MOVE from your home and DO NOT CONTRACT to rent or purchase a replacement dwelling without first contacting your relocation agent. The "decent, safe and sanitary" inspection is not a substitute for a professional housing inspection. If you remain in occupancy of your present dwelling after the Displacing Agency has completed the purchase, you must continue to pay your rent to the Displacing Agency for the period of your tenancy, as well as meet all other conditions stated in your lease or rental agreement. The Relocation Assistance Program is very complex. It is important that you carefully read and understand the matters explained in this notice and in the Informational Statement which was provided to you. Any person aggrieved by a determination as to eligibility for, or the amount of, a payment authorized by the Displacing Agency's Relocation Assistance Program may have the appeal application reviewed by the Displacing Agency in accordance with its appeals procedure.
