If the Displacing Agency acquires the property and you are displaced for the Project, you will beeligible for relocation assistance under the Uniform Relocation Assistance and Real Property AcquisitionPolicies Act of 1970 (URA), as amended and California Relocation Assistance Law (Sec 7260 et. seq. ofthe CA Government Code.However, you do not have to move now.This is not a notice to vacate the premises or a notice of relocation eligibility.The Displacing Agency has retained the professional firm of Overland, Pacific & Cutler, Inc. (OPC) torepresent the Agency and assist in the relocation process.In order to assess and better plan for the relocation needs of possible displaced non-residential occupantsin the Project, the Displacing Agency is preparing a Relocation Plan. In order to prepare this relocationplan, OPC staff will need to meet with you at your place of business to assess your relocation needs. OPCwill be in the area of your business beginning the week of November 12, 2018, and will be trying tocontact you then. If you want to make an appointment that is convenient for you/ please call therelocation agent identified below.If you rent or lease your unit, you should continue to pay your monthly rent to your landlord becausefailure to pay rent and meet your obligations as a tenant may be cause for eviction and loss of relocationassistance. You are urged not to move or sign any agreement to purchase or lease a unit before receivingformal notice of eligibility for relocation assistance. If you move or are evicted before receiving suchnotice, you will not be eligible to receive relocation assistance. Please contact us before you make anymoving plans. If the Displacing Agency acquires the property and you are eligible for relocationassistance, you will be given advisory services, including referrals to replacement sites, and at least 90days advance written notice of the date you will be required to move. GIN Notice P age | 2in federally-funded projects, in the case of an unincorporated business, each owner must be either acitizen or national of the United States, or an alien who is lawfully present in the United States. Theowner of a sole proprietorship and all owners of a partnership must provide information regarding theirlawful presence in the United States, and a for-profit or a non-profit corporation must certify that it isauthorized to conduct business within the United States. Owners of sole proprietorships or partnerships,who are not lawfully present in the United States, or who decline to provide this information, are noteligible for relocation assistance, unless such eligibility would result in exceptional hardship to a qualifyingspouse, parent, or child. Relocation benefits will be prorated to reflect the number of owners with certifiedlawful presence in the United States.Again, this is not a notice to vacate and does not establish eligibility for relocation payments or otherrelocation assistance. If the Displacing Agency decides not to purchase the property, you will be notifiedin writing.Any person aggrieved by a determination as to eligibility for, or the amount of, a payment authorized bythe Displacing Agency's Relocation Assistance Program may have the appeal application reviewed by theDisplacing Agency in accordance with its appeals procedure.
