Dear Mr. Adams:
I have received your letter on March 3, 2023, requesting permission to work outside of the
construction hours established by La Quinta Municipal Code Section 6.08.050, at the Dune
Palms Road Bridge, Project no. 2011-05.
Exception 2 of the above-mentioned code section allows the issuance of an early work permit
under certain specific conditions.
It is our determination that additional sufficient need exists due to the need to perform sewer
improvements in the most efficient manner. Therefore, a full closure is provision of the exception,
subject to the following conditions:
1. This permit is only valid for a full lane closure for sewer improvements at the Dune Palms
Road Bridge Improvements project, project no. 2011-05.
2. Work hours shall be from 6:30 a.m. to 5:30 p.m. on Monday, March 13, 2023, to Monday,
March 20, 2023. All lanes shall be opened no later than 6:00 a.m. on Monday, March 20,
2023.
3. This permit shall be revoked upon receipt by the Public Works Department of any citizen
complaint of construction noise occurring during the extended hours granted by this early
work permit, or upon violation of any condition of this early work permit.
All work not specifically included in the terms of this early work permit shall be performed only
during Code-established construction hours or by a separately issued early work permit.

Subject: Full Closure Extension
Dear Mr. Nowak,
Please reference our previous letter dated February 15, 2023.
As discussed at our most recent Weekly Meeting (March 1, 2023) the initial 2-week full closure of
Dune Palms Road was put in place Monday, February 27, 2023. Our subcontractor, SRK
Engineering, mobilized to the site, set up sewer bypass pumps and began excavation for the 12”
sewer relocation.
Due to the existing locations of both the 12” sewer and 18” sewer a redesign has been necessary.
OEI provided an RFI for this situation, and the project designer has addressed the conflicts.
Unfortunately, until the utility district (CVWD) reviews and approves the suggested redesign, work
cannot continue on these sewer relocations. The Full Closure of Dune Palms Road will need to be
extended a minimum of 1 week, through Monday, March 20, 2023.
Please understand that CVWD reviews and approval are a factor in our estimation that a 1-week
extension is necessary. In addition, OEI will need some assurances and direction from the City
before proceeding with the changes required to accommodate the conflicts discovered in the field.
To expedite this work OEI does not require an executed change order – acknowledgment of the
changed conditions with direction to proceed will suffice.
As all parties are aware, OEI has a subcontractor (SRK Engineering) performing this work. OEI has
directed SRK to remain mobilized on the site in anticipation of returning to work when this issue is
resolved. SRK has equipment on site and is incurring costs for this idle equipment.
OEI has not provided a date to SRK when work on the 12” and 18” sewer relocations can resume.
SRK will respond as quickly as possible, pending their availability of crews.

OEI is and will continue to perform work inside of the closure, preparing for the ultimate opening of
the temporary bypass road. Opening of the temporary bypass road is contingent on SRK completing
the relocation of both the 12” sewer and 18” sewer.
