Subject: Letter #004 (Full Closure Extension) Response
Mr. Adams,
The City is in receipt of your written notice, dated March 3, 2023, with the subject line
reading, “Full Closure Extension”. It is agreed that your subcontractor SRK did encounter
sewer line existing conditions that conflicted with the plan drawings. On February 27th, Ortiz
submitted RFI No. 8 detailing the sewer line conflict. On the same day, this RFI was
forwarded to designer of record Brad Donais. RFI response and revised plan drawings were
submitted to CVWD and reviewed and accepted by CVWD on March 7, 2023. This
information was forwarded to Ortiz the same day. In the e-mail sent, it was requested to have
SRK return on site as quickly as possible. Please refer to Special Provision Specification
Section 6.3.1 Notice of Delays:
“The Contractor shall take immediate steps to prevent, if possible the occurrence or
continuance of the delay.”
It is acknowledged that SRK incurred costs due to sewer pumps and equipment delivered to
the site and not utilized during this time frame. Idle equipment is being documented by our
inspector.
Plan revisions for the sewer line have already been sent to Ortiz; plan revisions for the storm
drain modification are forthcoming. All these revisions will be included in upcoming CCO No.
002.
