A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, DECLARING ITS INTENT TO
FORM AN ASSESSMENT DISTRICT FOR THE MAINTENANCE
AND SERVICING OF LANDSCAPING, WITHIN THE BOUNDARIES
OF THE TERRITORY INCLUDED IN THE LA QUINTA LANDSCAPING
DISTRICT NUMBER 1 AND TO LEVY AND COLLECT ASSESSMENTS
PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972
AND GIVING NOTICE THEREOF.
WHEREAS, the City Council by Resolution No. 86-37 initiated
proceedings to form an Assessment District pursuant to the provisions
of the Landscaping and Lighting Act of 1972 Part 2, Division 15 of
the California Streets and Highways Code); and
WHEREAS, by said Resolution No. 86-37 the City Council ordered
the Engineer to prepare a report pursuant to Section 22565 of said
Code; and
WHEREAS, the Engineer did prepare and file such a report and the
same was approved by the City Council on the 20th day of May, 1986.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LA QUINTA DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. That the public interest and convenience require and
it is the intention of the City Council of the City of La Quinta to
order the formation of an Assessment District and to levy and collect
assessments pursuant to the provisions of said Landscaping and Lighting
Act of 1972, Part 2 Division 15 of said Streets and Highways Code).
Section 2. That the improvements to be undertaken consist of the
maintenance, installation, servicing, replacement and irrigation of
median and fire station landscaping, located on the public streets within
the District. The proposed Assessment District, designated as La Quinta
Landscaping District Number 1" generally encompasses all of the
territories bounded by Avenue 54, Airport Boulevard, Jefferson Street
and Madison Street or the extensions thereof, except the areas of all
public streets,avenues, lanes, alleys, rights of way, publicly owned
properties, parks, all public school property being used for public
purposes, private streets and open space. All railroad, gas, water,
and electric utility owned property and rights of way shall be included
in the proposed District and assessed benefit derived, pursuant to
Streets and Highways Code Section 22595.
Section 3. That reference hereby is made to the report of the
Engineer on file with the City Clerk and open to inspection, for full
detailed description of the improvements, the boundaries of the
Assessment District and any zones therein, and the proposed assessments
upon assessable lots and parcels of land with the District.
Section 4. That said proposed maintenance, servicing and replace-
ment in the opinion of the City Council of the City of La Quinta will be
to the benefit of all property lying within the described boundaries
of the proposed Assessment District, as said Assessment District is
described and defined in said Engiener's report; and that there is general
pulbic benefit derived from the maintenance of the landscaping.

Section 5. Notice is hereby given that on June 3, at 7:30 p.m.
in the City Council Chambers, City Hall, located at 78-105 Calle
Estado, La Quinta, California, all interested persons may appear
before the City Council and be heard concerning the formation of the
District, the extent of the District, the services to be performed
and the proposed assessment and all other matters relating thereto.
Protests must be in writing and must be filed with the City
Clerk prior to the conclusion of the hearing. Any such protest
shall state all grounds of the objection and if filed by the property
owners shall contain a description sufficient to identify the property.
Section 6. The City Clerk shall cause notice of the hearing to
be given by causing the Resolution of Intention to be published and
posted and mailed in the manner required by Part 2 of Division 2 of
Division 15 of the Streets and Highways Code.
Section 7. The City Clerk shall certify to the adoption of this
Resolution.
