CC Resolution 1986-093 Opposing Mandatory Drug Testing^!4 RESOLUTION NO. 86-93
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA,CALIFORNIA, IN OPPOSING MANDATORY
RANDOM DRUG SAMPLING FOR CITY EMPLOYEES.
WHEREAS, The City Council of the City of La Quinta is aware of,
and seriously concerned about, the major drug abuse problem in our
nation today; and
WHEREAS, The City Council strongly supports all constitutional
and fair measures to counteract such abuse in the City of La Quinta,
or by the City Hall staff, or by other organizations with which the
City is involved; and
WHEREAS, The City Council considers any kind of mandatory
random drug testing of employees in violation of their constitutional
rights, as guaranteed by the Fourth Amendment of the United States
Constitution; and
WHEREAS, The City Council also finds such mandatory random
testing demeaning for persons required to participate; and
WHEREAS, The City Council is aware that such testing often
lacks validity and can give employers a wrong impression of certain
employees, particularly if they are using over-the-counter or
prescription drugs.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
city of La Quinta reiterates its commitment to fight the drug abuse
problem within its domain; and
BE IT FURTHERMORE RESOLVED that the City Manager be instructed
to maintain awareness of any drug abuse problems on his staff or in
the City and that he take proper corrective actions; and
BE IT FURTHERMORE RESOLVED that the City Council seriously
rejects any program of mandatory random drug testing of any members
of the city staff; and
BE IT FURTHERMORE RESOLVED that the City Council of the
City of La Quinta urges all organizations with which the City
participates, either through funding or through participation
on the governing board of such organizations, to refrain from
mandatory random drug testing of employees, now and in the future.
