A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, VACATING
CERTAIN PORTIONS OF EISENHOWER DRIVE.

WHEREAS, the City Council did adopt its Resolution No.
88-89 declaring its intention to vacate certain portions of
Eisenhower Drive pursuant to the Public Streets, Highways and
Service Easements Vacation Law; and
WHEREAS, said Resolution No. 88-89 fixed August 2, 1988 at
the hour of 7:30 P.M. in the Council Chambers as the time and
place for hearing all persons interested in or objecting to the
proposed vacations; and
WHEREAS, a Notice of Public Hearing was published in the
time and manner provided by law and notices of said hearing were
posted along said portions of the street to be vacated in the
time and manner provided by law; and
WHEREAS, the Planning Commission has adopted its Resolution
No. P.C. 85-008 determining that the vacation of said street is
not in conflict with the Circulation Element or any other
element of the General Plan; and
WHEREAS, the City Council has conducted its hearing and has
heard the evidence concerning this matter.
NOW, THEREFORE, the City Council of the City of La Quinta,
does resolve as follows:
1. The City Council hereby finds and determines that the
following described portion of Eisenhower Drive is
unnecessary for present or prospective public use and
hereby orders said street vacated and abandoned.
2. Said Street ordered vacated and abandoned is the
southeasterly 21 feet of Eisenhower Drive between
Avenida Fernando (South) and San Vincente Street. Said
real property is particularly described in Exhibit
"A", attached hereto and incorporated herein by this
reference. A map designating the portion of said
drive and boulevard to be vacated is attached hereto
as Exhibit "B" and incorporated herein by this
reference.

3. The City Council hereby finds and determines that the
street hereby vacated and abandoned is not useful as a
non -motorized, transportation facility as defined in
Lo3
Streets and Highways Code, Section 156, nor useful as
a bicycle path or route pursuant to Public Resources
Code, Section 5079.
4. This Council hereby determines that the public
convenience and necessity require, and it is
accordingly ordered, that there is reserved and
excepted from the vacation of said street, an easement
in favor of the public, the City of La Quinta, the
County of Riverside, the State of California, and all
public agencies and their officers, agents, employees,
and contractors, for access, ingress and egress of
fire, police and other emergency services vehicles and
personnel, on, in, over and across the areas of said
street herein ordered vacated.
5. The City Council hereby reserves and excepts from the
proposed vacation, the permanent easement and right at
any time and from time to time, to construct,
maintain, operate and replace and renew sanitary
sewers, water systems, and storm drains and
appurtenant structures in, upon, over and across any
part of the street proposed to be vacated and,
pursuant to any existing franchise or renewals thereof
or otherwise, to construct, met, operate, replace,
remove, renew and enlarge lines of pipe, conduits,
cables, wires, poles and other convenient structures,
equipment and fixtures for the operation of gas pipe
lines, telegraphic and telephone lines, and traffic
signals and for the distribution of electric energy,
petroleum and its products, water and incidental
purposes, including access and the right to keep the
property free from flammable materials and wood
growth, and' otherwise protect the same from all
hazards in, upon, and over the street proposed to be
vacated together with the right without notice, to
assign said right of way or any portion thereof.
These proceedings are taken subject to the above
reservations and exceptions.
6. The City Clerk is hereby authorized and directed to
record a certified copy of this Resolution in the
office of the County Recorder of Riverside County.

RESOLUTION OF INTENTION AS FOLLOWS:
TO CLOSE AND VACATE THE SOUTHEASTERLY 21 FEET OF EISENHOWER
DRIVE BETWEEN AVENIDA FERNANDO (SOUTH) AND SAN VICENTE
STREET, AN EXISTING DEDICATED STREET MORE PARTICULARLY
DESCRIBTED AS SET FORTH
"All that portion of a strip of land 21.00 feet wide lying
Westerly, Northwesterly, Northerly, and adjoining the Easterly,
Southeasterly and Southerly Line of Lot "T" (Eisenhower Drive -
former].y Avenida Serra) of La Quinta Golf Estates Unit No. 1 as
shown by map on file in Book 37 of Maps at Pages 96 through 98,
thereof, Records of Riverside County, State of California, said
line being described as follows:
Commencing at the Southeast corner of said Lot "T";
Thence N00° 01130" W along the Easterly line of said Lot "T" a
distance of 200.00 feet to the point of being of the line being
described, said point also being the point of compound curvature
in the West line of Lot 115 of said La Quinta Golf Estates Unit
No. 1, said point hereinafter referred to as Point "A";
Thence Northeasterly along the Southeasterly line of said Lot
"T" on a curve concave Southeasterly having a radius of 1950.00
feet through an angle of 8905913011, an arc length of 3062.77
feet;
