A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, ANNOUNCING
CONCURRENCE WITH THE ENVIRONMENTAL
DETERMINATION AND APPROVING TENTATIVE
TRACT 24507, AMENDMENT #1.
CASE NO. TT 24507, AMENDMENT 11 STEVEN BRUM**
WHEREAS, the Planning Commission of the City of La Quinta, did, on
the 8th day of August, 1989, hold a duly-noticed Public Hearing to consider the
request of Steven Brummel to subdivide +35 acres into 25 single family development
lots for sale, one well site parcel, along with various common area parcels, generally
located on the north side of 52nd Avenue, +2650 feet east of the Jefferson Street
centerline, and more particularly described as:
BEING A PORTION OF THE SOUTHWEST QUARTER OF THE
SOUTHEAST QUARTER OF SECTION 4, T65 R7E, S.B.B.M.
WHEREAS, said real property is within an area which is part of an
approved Sphere of Influence of the City of La Quinta; and,
WHEREAS, sai4 real property area is currently under consideration
for annexation into the City of La Quinta; and,
WHEREAS, California Government Code Section 66454 provides that
a city may take action on a tentative subdivision map of unincorporated property
adjacent to that City, provided that approval of said map is conditioned upon
annexation of said property to such City; and,
WHEREAS, the City Council of the City of La Quinta, California, did
on the 6th day of September, 1989, hold a duly noticed Public Hearing to consider
the Applicant's request and recommendation of the Planning Commission conce*ning
the environmental analysis and Tentative Tract Map 24507; and after such
consideration, did adopt City Council Resolution 89-99 making findings and granting
approval of said Tentative Tract; and,
WHEREAS, the Applicant, Steven Brummel, has requested an
amendment to revise Condition #35 of said Tentative Tract Map as adopted by City
Council Resolution 89-99; and,
WHEREAS, the La Quinta Planning Commission did, on the 14th day
of August, 1990, hold a duly noticed public hearing to consider said amendment
request for Tentative Tract 24507; and,

^#=\ WHEREAS, the Planning and Development Director has determined
that the proposed amendment is exempt from CEQA; and,
WHEREAS, the La Quinta City Council did on the 4th day of
September, 1990, hold a duly noticed public hearing to consider the recommendation
of approval by the Planning Commission for Tentative Tract 24507, Amendment #1;
and,
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, If any, of all interested persons desiring to be heard, said
City Council did find the following facts to justify recommendation for approval of
said amendment request:
1. Approval of Tentative Tract 24507, Amendment #1, will not have any adverse
effect on the environment, as the original design has not been altered, and
therefore, the initial determination that Tentative Tract 24507 will not have any
significant impact on the environment, remains vaild.
2. That the approval process for Annexation #5 has delayed implementation of
Tentative Tract 24507, as conditionally approved, and the proposed amendment
is justified in order to compensate for that delay.
3 That the proposed Tentative Tract 24507, Amendment #1, as conditionally
approved, is consistent with the goals, poilcies, and intent of the La Quinta
General Plan for land use density, circulation requirements, zoning district
development standards, and design requirements of the Subdivision Ordinance
and the La Quinta Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of La Quinta, California as follows:
1. That the above recitations are true and correct and constitute the findings of
the Council in this case;
2. That it does hereby grant confirmation of the Planning and Development
Director's determination relative to the environmental concerns for this
amendment request.
3. That it does hereby approve the subject Tentative Tract Map 24507,
Amendment #1 for the reasons set forth in this Resolution and subject to the
attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the La
Quinta City Council, held on this 4th day of September, 1990, by the following vote,
to wit:

CONDITIONS OF APPROVAL RECOMMENED
TENTATIVE TRACT 24507, AMENDMENT #1
SEPTEMBER 4, 1990
1. Development of Tentative Tract 24507, as amended, shall conform to the
original Conditions of Approval as contained in City Council Resolution 89-
99, adopted September 6, 1990, except where the following modification
takes precedence;
a. Condition 35 to be modified as follows:
35. This approval shall not be in effect until and
unless the annexation of the property has
been approved, adopted by Resolution of the
City Council, and said Resolution has been
recorded. No final map may be approved
until the annexation is completed; however,
the Applicant may commence with the final
map review process while awaiting
annexation. The property shall have been
annexed to the City within two years of the
original date of approval of the tentative
tract map by the City Council."
No other changes to the referenced conditions, or to the approved Exhibit
A" for Tentative Tract 24507, are authorized by approval of this
Amendment.
