A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA,
ANNOUNCING FINDINGS, ADOPTING A
NEGATIVE DECLARATION, AND ADOPTING
AMENDMENTS TO THE GENERAL PLAN OF LA
QUINTA.
WHEREAS, the Planning Commission has conducted a
duly-noticed Public Hearing and made a recommendation on each
of the requested Amendments; and,
WHEREAS, the City Council has conducted a
duly-noticed Public Hearing on the Amendments and considered
the recommendation of the Planning Commission; and,
WHEREAS, an Environmental Review has been conducted
for the said Amendments complying with the requirements of The
Rules to Implement the California Environmental Quality Act of
1970" County of Riverside Resolution No. 82-213, adopted by
reference in City of La Quinta Ordinance No. 5), in that the
Planning Director has determined after initial studies that the
Amendments will not have a significant adverse impact on the
environment and that a Negative Declaration should be filed
where appropriate; and,
WHEREAS, at said public meeting, upon hearing and
considering all testimony and arguments, if any, of all
interested persons desiring to be heard regarding the
Amendments, and City Council did find the following facts to
justify the adoption of the proposed Amendments.
GENERAL PLAN AMENDMENT NO. 91-036 DON HOWARD
1. The property is suitable for development under the
proposed General Plan Designation of Low Density
Residential at 2-4 units per acre, and preannexation
zoning of R-1.
2. The City of Indio General Plan designates the property,
as well as the surrounding area as single family
residential at 0-10 dwelling units per acre.
3. The development of this property at this residential
density will be consistent with existing adjacent single
family development within the City of La Quinta.
4. Environmental Assessment 91-188 identifies no significant
adverse environmental impact from the proposed General
Plan Amendment designating the property as Low Density
Residential.

GENERAL PLAN AMENDMENT 90-034 MAJOR COMMUNITY FACILITY HIGH
SCHOOL)
1. The location of a high school on this site is considered
desirable and necessary by the Desert Sands Unified
School District.
2. The request for a major community facility in this
location is consistent with the goals and policies of the
La Quinta General Plan.
3. Traffic impacts caused by the implementation of GPA
90-034 can be mitigated to a large degree.
4. Environmental mitigation measures can be generated to
reduce the impact of a major community facility land uses
on the subject property.
GENERAL PLAN AMENDMENT 91-035 THE KOENIG COMPANIES
1. Traffic impacts caused by the implementation of GPA
91-035 can be mitigated to a large degree.
2. The request for commercial land use is consistent with
the intent of the La Quinta General Plan.
3. Environmental mitigation measures can be generated to
reduce the impact of General Commercial and uses on the
subject property.
GENERAL PLAN AMENDMENT 90-032 A. G. SPANOS CONSTRUCTION
1. The request for commercial land is consistent with the
intent of the La Quinta General Plan.
2. The traffic impacts caused by the Amendment can be
mitigated to a large degree.
3. Environmental mitigation measures can be generated to
reduce the impact of Tourist Commercial and adjacent uses
on the site.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of La Quinta, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Council in these cases; and
2. That it does hereby confirm the conclusion of
Environmental Assessments in that the Amendments will not
result in a significant adverse impact on the environment
because mitigation measures will be added for each
project, and that a Negative Declaration is adopted.

Exhibits VIAII, *B", C", and 1D'1 are hereby adopted.
4. Section 7.5.10 is amended as illustrated on Exhibit E",
attached hereto is hereby adopted.
PASSED, APPROVED and ADOPTED at a regular meeting
of the La Quinta City Council, held on this 16th day of April,
1991, by the following vote, to wit:

CIRCULATION POLICIES
Amendment to policy 7.5.10 under Street Standards, by adding
the following sentences:
Provided however, the City Council may modify the median
breaks/intersection spacing requirements set forth in
Table vII-3 in connection with large scale projects
including mixed use projects) consisting of a) 100 or
more acres and b) containing at least i) 100 or more
single-family detached dwellings or ii) 250 or more
multi-family dwelling units if such modification does not
endanger the public health and safety."
