CC Resolution 1991-0532 ^ ?" RESOLUTION NO. 91 53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, APPROVING AND ADOPTING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF LA QUINTA AND THE LA QUINTA CITY EMPLOYEES' ASSOCIATION LQCEA), COMMENCING ON JULY 1, 1991, AND TERMINATING ON JUNE 30, 1992. WHEREAS, the City of La Quinta, hereinafter referred to as 1CITY", and the La Quinta City Employees' Association, hereinafter referred to as Association", have met and conferred over wages, hours, terms and conditions of employment pursuant to Government Code Section 3500, as amended; and WHEREAS, the City and the Association have signed a Memorandum of Understanding for the period comencing on July 1, 1991, and terminating on June 30, 1992; NOW, ThEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA QUINTA as follows: SECTION 1. The City does hereby approve, ratify, and authorize implementation of each economic and non-economic benefit and right set forth in the Memorandum of Understanding between the City and Association, attached hereto and executed on June 18, 1991, and incorporated herein as Exhibit A", and said to the extent the City may legally do so in accordance with the time constraints of said Memorandum of Understanding. MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF LA QUINTA AND THE LA QUINTA CITY EMPLOYEES' ASSOCIATION WHEREAS, on July 2, 1991, the City of La Quinta herein referred to as CITY), by its City Council, adopted Resolution No. 91-53 recognizing the La Quinta City Employees' Association herein referred to as ASSOCIATION), as the recognized employee organization representing all members of the referenced Association; and WHEREAS, the City and Association have met and conferred in good faith pursuant to provisions of the Meyers-Milias-Brown Act, on all matters relating to employment conditions and employer/employee relations, including wages, hours, and other terms and conditions of employment; and WHEREAS, pursuant to said Meet and Confer process, City and Association have reached the following agreement relative to any changes in wages, hours and other terms and conditions of employment and have hereby entered into this Memorandum of Understanding. SECTION 1. MEET AND CONFER PROCESS This Memorandum of Understanding is made and executed pursuant to Government Code Section 3500, as amended, and hereby satisfies City's duty to meet and confer with the Association during the period of this Agreement. The term of this Agreement shall be for a period of one year, commencing July 1, 1991, and ending June 30, 1992. SECTION 2. SALARY ADJUSTMENT A salary increase of 3.7% is hereby approved as reflected on the attached schedule of salary ranges dated July 1, 1991. This percentage reflects a negotiated cost of living increase of 5.0%, minus 1.3% as referenced in Section 3 of this Memorandum of understanding. SECTION 3. PERS PROGRAM ADDITION City agrees to implement the modification to the PERS Program 2% at age 55, replacing the PERS Program 2% at age 60. For consideration of the implementation of said Program, the employees hereby agree to share in the cost of the program by accepting a deduction of the negotiated cost of living increase of 5.0%. Additionally, in the event that any future cost of living increase shall be less than 1.3%, the City shall absorb the entire cost of the program and grant no cost of living increase. SECTION 4. FIVE YEAR PINS City agrees to implement a program to provide an anniversary pin to employees who have obtained or shall obtain five 5) years of service with the City. SECTION 5. TOYS FOR TOTS PROGRAM City agrees to designate a location of City property to be a collection point for the Toys for Tots Drive. This location shall be made available for said purpose during the months of November and December. This Memorandum of Understanding is hereby executed and/or ratified this 18th day of June, 1991, by and between the following authorized representatives of the City and the La Quinta City Employees Association.
