RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA *UINTA
DETERMINING THAT PUBLIC AGENCY ACCESS RIGHTS TO CERTAIN
REAL PROPERTY ARE NO LONGER NEEDED BECAUSE ACCESS BY
PUBLIC AGENCIES TO SAID CERTAIN REAL PROPERTY IS NOW
PROVIDED BY ALL WEATHER STREET IMPROVEMENTS AND ACCESS
RIGHTS VIA ANOTHER ROUTE
WHEREAS, the City Council of the City of La Quinta adopted Resolution 8e-48
that conditionally vacated the Adams Street right of way and by condition #4 of said
Resolution reserved access rights for public agencies for ingress and egress of fire,
police, and other emergency service vehicles and personnel; and
WHEREAS, said access rights, when reserved by said resolution, were across
unimproved land and intended to serve as a means of access to properties not located
adjacent to public streets until an alternate means of access was provided and
WHEREAS, all property contiguous to that portion of the easement that crosses
lots4, 5,8,12,13,14, and l6ofTract 25389-1, intheCityofLaQuinta, as per map
recorded In Book 221 pages 30 through 37 inclusive of Maps, in the Office of the
County Recorder of Riverside County, California, is now served by equivalent
easements that underlie improved private streets through said tract and Tract 26016,
as per map recorded in Book 227 pages 71 and 72 of Maps, in office of same County
Recorder; and
NOW, THEREFORE, the City Council of the City of La Quinta does hereby
find, determine, order and resolve as follows:
Section 1 That portion of the access easement reserved by Resolution 88-48
in the former Adams Street right of way that crosses lots 4, 5, 6, 12, 13, 14, and 16
of Tract 25389-1 is no longer needed by public agencies that provide emergency
services because all property formerly served by said easement 15 flOW served by the
improved private streets with equivalent underlying access easements in Tract
25389-1 and Tract 26016.
Section 2 The City Manager shall execute a Quitclaim Deed that does forever
remise, release, and qultclalm to the owner or owners of record of lots 4, 5, 6, 12,
13, 14, and 16 of Tract 25389-1 the easement that is reserved in condition #4 of
Resolution 88-48 of the City Council of the City of La Quinta,
PASSED, APPROVED, and ADOPTED this 21st day of October, 1991.
