WHEREAS, the City Council did adopt its Resolution
92-05, declaring its intention to vacate certain portions of
Calle Paloma and Washington Street pursuant to the Public
Streets, Highways and Service Easements Vacation Law; and,
WHEREAS, said Resolution 92-05 fixed February 18,
1992, at the hour of 7:00 P.M. in the La Quinta City Hall
Council Chambers as the time and place for hearing all persons
interested in or objecting to the proposed vacation; and,
WHEREAS, a Notice of Public Hearing was posted in
the time and manner provided by law along said portions of the
streets to be vacated in the time and manner provided by law;
and
WHEREAS, the Planning Commission has determined
that the vacation of said street is not in conflict with the
Circulation Element or other policies of the General Plan; and,
WHEREAS, the City Council has conducted its
required public hearing and, upon hearing and considering all
testimony and arguments of all interested persons desiring to
be heard, did find the following facts to exist to justify the
approval of said street vacation:
1. The vacation of a portion of the Calle Paloma &
Washington Street right -of -Way as proposed is consistent
with the La Quinta General Plan.
2. The portion of Calle Paloma & Washington Street proposed
for vacation is not needed to serve any.substantive
public benefit associated with traffic circulation.
3. The proposed vacation of Calle Paloma & Washington Street
will benefit the public by providing for increased
traffic safety.
4. Approval of the proposed street vacation will not cause a
significant impact on the environment.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of La Quinta, California as follows:

SECTION 1: The City Council of the City of La
Quinta, having elected to proceed under the provisions of
Division 9, Part 3, Chapter 2 of the Streets and Highways Code
of the State of California, and having held a public hearing as
provided therein, hereby finds from all evidence submitted that
the streets described in this resolution are unnecessary for
present or prospective purposes and that the public interest
and convenience require the closing of said streets.
SECTION 2: The City Council hereby orders the
vacation of portions of streets described as follows in the
attached exhibits.
SECTION 3: In the proceeding herein adopted by
this City Council for vacation of the streets described in
Section 2, the City of La Quinta reserves and excepts from the
vacation the permanent easement and right at any time, or from
time to time, to construct, maintain, operate, replace, remove
and renew sanitary sewers and storm drains and appurtenant
structures in, upon, over and across any street or part thereof
proposed to be vacated and pursuant to any existing franchises
or renewals thereof, or otherwise, to construct, maintain,
operate, replace, remove, renew and enlarge lines of pipe,
conduits, cables, wires, poles and other convenient structures,
equipment and fixtures for the operation of gas pipe lines,
telegraphic and telephone lines, railroad lines, and for the
distribution or transportation of electric energy, petroleum,
and its products, ammonia, water and incidental purposes,
including access and right to keep property free from
inflammable materials, and wood growth, and to otherwise
protect the same from all hazards in, upon, and over all of
Washington Street right-of-way proposed for vacation.
SECTION 4: The City Council hereby determines that
the vacation of the streets described herein is required by
public interest, convenience, safety and welfare.
SECTION 5: The City Council hereby determines that
the vacation will not cause significant environmental impact.
SECTION 6: The Resolution for street vacation is
valid and shall be recorded if within 30 days of its adoption
quit claim deeds from the owners of Lots 96, 97 & 196, Desert
Club Tract, Unite No. 5, are executed and recorded as
recommended by the City of La Quinta Engineering Department.
The purpose of these deeds is to redistribute the vacated
street to the adjacent property owners in a manner which is
fair, equitable, and allows logical development and use of said
land.
SECTION 7: The City Council hereby determines that
the City Clerk is hereby authorized and directed to record a
certified copy of this Resolution in the office of the County
Recorder of Riverside County after Section 6 has been complied
with.

That portion of Calle Paloma (Lot "0") as per Map of Desert Club Tract Unit
No. 5, on file in Book 21 of Maps, Pages 61 and 62 thereof, records of the
Recorder of Riverside County, California, and a portion of Washington
Street (formerly Marshall Street).
Beginning at a point in the Westerly line of Lot 95 of said Desert Club
Tract, being the Southerly terminus of a 20.00 foot radius curve, on the
Westerly line of said lot, and Easterly Right of Way line of Marshall
Street, 30 feet distant from centerline of Marshall Street (measured at
right angles);
THENCE South 000 09' 30" East along the West line of said Lot 95 and along
the West line of Lot 96 of said Desert Club Tract, a distance of 211.57
feet;
THENCE Southeasterly and Easterly along a curve concave northeasterly,
having a radius of 20.00 feet, tangent to the last described course,
through a central angle of 1050 16' 00", for an arc distance of 36.75 feet,
(40.23' record) to a point of compound curve, from which point a line to
the radius point bears North 150 26' 30" West;
THENCE Northeasterly along a curve concave Northwesterly, having a radius
of 600 feet, through a central angle of 270 03' 08", an arc distance of
283.29 feet, (said curve being the Southerly and Southeasterly line of Lots
96 and 97, and Northerly and Northwesterly line of Lot "0" of said tract)
to a point of a cusp in the Southeasterly line of said Lot 97. A radial
line from that point to the radius point bears North 420 29' 38" West;
THENCE leaving said Southeasterly line of said Lot 97, Southwesterly and
Southeasterly along the arc of a curve, concave Easterly, having a radius
of 50.00 feet, through a central angle of 1120 37' 12" for an arc distance
of 98.28 feet to a point of cusp in the Northeasterly line of Lot 196 of
said tract. Said point being on the Northerly line of said lot, on a curve
