Dear Mr. Noya,
In regard to the above referenced applications, staff previously sent to you a letter
requesting your disposition in regard to this proposal, said letter dated July 13,
2009 (copy enclosed). To date, we have received no response to that letter.
Due to. the fact that we have had no response to the requestwithin the 30 -day
window as outlined in the referenced letter, and that there has. been adequate time
to contact this office and/or submit any pertinent information, we are considering
this application as abandoned, and are closing the case files.
Due to an outstanding balance deficiency related to legal review of the
development agreement application, no refund of application fees is available. If
