A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, AMENDING THE PERSONNEL
RULES PURSUANT TO THE 1995196 MEMORANDUM OF
UNDERSTANDING WITH LA QUINTA CITY
EMPLOYEES' ASSOCIATION
WHEREAS, the City Council is authorized and directed under the provisions of
Municipal Code Section 2.08.060(B) to adopt rules for the administration of the personnel
system created in that section; and,
WHEREAS, Resolution 88-29 established those rules which are commonly referred
to as the City of La Quinta Personnel Policies; and,
WHEREAS, it is necessary from time to time to amend those policies to provide for
an equitable system of personnel management in Municipal Government.
NOW, THEREFORE, BE IT RESOLVED TIIAT THE CITY COUNCIL OF
THE CITY OF LA QUINTA, CALIFORNIA DOES HEREBY AMEND RULE X
SECTIONS: 3.F. EXEMPT POSITIONS; 5. G. VACATION BUY BACK; 7.
F ADMINISTRATIVE LEAVE AND RULE XIV SECTION 7. LEAVES OF ABSENCE
WITH PAY AS FOLLOWS:
ADMINISTRATIVE LEAVE
PURPOSE: To provide administrative leave for certain management positions that are
exempt from overtime and compensatory time off this is an issue for non-
exempt).
POLICY:
I. EXEMPT POSITIONS
A. The following Department Directors and Professional/Management
employees are exempt from, and do not earn overtime and
compensatory time off:
1. City Manager

ACCUMULATION OF ADMINISTRATIVE LEAVE
D. The following positions shall be granted forty 40) hours of
Administrative Leave annually. The Administrative Leave time off
shall be allowed at the discretion of the respective Department
Directors:

Safety Manager is granted eighty 80) hours of Administrative Leave
annually. Any subsequent individuals in that position will accrue time
off in accordance with Section II.D of this policy.
RULE X. WORK SCHEDULES AND OVERTIME
Section 5. Vacation
G. VACATION BUY-BACK:
1. Mandatory: Vacation hours may be accumulated and carried over to
succeeding calendar years up to a maximum accrual of 320 hours. Accrued
vacation hours which exceed 320 hours as of the last pay period of November
of each year shall be paid at the employee's regular rate of pay as time worked
and shall be included in the second payroll check of December.
Notwithstanding the foregoing, existing employees whose vacation hours
exceed 320 hours as of July 1, 1995 will be assigned a maximum accumulation
amount equal to the amount of such employee's accrual of vacation time
accumulated as of July 1, 1995.
2. Optional: In addition to the above, employees with a minimum of 80 hours of
accrued vacation time as of the last pay period in November in any calendar
year, may receive pay at the employee's regular rate of pay, for a portion or
the entire amount over 80 hours, provided that the employee has taken at least
40 hours of vacation consisting of five consecutive work days, and excluding
holidays, in the prior year between December 1 and November 30.
Any employee desiring to exercise this option must n:ake a written request to
the Finance Director no later than November 15 in the calendar year for which
vacation buy back is sought. The buy back pay will be included in the second
payroll check of December.

RULE XIV. ADMINISTRATIVE LEAVES. REPORTS & RECORDS
Sec. 7. Leaves of Absence with Pay:
1. Family Illness Leave. If an employee requests to be absent from duty because of
an illness in his immediate family which requires his attendance, he may, at the
discretion of the City Manager, be granted leave from his accrued sick leave not to
exceed 6 days per year. For members of the immediate family: mother, father,
brother, sister, spouse, children, grandparents, grandchildren, in-laws and legal
guardians.
2. Bereavement Leave. Bereavement leave with pay, not to exceed 3 days, shall be
granted full-time employees at the discretion of the City manager. This shall be the
maximum time allowable based on demonstrated need and shall be limited to death
within the immediate family. For the purposes of this action, the following are
considered members of the immediate family: mother, father, brother, sister, spouse,
children, grandparents, grandchildren, in-laws, aunts, uncles, nieces, nephews and
legal guardians.

Quinta, California this 5th day of July, 1995, by the following vote:
