A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA APPROVING THE ELIMINATION OF CONOITIONAL USE PERMIT
93.005 AS IT PERTAINS TO TENTATIVE TRACT 28189 ANO CHANGE OF ZONE
95-078

WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 27th day of June,
1995, hold a duly noticed public hearing to consider the elimination of Conditional Use Permit 93-055 as it pertains
to Tentative Tract 28189 and Change of Zone 95-078 for 3.63 acres located south of 56th Avenue and east of
Jefferson Street, within The Quarry development, more particularly described as:
LOTS 33-38, INCLUSIVE OF TRACT 27728, BOOK 24911-13, IN THE NORTH
HALF OF SECTION 29, TOWNSHIP 6 SOUTH, RANGE 7 EAST, S.B.B.M.
WHEREAS, the City Council of the City of La Quinta, California, did on the 18th day of July, 1995,
hold a duly noticed public hearing to consider the above described application; and,
WHEREAS, said elimination of conditional use permit request has complied with the requirements
of the California Environmental Quality Act of 1970 as amended*, and adopted by City Council Resolution 83-68, in
that the Community IOevelopment Oirector has determined that the elimination of the conditional use permit will not
have a significant adverse impact on the environment and a Negative Oeclaration of environmental impact is
recommended; and,
WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any,
of all interested persons to be heard, said City Council did find the following facts and reasons to justify the
recommendation of said change of zone:
1. The proposed elimination of the conditional use permit will not adversely affect the planned development as
specified by the General Plan for the City of La Quinta, or by Tract 27728.
2. The proposed elimination of the conditional use permit as it applies to Tentative Tract 28189 and Change
of Zone will further the intent of the goals and policies of the General Plan to provide a variety of housing
types within the City.
3. There will be no significant impacts resulting from the elimination of the conditional use permit as it applies
to Tentative Tract 28189 or Change of Zone 95-078.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California, as
follows:
1. That the above recitations are true and correct and constitute the findings of the Council in this case.

2. That it does hereby approve of the elimination of Conditional Use Permit 93.005 as it applies to that area
contained within Tentative Tract 28189 and Change of Zone 95.078 for the reasons set forth in this
resolution and as illustrated in the map labeled Exhibit A", attached hereto.
